party of the first part, and
GEORGE SOLOMON and EILEEN SOLOMON, his wife, both residing at
1275 Mill CreekDrive, Southold, New York 11971
party of the second part,
WITNESSETH, that the party of the first part,by virtue of the power and authority given in and by said last
will and testament, and in consideration of ONE HUNDRED FORTY—SEVEN THOUSAND FIVE
HUNDRED and 00/100 ($147,500.00)--------=-------------------------------- dollars,
paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,situate,
lying and being in the Town of Southold, County of Suffolk and State of New York, being
known as part of lot no. 3 on a certain map entitled, "Map of ROBERT D. HAMILTON"
filed in the Office of the Clerk of the County of Suffolk on 4/22/93 as map no.
9343, said part of lot being bounded and described as follows:
BEGINNING at a point on the easterly side of Horton Avenue said point being
where the extreme easterly end of Oak Street intersects with the easterly side of
Horton Avenue;
THENCE from said point of beginning South 54 degrees 34 minutes 20 seconds
East, 19.13 feet, along the southerly end of a right of way;
THENCE still along said right of way North 34 degrees 56 minutes 10 seconds
East, 77.02 feet to lands now or formerly of Rosemary Byrnes;
THENCE along said lands South 67 degrees 39 minutes 00 seconds East, 177.50
feet to lands now or formerly of North Fork Church of Christ;
THENCE along said lands the following two courses and distances:
1) South 53 degrees 05 minutes 20 seconds West, 102.94 feet;
2) South 22 degrees 24 minutes 00 seconds West, 71.44 feet to lands now or
formerly of Swanson;
THENCE along said lands North 67 degrees 36 minutes 00 second West, 199.91
feet to the southeasterly side of Horton Avenue;
TEHNCE along the southeasterly and easterly side of Horton Avenue the
following courses and distances:
1) North 57 degrees 21 minutes 00 seconds East, 49.64 feet;
2) North 35 degrees 25 minutes 40 seconds East, 49.50 feet to the point or place
of BEGINNING.
BEING AND INTENDED TO BE the same premises in liber 11377 cp 124.
TOGETHER with all right, title and interest, it any, of the party of the first part in and to any streets and
roads abutting the above described premises to thecenter lines thereof;TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of decedent's death in said premises, and also
the estate therein, which the party of the first part has or has power to convey or dispose of,whether individ-
ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other Erurpose.
The word party" shall be construed as if it read "parties' whenever the sense of this indenture so requires.
