who died on the 23rd day of July nineteen hundred and ninety–five
party of the first part, and
CHARLES BOYAR, JR. , residing at 36 Drake Road, Scarsdale, New York 10583
party of the second part,
WITNESSETH,that the party of the first part, to whom letters
testamentary were issued by the Surrogate's Court, Suffolk County, New York
on April 24 , 1996 and by virtue of the power and authority given in and by said last will
and testament, and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of partial
distribution of estate pursuant to paragraph THIRD of Last Will and
Testament of Charles Boyar,

release unto the party of the second part, the distributees or successors and assigns of the party of the second
part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being iKjhc at Peconic , near Nassau Point, Town of Southold,
Suffolk County, New York, bounded and described as follows:
BEGINNING at a point marked by a concrete monument set on the
1 southerly line of Mason Drive at the northwesterly corner of the
premises herein described and the northeasterly corner of land now
or formerly of Wong (formerly Hinkle ) ; running thence along the
southerly line of Mason Drive, North 720 24 ' 30 " East 75 . 34 feet;
running thence South 120 08 ' 10 " East, a distance of 340 feet to
ordinary high water mark of Haywaters Cove; running thence in a
westerly direction along the ordinary high water mark of Haywaters
Cove , a distance of 75 feet to said land of Wong; running thence in
a northerly direction along the easterly line of said land of Wong,
North 120 08 ' 10 " West, a distance of 340 feet to the southerly line
of Mason Drive to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises as conveyed by deed
dated July 18 , 1977 and recorded the Suffolk County Clerk ' s
TAX MAP Office on July 22 , 1977 in Lib 8275

roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances,

the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ-
ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the distributees or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
Subject to the trust fund provisions of section thirteen of the Lien Law.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
