After investigation and personal inspection, the Board finds
and determines as follows:
By this appeal, appellant seeks permission to construct a
24' by 13'6" garage addition, to be attached at the southerly side
of the existing dwelling with a 4'6" by 9' breezeway in the sideyard
area. The setback proposed from the southerly property line is
seven feet. The premises in question is improved with a~one-family
framed dwelling with a 12' by approximately 6' accessory building
in the rearyard area and contains approximately 10,000 square feet
in area. The premises is located at the junction of two intersecting
streets. It is the opinion of this Board that sufficient hardship
or practical difficulties has not been shown inasmuch as a facility
as proposed by appellant may be constructed in the rearyard area
under the provisions in the Code specified for "accessory buildings."
The Board does not agree with the reasoning of appellant.
The Board finds that the relief requested is substantial in
relation to the Code requirements; that the relief requested is
not within the spirit of the zoning ordinance; that if the variance
were granted the character of the neighborhood would be adversely
affected; that the hardship or practical difficulty is not sufficient
to warrant the granting of this relief; that the circumstances are
not unique; that the relief may be obtained by a method other than
a variance; and that the interests of justice will be served by
denying the relief requested by this appeal.
On motion by Mr. Douglass, seconded by Mr. Grigonis, it was
RESOLVED, that Frank J. Abbadessa be denied a variance to the
zoning ordinance, Article III, Section 100-31 as applied for,
Appeal No. 2831.

~. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficulties or unneces*
sary HARDSHIP because the dwelling is located on a coz-nar plot bound on
the north side by Snug Harbor Road and on the east side by Maple
Lane. The contractor had evidentally located the building to the
limits of ordinance requirements. There was no consideration given
in the design of the dwelling for the possibility of adding a
garage. In order to attach a garage to the dwelling without a
breezeway, it will be necessary to block up the Master Bed Room
window which faces south and also block off quick egress from the
side door to the side yard. It would then be required to exit
from the side door into the garage and then out from the garage
into the side yard. In the event of an emergency such method of
egress could be hazardous to life safety. Access to the crawl space
under the house (no basement) will also be blocked off.
2. The hardship creotedis UNIQUEandisnotshared by all properties alike in the immediate
vicinity ofthisproperty and in this use district because the dwellings in the area
were all designed and built with attached garages and with two means
of proper egress. The motif of the dwelling design is Japanese in
character. Additions to such dwellings are done by separate buildings
with minor connections such as a breezeway.
3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the garage as designed with the breeze-
way would maintain the original design of the dwelling and in fact
enhance the character of the area. The south property line is
planted with trees which will screen the south side of the garage.
Entry will be directly off Maple Lane. The proposed addition will
aesthetically add to the design of the dwelling which will result
in upgrading the in~nediate area. Locating the garage at any other
location would in fact downgrade the design value resulting in
negative value to the character of the district.

Dear Mr. Abbadessa:
Reference is made in your most recent letter received
by the Board on September 8, 1981 concerning the construction
of a home at premises located on Maple Lane. All construction
within the township must be given approval by the Building
Department before it is commenced, and at any time during
regular office hours someone would be happy to make the files
available to you for inspection. If variances were granted,
the files would contain the written findings and determination
of the Board.
Among the findings in this Board's determination regarding
this appeal made June 18, 1981 is the opinion of the board that
sufficient hardship has not been shown and the fact that a
facility such as you propose may be constructed under the
provisions of the zoning code, Article III, without requiring
a variance.
It is also the consensus of the board mer~ers that the
reasons indicated for a rehearing are not sufficient to warrant
a motion among the board members to call for a rehearing.
Accordingly, the request for a rehearing is denied.

Dear Mr. Pell:
Reference is made to the enclosed copy of letter dated July 27,
1981 to the Board of Appeals requesting a rehearing regarding
an application made to the Board on June 11, 1981 for a variance
to build a garage adjacent to my dwelling with "insufficient
side yard." My application was denied without prejudice.
I learned of the above mentioned denial through the Suffolk Times.
I have not, as of this date, received formal notification.
During a conversation in early July with Mr. Charles Gregonis,
Chairman of the Board of Appeals, he suggested I re-apply for a
variance or write a letter requesting a rehearing. Naturally,
I chose to request a rehearing since submitting another application
would require considerable time and effort which, in my opinion,
would be an unnecessary expenditure of time and money on my part
and also of the tax payers money. My application and letter re-
questing a rehearing were very explicit in explaining the hardships
caused to me by not being allowed to build the garage where I have
planned it. The Board in its double denial to my request has
completely ignored the extreme hardships caused to me and is denying
me the right to protect and take full advantage of my capital
investment.
The ordinance of which I am requesting a variance requires a
distance of ten feet from a major dwelling to the side yard
property line. I have requested a variance of three feet which
would result in seven feet from the property line in lieu of the
specified ten feet. Any major dwelling built on the adjacent
property will be ten feet from the mutual property line resulting
in seventeen feet between dwellings.

I plan to lay a driveway to the proposed garage, a fairly large
house with an extension well beyond the thirty five foot distance
required by ordinance from a major dwelling to the property line
parallel to the road. I would like to know under what circumstances
the owner of the property has been allowed such a variance.
I called the Board of Appeals on August 12, 1981 to inquire on the
status of my request for a rehearing. I was informed that the
Board members discussed the matter and that since no one made a
motion a vote was not taken and therefore my request was denied.
I consider this a blatant, inexcused and prejudiced move on the part
of the Board members.
As a very irritated tax payer I am asking your office to look into
this matter as soon as possible and to inform me why (1) the
building on Maple Lane is allowed to be erected well beyond the
thirty five foot requirement, and (2) on what explicit grounds
my requests have been denied. If I do not receive satisfactory
replies, I will be left with no alternative but to take action
against the Board members, individually if necessary, to have
them show cause regarding this matter.
I apologize for the necessity of having to write such a letter to
your office. However, I am incensed by the seemingly calloused
concern of the Board members - or member - regarding the hardships
they are creating by their denial to grant me a variance to build
a dwelling seven feet from the property lime instead of ten feet.
I will appreciate a response from your office at your earliest
convenience. Thank you for your cooperation.

Gentlemen:
I have noted in the Suffolk Times that my appeal for a variance to
build an attached breezeway and garage on the south side of my
dwelling at Maple Lane and Snug Harbor Road, Greenport has been
denied without prejudice.
T~e denial of my appeal to build the structure as I have requested
will create an.extreme hardship for me for the following reasons:
1. There is presently no storage facilities in the
dwelling other than four clothes closets and a
p~ntry. The attic, foundation crawl spaces are
o~ no storage value. A small storage shed is my
only means of storing all outside furniture,
garden tools and equipment, and the many miscellaneous
items required in the maintenance of the dwelling
and its surrounding property. I have no area which
can be used as a workshop, an absolute necessity
in the upkeep of a dwellinE and property. I take
great pride in the appearance of my grounds and
keeping them in excellent condition requires that
I use a hand mower. A sit-down type would facilitate
care and cause less pressure on my back which, because
of a boating accident, causes me discomfort aftem
certain strenuous activities such as walking to mow
over 10,000 square feet of lawn. Since I have no
place to store a sit-down mower to protect it from
the elements and vandalism, I cannot take advantage
of having one.

I am forced to leave me car out in the elements
which in any area is detrimental. In Greenport,
where the salt air has a more deteriorating effect,
depreciation is accelerated. The vehicle represents
a sizeable investment which I can not replace now
or in the near future without financial hardship.
To erect the needed addition in any area other than
where proposed, will create further damaging hard-
ships. The property value will be down-graded and
it will be a blight on the community. I w~ll be
denied my right to appreciate my capital investment.
In one instance it would

instance it would be

them show cause regarding this matter.
I apologize for the necessity of having to write such a letter to
your office. However, I am incensed by the seemingly calloused
concern of the Board members - or member - regarding the hardships
they are creating by their denial to grant me a variance to build
a dwelling seven feet from the property line instead of ten feet.
I will appreciate a response from your office at your earliest

Gentlemen:
I have noted in the Suffolk Times that my appeal for a variance to
build an attached breezeway and garage on the south side of my
dwelling at Maple Lane and Snug Harbor Road, Greenport has been
denied without prejudice.
The denial of my appeal to build the structure as I have requested
will create an extreme hardship for me for the following reasons:
There is presently no storage facilities in the
dwelling other than four clothes closets and a
pantry. The attic~foundation crawl spaces are
of no storage value. A small storage shed is my
only means of storing all outside furniture,
garden tools and equipment, and the many miscellaneous
items required in the maintenance of the dwelling
and its surrounding property. I have no area which
can be used as a workshop, an absolute necessity
in the upkeep of a dwelling and property. I take
great pride in the appearance of my grounds and
keeping them in excellent condition requires that
I use a hand mower. A sit-down type would facilitate
care and cause less pressure on my back which, because
of a boating accident, causes me discomfort aftem
certain strenuous activities such as walking to mow
over 10,000 square feet of lawn. Since I have no
place to store a sit-down mower to protect it from
the elements and vandalism, I cannot take advantage
of having one.

I am forced to leave me car out in the elements
which in any area is detrimental. In Greenport,
where the salt air has a more deteriorating effect,
depreciation is accelerated. The vehicle represents
a sizeable investment which I can not replace now
or in the near future without financial hardship.
To erect the needed addition in any area other than
where proposed, will create further damaging hard-
ships. The property value will be down-graded and
it will be a blight on the community. I will be
denied my right to appreciate my capital investment.
In one instance it would require the destruction of
a beautiful old weeping willow tree and pines to create
an awkward driveway off Snug Harbor Road. In the other
instance it would be necessary to erect the addition
in approximately the center of the now open and pleasant
property. In both instances it would be necessary to
remove the storage shed which is required in addition
to the garage; the addition cannot be attached to the
dwelling without further destruction and unnecessary
added costs; the view from the deck would be reduced
to the point of negative value.

Gentlemen:
Enclosed please find application for an appeal from decision
of the Building Inspector regarding a request for permit to
construct a garage addition to existing dwelling at 1200 Maple
Lane & Snug Harbor Road in Greenport.
The sketches included indicate the south side of the garage at
7'-0" from the southerly property line. The distance shown on
the permit application was 4'-0". The proposed addition was
moved northerly as much as possible and still maintain the
integrity of the design.
