TOGETHER with the right to the use of the following described strip of land to be used in common with others as a right of way Eugene Creek; BEGINNING at a point distant 449.83 feet easterly, when measured along the Northerly line of Fleetwood Road from the intersection of the Easterly side of Pequash Avenue with the Northerly line of Fleetwood Road and from said point of beginning running in a straight line and at right angles to the Northerly line of Fleetwood Road to the mean high water mark line of Eugene Creek; running thence in a generally easterly direction and along the mean highwater mark line of Eugene Creek a distance which would be equivalent to a distance when measured at right angles to the first course herein, 13 feet 6 inches; running thence in a general southerly direction and parallel to the first course herein to the northerly side line of Fleetwood Road and running thence westerly, along the northerly line of Fleetwood Road, a distance of 13 feet 6 inches to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premise conveyed to the grantors herein in deed dated Januaary 27, 1977, recorded on February 8, 1977 in liber 8188, cp 331. Together with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; Together with the appurtenances and all the estate and rights of the party of the first part in and to said premises; To Have and to Hold the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. And the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
