WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,

New York, known and designated as lot No. 8 on a certain map entitled "Map of Bennett's
Pond at Mattituck, Town of Southold, Suffolk Countv, New York" filed in the Office of the
Clerk of the County of Suffolk on June 12, 1970, as Map No. 5483, being more particularly

000 BEGINNING at a point on the westerly side of Bennett's Pond Lane distant 505.82 feet
southerly from the corner formed by the westerly side of Bennett's Pond Lane with the
Southerly side of Westphalia Road.
RUNNING THENCE along the westerly side of Bennett's Pond lane South 29 degrees 22
minutes 50 seconds East 125 feet;
'13 RUNNING THENCE South 60 degrees 37 minutes 10 seconds West 207.49 feet;
RUNNING THENCE North 29 degrees 32 minutes 00 seconds West 125.00 feet;
RUNNING THENCE North 60 degrees 37 minutes 10 seconds East 207.82 feet to the westerly
side of Bennett's Pond Lane to the point or place of BEGINNING.
It77 �i� TOGETHER with an undivided one-tenth (1/10th) interest in two strips of land shown and
designated as "Park" on the "Map of Bennett's Pond" filed in the Office of the Clerk of the
County of Suffolk on June 12, 1970, as Map No. 5483. SUBJECT TO a maintenance charge not
` to exceed $10.00 in any one calendar year for the upkeep of said park areas.
f TOGETHER with a right of way of ingress and egress and for public utility easements over
proposed roads to and from the subject premises as shown on the "Map of Bennett's Pond"
filed in the Office of the Clerk of the County of Suffolk on June 12, 1970, as Map No. 5483, to
the nearest public highway. The party of the first part reserves the fee to said proposed roads
for the purpose of their dedication to the Town of Southold as public highways.
SUBJECT TO covenants and restrictions of record filed in Liber 6797 page 357.
BEING AND INTENDED to be the same premises conveyed to Douglas O. Bailey and Jutta
Bailey be deed recorded in Liber 7110 Cp. 7.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part y?vggants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AN ,the party of the first part, in,rompiiance with Section 13 of the Lien Law, covenants that the party of
the rst part;will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a. frust-fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
