WITNESSETH, th1t the party of the first part, in consideration of Ten Dollars and other valuable con-
sideration paid by the party of the second part, does hereby grant and release unto the party of the se-ond
part,_ the heirs or successors and assigns.of the party of the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck,
Town of Southold, County of Suffolk and State of New York, known and described as
part of Lot No. 5 plus a ten foot strip on "Map of Caption Kidd Estates" filed in the
Office of the Clerk of the County of Suffolk on January 19, 1949 as Map No. 1672 and
more particularly described as follows:
BEGINNING at a monument on the southeasterly line of Sound Beach Drive 12.0 feet
northeasterly along said southeasterly line from the southwesterly line of said Sound
Beach Drive, said point of beginning being a northerly corner of Lot N4 as shown on
"Map of Captain Kidd Estates" filed in the Suffolk County Clerk's Office as Map No.
1672; from said point of beginning;
RUNNING THENCE along said southeasterly line of Sound Beach Drive, North 57
degrees 30 minutes East. a distance of 100 feet;
THENCE South 29 degree< 55 minutes 20 seconds East a distance of 261.58 feet;
THENCE Southwesterly through Lot No. 5, South 60 degrees 04 minutes 40 seconds
West a distance of 113.35 .`ect;
THENCE along the nort )easterly line of Lot No. 4, North 26 degrees 56 minutes 00
seconds West, a distance of 257.45 feet, to the point of BEGINNING.
TOGETHER WITH an easement of ingress and egress for vehicular and pedestrian
passage over a ten foot strip of land along the easterly line of the southerly portion of
Lot No. 5, as described in a deed between Steve Tsontakis and Aglaia Tsontakis,
recorded in Liber 7061 p':tge 496, from Central Drive to said land.
SAID PREMISES being known as and by street numberl800 Central Drive, Mattituck, N.Y.
BEING and intended '-_o be the same premises conveyed to FRANKLIN H. ORNSTEIN andSUSAN
ORNSTEIN, his wife, by deed dated 4/10/81 recorded 4/16/81 in Liber 8989 page 213.

and roads abutting the al ove-described premises to the center lines thereof; TOGETHER with the appur-
tenances and all the eslaie and rights of the party of the first part in and to said premises; TO HAVE AND
TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns
of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party'of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such con-
sideration as a trust fund to be applied first for the purpose of paying the cost of the improvement an(] will
apply the same first to the payment of the cost of the improvement before using any part of the total of the
same for any other purpose.
The word "party"shall be construed as if it read "parties" whenever the sense of this indenture so requires.
