(631) 765-1809 Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF DECEMBER 29, 2004 ZB Ref. 5621 - Ellen Schulteis Property Location: 920 Meday Avenue (a/k/a 430 Illinois Ave), Mattituck; CTM 113-11-4.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 12,198 sq. ft. lot has frontage along two roads, Illinois Avenue to the west and Meday Avenue to the north. The lot is improved with a single-story, one -family dwelling located in a nonconforming location with 23.4% lot coverage. BASIS OF APPLICATION: Building Department's December 3, 2003 Notice of Disapproval, amended September 21, 2004, citing Sections 100-242A and 100-244B, in its denial of a building permit to construct additions and alterations. The reasons stated in the Disapproval are that the new construction is not permitted because such additions will increase the degree of nonconformance, with a rear yard setback of 19.6 feet, single side yard of 5.6 feet, and lot coverage at 29.6%. The existing setbacks of the one-story dwelling as exist are 17.5 feet from the rear yard line, 5.6 feet on a single side. The existing lot coverage is noted as 23.4%. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 18, 2004 and December 16, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant originally requested the following variance relief to construct additions and alterations to the existing single-family dwelling as shown on the November 12, 2003 survey, revised September 10, 2004 for: (a) a proposed increase in lot coverage from 23.4% to 29.6%; (b) a proposed garage addition 12.5+- feet from the easterly (side) line at its closest point; (c) conversion to living space of the existing garage which is 5.6 feet from the easterly (side) line at its closest point, after attaching it as part of the principal dwelling; (d) proposed second-story addition starting at 26+- feet from the rear property line, beyond the existing 17.5 ft. rear yard setback, and 7.9 ft. front yard setback. Page 2 - December 29, 2004 ZB Ref. 5621 - Ellen Schulteis CTM Id: 1 13-1 1-4.1 ADDITIONAL INFORMATION:AMENDED RELIEF: During the November 18, 2004 public hearing, the applicant was requested to reduce the proposed lot coverage for a possible alternative plan that would be more conforming to the code's 20% lot coverage limitation. On December 10, 2004, the applicant submitted a revised survey plan for 25% lot coverage, reduced from the original request of 29.6%. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant does not propose to increase the existing setbacks, rather the request is to fill in the existing foot print and to add a second story to a portion of the building. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot is small and the house, as exists, already exceeds the minimum requirement of lot coverage and setback from the property line. 3. The variance granted herein is not substantial. 4. The difficulty was not self-created. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The proposed construction will have a side yard setback of 5.6, a rear yard setback of 19.6 feet, and a total lot coverage of 27 percent. Therefore, the proposed addition is not permitted pursuant to Article XXVI, Section 100-244, which states that non-conforming lots, measuring less than 20,000 square feet in total size, require a minimum side yard setback of 10 feet and a rear yard setback of 35 feet.
