sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or

c. The work covered by this application may not be commenced before issuance of Building Permit.
, d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues,a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of

property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Is retumed herewith and disapproved on the following grounds:
The "as built" hot tub on a non-conforming, comer parcel, is not permitted pursuant to
Article XXIII Section 100-239.4B, which states:
"All buildings or structures located on lots upon which a bulkhead ...exists &
which are adjacent to tidal water bodies other than sounds shall be set back not
less than 75' of the bulkhead."
The existing survey indicates the hot tub in the front yard, at a distance of approx. 25'
to the retaining wall.

Furthermore, the proposed 2 story addition is not permitted pursuant to Article XX1V
Section 100-242 which states:
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a non-conforming building containing a conforming use, provided that
such action does not create any new non-conformance or increase the degree of non-
conformance with regard to the regulations pertaining to such buildings."
Pursuant to the ZBA's interpretation in Walz (#5309), such additions & alterations will
thus constitute an increase in the degree of nonconformance.
The minimum side yard setback is proposed at 8.2'.
Pursuant to Article XXIV Section 100-244 such buildings on lots less than 20,000 sq. ft.
require a minimum setback of 10'.

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF NOVEMBER 9, 2006

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review fails under the Type II category of the State's List of Actions,
without further steps under SEQRA.
PROPERTY FACTS/DESCRIPTION: The applicant's 9,488 sq. ft. non-conforming parcel is a corner lot with
two front yards, improved with a single-family, one-story dwelling with garage as shown on February 21, 2006
survey prepared by Stanley J. Isaksen, Jr. The property is 55.23 feet wide, fronting along West Shore Drive,
and 172 feet width fronting along Oak Drive, 55.15 feet along near the high water line of Southold Bay, and
168 feet along Lot 24 (now or formerly of F. Ghavimi).
BASIS OF APPLICATION: Based on the applicant's request for a building permit and the Building Inspector's
August 21, 2006 Notice of Disapproval citing Sections 100-239.4B (280-116), 100-242 (280-122) and 100-244
(280-124), variances are requested: (1) for an as-built hot tub structure located less than 75 feet from the
bulkhead, and (2) for a second-story addition over the existing first floor which will constitute an increase in
the degree of nonconformance when located less than 10 feet from the side lot line.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on October 26, 2006, at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of
the properly, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicants are requesting approval of an as-built (hot tub)
structure in the front yard at 27.5 feet from the retaining wall adjacent to a beach area (common use) at
Southold Bay. The a~p,r, ii~R~ wishes to construct a second-story addition over the existing deck over

REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:
l. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a
detriment to nearby properties. The existing hot tub structure is screened with evergreens and the addition to
the house is in keeping with homes in the area, utilizing the same footprint of the garage at lower level for a
second story.

2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicant to
pursue, other than an area variance. The lot is long and narrow, and placing a hot tub in any location on this
lot would require some degree of relief. The second-story addition will not increase the building footprint sized
that is currently covering the lot.
3. The variance granted herein is substantial. With respect to the hot tub, the setback relief is substantial
representing a 66% reduction from the code-required 75 ft. minimum setback from the bulkhead. The addition
will only increase the bulk of the house addressed in the Interpretation rendered under ZBA Appeal No. 5039
(Walz), and not the actual side yard or front yard setbacks.
4. The difficulty has not been self-created.
5. No evidence has been submitted to suggest that a variance in this residential community will have an
adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of a hot tub structure and second-story addition, while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Goehringer, and
duly carried, to
GRANT the variance as applied for, as shown on the site survey prepared February 21,2006 by
Stanley J. Isaksen, Jr. and shown on the elevation diagram date-stamped September 8, 2006, subject
to the following Condition: That the area within the new nonconforming setback created by the hot tub
shall not be used~,enclosed or planned for future livable space.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams
or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This
action does not authorize or condone any current or future use, setback or other feature of the subject property that may
violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the dght to substitute a similar design that is de minimis in nature for an alteration that does not
increase the degree of nonconformity.

Findings: The project meets all the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code. The

Dear Mrs. Volpe:
Based on the information you have submitted the Department of Environmental Conservation
has determined that the property landward of the existing retaining wall and the 22' elevation
contour line to the east (top of the bluff) as shown on the survey by Stanley J. Isaksen, dated
2/21/06, last revised 6/23/06, is beyond Tidal Wetlands Act (Article 25)jurisdiction. Therefore,
in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no
permit is required.
Be advised, no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit.
It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation within Article 25 jurisdiction
which may result from your project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide
construction area) or erecting a temporary fence, barrier, or hale bay berm.
Please note that this letter does not relieve you of the responsibility of obtaining any necessary
permits or approvals from other agencies or local municipalities.
