LEGAL
The subject property consists of two non-contigous parcels that are legally
identified on the Suffolk County Tax Map as District 1000, Section 55, Block 01, Lot 8
and District 1000, Section 55, Block 02, Lot 9.1. The subject's land area consists of
63.8 + acres in total.
LAND
The appraised property consists of two parcels of land that are separated by
Railroad Avenue (Youngs Avenue). The westerly pamel is an irregular shaped tract with
1,674' of ~"ontage on the westerly side of Youngs Avenue. The southerly boundary runs

with a total length of 608 +' of which, 396 +' is frontage on the easterly side of Horton's

The easterly parcel is also an irregular shaped tract of land with 1,357+' of

Access to the westerly pamel can be obtained from Hortons Lane, Old North
Road and Youngs Avenue. All of these roads are two lane, macadam paved, town
owned and maintained roadways. Utilities available along these roads include electric
and telephone lines. In this area water is supplied by private well and sanitary waste ·
by on site cesspool. It should be noted that upon inspection of the site, it is apparent
that a utility easement encumbers a portion of the subject site as there are presently
elevated high tension electrical lines spliting both subject parcels.

of development rights of agricultural lands owned by Berkman, Courtenay, and
Dickerson. At this time, the proof of verification and publication of such change

given that pursuant to the provisions of the Agricultural Lands Preservation Law
of the Town of Southold, constituting Chapter 25 of the Southold Town Code,

Southold Town Clerk." I have a notice, that, I as Town Clerk, posted this
on the Town Clerk's Bulletin Board, that it was published in The Suffolk Times,

and The Long Island Traveler-Watchman. I have a letter, a memorandum, to the
Town Board, at the request of the Town Board from Arthur Ross, Chairman of
Land Preservation Committee, dated May 28, 1992. This is written in response
to the request of the Board for a brief report outlining the selection criteria for
the Moelius, I'll explain, was a hearing we held two weeks ago. Berkman, Courtenay,
and Dickerson parcels, which were recommended to the Board for purchase of
development rights by the Town. In carrying out it's role as advisor to the Board,
the Land Preservation Committee, and it's predecessor committees, has sought
to avoid the restrictions inherent in a list of criteria, which a property must meet
in order to be considered for recommendation to the Board. While I can not speak
for specific decisions of the Farmland Preservation Committee, since it's inception,
Bob Villa, and Gerry Dennahy have shared my concern, that the program not
be subiect to challanges on the grounds, that rigid specifications were not met in
each, and every case. At the same time, my colleagues and I, have been mindful
of the need for guidelines, other than appraisal value for our decision making.
This need became all the more evident when applications increased after the voters
approved the renewed Farmland Program in November, 1991. After thorough
discussion we reported a list of factors for committee deliberation, which are
included in the minutes of our meeting of March 10, 1992, which you received.
A copy is enclosed with this letter. These factors are not set in stone. We
expect to change ~hem from time to time, but they serve for the present. Another
prime consideration entered our deliberations on Moelius, 13erkman, Courtenay,
and Dickerson properties. All four have been referred on to the County, when
Town funds appropriated on the early program had been exhausted. While the
County purchased many Southold Town farms, these four were among those frozen
in the pipeline of County procedures, and we gave them priority. The Berkman
eighteen acre parcel was selected from two offerings made by the same owner,
It adjourns a farm on which the County purchased development rights to thirty-seven
acres. The twenty acre Courtenay property in Mattituck is prime farmland in an
area where several farm families are considering the sale of development rights.
This purchase might be an incentive to go forward. The sixty-two acre Dickerson
parcel was choosen from two offered by this local family. It is east, and west
of Railroad Avenue, otherwise known as Youngs Avenue, north of County Route
48, and may well be the northern boundary of the hamlet of Southold in the future.
I will read the factors for committee deliberation. Their~ statute is a bonafide
agricultural production will conserve, protect and encourage the improvement of
prime agricultural lands, both for the production of food and the preservation
of open space. Other, ten acres or more, current production, reasonably accessible
open space factor, resident farmer, probably of development, proximity to other
property under protection from non-farmland use, physical characteristics, and/or
impairment, readily available for transfer, visability, scenic, fertility, soil quality,
and then when have some other data supplied by the Assessors, that is in the
file, and may be examined at any time, as well as information from our accountant
concerning the method, the debt schedule concerning the bond should we purchase
these properties.

OPTION AGREEMENT

hereinafter described as the Optionor, and the TOWN OF SOUTHOLD, a
municipal corporation of the State of New York having its office and principal
p]ace of business at Main Road, Southoid, New York, hereinafter described as
the Optionee.
WITNESSETH:
1. In consideration of the sum of Ten ($10.00) Dollars, paid by the
Optionee, the Optioner does hereby give and grant to the Optionee the
exclusive option, right and privilege to purchase the premises at Southold, New York,
also Known on the Suffolk County Tax map as Dist.1000-55-2-8 and 1000-55-2-9
and more particularly described in Schedule A annexed hereto, made a part
hereof, and initialed by the parties hereto.
2. That this option shall continue in effect until 12 o'clock midnight
on the 60th day after the Southold Town Board holds a public hearing on the
question of the acceptance of this option, as required and provided in Section
25-q0 of Chapter 25 of the Southold Town Code. The Optionee represents that
it will hold such public hearin9 within 45 days from the date hereof. In the
event that the Optlonee fails to hold such hearing within 45 days from the date
hereof, the Optionor shall have the right to terminate this option by giving
written notice of termination to the Southold Town Clerk.
3. The total purchase price shall be $6,500.00
ollars per acre of land, to be paid by the Optionee, if this option is
exercised, as provided in the annexed form of agreement.
4. If this option is exercised by the Optionee as herein provided,
the Optionor and the Optionee will respectively as seller and purchaser perform
the obligations set forth in the form of agreement to be performed by the seller
and the purchaser therein, said form of agreement being annexed hereto and
made a part hereof, and marked Exhibit A.

part, as a covenant running with the land in perpetuity, further covenants
and agrees for the party of the first part, and its heirs, legal
representatives, successors and assigns of the party of the first part, to
use the premises on and after the date of this instrument solely for the
purpose of agricultural production.
AND the party of the first part, covenants in all aspects to comply with
Section 13 of the Lien Law, as same applies with said conveyance.
The definition of "Agricultural Production" as defined in Section 25-30
of Chapter 25 of the Southold Town Code is as follows:
"Agricultural Production shall mean the production for
commercial purposes of crops, livestock and livestock
products, but not land or portions thereof used for
processing or retail merchandising of such crops, livestock
or livestock products. Land used in agricultural
production shall also include fences, equipment storage
buildings, livestock barns, irrigation systems, and any
other structures used exclusively for agricultural
purposes."
The party of the first part and the party of the second part do hereby
covenant and agree in perpetuity that either of them or their respective
heirs, successors, legal representatives or assigns, shall only use the
premises on and after this date for the purpose of such agricultural
production and the grantor covenants and agrees that the underlying fee title
may not be subdivided into plots by the filing of a subdivision map pursuant
to Sections 265 and 277 of the Town Law and Section 335 of the Real Property
Law, or any of such sections of the Town or Real Property Law or any laws
replacing, or in furtherance of them.
The word "party" shall be construed as if it reads "parties" whenever
the sense of this indenture so requires.

1] The Seller agrees to sell and convey, and the Purchaser agrees to
purchase the Development Rights, as hereinafter defined, in ALL that certain
plot, piece or parcel of land, situate, lying and being in the Town of
Southold, County of Suffolk and State of New York, more particularly bounded
and described as set forth in the description annexed hereto as RIDER "A".
2] Development Rights, as authorized by 247 of the New York State
General Municipal Law, as amended shall mean the permanent legal interest
and right to permit, require or restrict the use of the premises exclusively
for agricultural production as that term is presently defined in Chapter 25 of
the Southold Town Code, and the right to prohibiLor restrict the use of the
premises for any purposes other than agricultural production. By the sale of
such development rights.and interest, the Seller shall be deemed to have
covenanted and agreed that the Seller, and the heirs, legal representatives,
successors and assigns of the Seller, shall only use the premises, on and after
the date of delivery of the instrument of conveyance to the Town,~or such
agricultural production. Such covenant shall run with the land it perpetuity.

any other person or the public may have any rights, but title to the

5] The deed shall be in the form approved by the Town Attorney, and
shall be duly executed and acknowledged so as to convey to the Purchaser
Development Rights of the said premises, free of all liens and encumbrances,
except as herein stated, and said deed shall contain such trust clause as is
required by law.
If the Seller is a corporation, it shall 'deliver to the Purchaser at the
time of the delivery of the deed hereunder a resolution of its board of
directors authorizing the sale and the delivery of the deed, and a certificate
by the secretary or assistant secretary of the corporation certifying such
resolution and setting forth facts showing that the conveyance is in
conformity ~¥ith the requirements of 909 of the Business Corporation Law. The
deed in such case shall contain a recital sufficient to establish compliance with
said section.
6] At the closing of title the Seller shall deliver to the Purchaser a
certified check to the order of the recording officer of the county for the
amount of the docur~entary stamps to be affixed thereto in accordance with
Article 31 of the Tax Law.
7] Any sums paid or~ account of this contract and the reasonable
expenses of the examination of the title to said premises and of the survey, if
any, made in connection therewith are hereby made liens on said premises,
but such liens shall not continue after default by the Purchaser under' this
contract.
8] The Seller agrees that the underlying fee title retained by the Seller
may not be subdivided into plots by the filing of a subdivision map pursuant
to 265 and 277 of the Town Law and/or 335 of the Real Property Law, or
laws, amending or replacing the same. The underlying fee may be divided
only pursuant to applicable provisions of law and upon approval of the Town
Planning Board or its successor. The provisions of this section shall survive
delivery of the instrument of conveyance.
9] Rights hereunder sold are sold and are to be conveyed subject to:
NO EXCEPTIONS.
10] The Purchaser'may make its determination of whether the premises
are free from all encumbrances, except as stated, as set forth in Paragraph
5, on the basis of its own examination of the title, or that of its agents, or a
title report of a member company of the New York Board of Title Underwriters,
and may require the Seller to clear title exceptions raised to the satisfaction
of the Purchaser, and if any is involved, the title company.
11] If at the date of closing there may be any other liens or encumbrances
which the Seller is obligated to pay and discharge, the Seller may use any portion
of the balance of the purchase price to satisfy, the same, provided the Seller
shall simultaneously either deliver to the Purchaser at the closing of title,
instruments in recocdable form and sufficient to satisfy such liens and
encumbrances of record together with the cost of recording or filing said
instruments. The Seller agrees to sign such proper vouchers for the
closing check(s) as may be requested by the Town Fiscal Officer at least two
weeks prior to the date fixed for closing. The Purchaser, if request is made
withing a reasonable time prior to the date of closing of title, agrees .to
provide at the Closing separate checks as requested, aggregating the amount

of the purchase price, to facilitate the satisfaction of any such liens and
encumbrances shall not be deemed objections to title if the Seller shall comply
with the foregoin9 requirements.
12] If a search of the title discloses judgments, bankruptcies or other
returns against other persons havin9 names the same or similar to that of the
SelIer, the Seller will, on request, deliver to the Purchaser an affidavit
showin9 that such judgments, bankruptcies or other returns are not against
Seller, if such is the case.
13] In the event that the Seller is unable to convey title in accordance
with the terms of this contract, the sole liability of the Seller will be to pay
the cost of examinin9 the title, by the PurChaser, the Purchaser's a9ents, or
the Purchaser's title company, which cost is not to exceed the charges fixed
by the New York Board of Title Underwriters, and the cost of any survey
made in connection therewith incurred by the Purchaser and upon such
payment bein9 made, this contract shall be considered cancelled.
14] The Seller, simultaneously with the execution and delivery of this
Agreement, has also delivered the required verified public disclosure
statement for filin9 with the Town Fiscal Officer. At the time of the closing,
the Seller shall submit a then applicable such statement or a sworn statement
that there have been no changes in interest since the date of this A9reement.
Any evidence of a conflict of interest or prohibited contractural relationship
shall require approval of the contract and sale by the Supre~me Court.
15] The deed shall be delivered upon the receipt of said payments at the
office of the Supervisor, Southold Town Hall, Main Road, Southold, New York.
16] The parties agree that no broker brought about this sale.

17] It is understood and agreed that all understandings and agreements
had between the parties hereto merged in this contract, which, with the
exhibits, fully and completely expresses their agreement, and that the same is
entered into after full investigation neither party relyin9 upon any statement
or representation made by the other, not embodied in this contract.
18] The agreement may not be changed or terminated orally. The
stipulations aforesaid are to apply to and bind the heirs, executors,
administrators, successors and assigns of the respective parties.
19] If two or more persons constitute the Seller, the work "Seller" shall
be construed as if it read "Sellers" whenever the sense of this Agreement so
requires.
20] The closin9 date shall be on or about November 15, ~992 at the
Southold Town Hall, Main Road, Southole, New York.

I am writing you at the suggestion of Joseph Gold, Esq., Chairman of the Land
Preservation Committee. My husband and I recently asked the Dickerson family if they would
be willing to sell us a portion of the 40+ acre site (Tax Map Designation 1000-55-1-8.2) on
Youngs Avenue (the "Site"). Howard Dickerson stated the family was told at the time the
development rights were sold that the Site could not be further divided.
Unfortunately we can not afford all 40+ acres, but are in a position to purchase
approximately 15 acres. The Site currently is being leased for growing potatoes. If we bought
a portion of the Site, we would plant grapes. We understand that the Site may be used for
agricultural purposes only.
The Dickerson family agreed to let me approach the Town of Southold to inquire
whether it would be permissible for the owners of the Site to divide the Site into two parcels in
order for a portion of the Site to be sold to another party. I placed several telephone calls to
various Town of Southold officials and ultimately was directed to Mr. Gold. Mr. Gold asked
me to put the question in writing and direct the question to you as Southold Town Clerk. If
you determine that it is permissible to set off a portion of the Site for sale to another party,
please let me know the procedures the Dickerson family and we would need to follow in order
to accomplish the set off.

At the direc3i, 'on of the Town B~ard, the Agricultural Advi~y Committee reviewed the
Dickerson Farmland split request. The Town of Southold has purchased Development Rights to
the Dickerson farm Tax Map Designation 1000-55-1-8.2. It is our understanding that deed
restrictions do not allow for further divisions. At our meeting after reviewing the Town At tomey
Memorandum dated December 12, 1996, other Possibilities exist. Joe Gold Esq., Chairman of the
Land Preservation Committee, also attended the meetiag and gave the ag. committee an overview
of his committ~ and the parcel in question. Howard Dickersor, a member of the agricultural
committee pa'ovided a survey map and explained the lay of the land as well as soil structure
current uses of the farm. Steve Mudd, a vineyard owner, also in attendance, added his exert;rise.
it is the opinion of those committee members present that a split of the Dickersoa
a~a ~-z of the southern portion of 18 acres is in the best interest of agricolture and Southuld
Town. We feel it does not compromise Southold Towns~ goal of Farmland Preservation. "/'he
split leaves both parcels significantly greater than t0 acres by Ag, and Markets definition.
Therefore, the Agricultural Advisory Committee recommends the Southold Town L',,ard
to take the necessary steps to split the Dickerson Farm maintaining all other present deed
restrictions.

feel that they have the ability to change the deed

Parker E. Dickerson and Betsey B. Dickerson, residing at 1485 Mill
Creek Road. Southold, New York and Chester M. Dickerson, residing at 155
Mountain View Road, Torrington, Connecticut (hereinafter referred to as
Owners) are now the owners of the fee title to the real property described on
Exhibit A attached hereto and incorporated herein, subject to a grant of
development rights made to the Town of Southold with offices located at 53095
Main Road. Southold. New York (hereinafter referred to as Town) on November
25. 1992 and recorded in Book 11584 Page 191 of the records of the Suffolk
County Clerk. Said grant of development rights contained a covenant that the
underlying fee title may not be subdivided under either state or local law.
In consideration of the sum of ten dollars ($10.00) and other good and
valuable consideration paid by Owner to Town, the receipt of which is hereby
acknowledged, Town hereby consents that the original covenant restricting all
subdivision is hereby changed and modified so that Owner, his heirs and
assigns, shall have the right to split off and sell the southeasterly eighteen (18)
acres of the property, on the condition that both resulting properties may only be
used for agricultural purposes and that no further subdivisions shall occur.

The following took place at a meeting of the Southold Town Planning Board on
Monday, September 15, 1997:
The final public hearing, which was held at 7:30 p.m. was closed.
The following resolution was adopted:
WHEREAS, Chester M. Dickerson, Parker E. Dickerson and Betsey B.
Dickerson are the owners of a 42.7253 acre parcel; and
WHEREAS, the Development Rights have been sold to the Town on 40.8799
acres of the 42.7253 acre parcel; and
WHEREAS, on March 4, 1997 the Southold Town Board approved an
Agreement for Modification of Restrictions between Parker Dickerson, Betsey
Dickerson and Chester Dickerson and the Town of Southold, giving the
Dickersons the right to split off and sell the southerly eighteen (18) acres of the
property with the condition that both resulting properties may only be used for
agricultural purposes and that no further subdivision shall occur; and
WHEREAS, the Dickersons have applied to the Planning Board to subdivide the
42.7253 acre parcel into two lots; and

WHEREAS, Lot 1, which is a total of 24.4211 acres, includes a 1.8454 acre area
on which the development rights are intact, and Lot 2, which is a total of 18.3042
acres does not include any development rights; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on June 9, 1997; and
WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southotd, New York, on September 15, 1997; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice
of Public Hearing, has received affidavits that the applicant has complied with
the notification provisions; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board approve and authorize the
Chairman to endorse the final surveys dated June 25, 1997.
Enclosed please find a copy of the map which was endorsed by the Chairman.
The mylar maps, which were also endorsed by the Chairman, must be picked up
at this office and filed in the office of the County Clerk. Any plat not so filed or
recorded within sixty (60) days of the date of final approval, shall become null
and void.

Parker Eugene Dickerson, a life-
long Southold resident, died April
27 at Eastern Lon. g Island Hospital.
He turned 84 on April 23.
Born at East-
ern Long Island
Hospital on
April 23, 1925,
to Mahlon and
Lillian (Bergen).
Dickerson, Park-
er grew up in the
Bayview area
of Southold. He
graduated from PARKER ~ DICKERSO~I
Southold High School in 1943. Af-
ter attending Miami University for
one year, he returned to Southold
to work on the family farm.
Parker married Betsey McDonnell
on Feb. 6, 1955. He continued farm-.
ing as co-owner of Dickerson Bros.-
Farm with his brother, Chester, un-
til their retirement in 1986. He and
Betsey moved back to the Bayview
farm in 2005.
Over the years. Parker's communi-
ty involvement took many forms. He
was a lifelong member of Southold
United Methodist Church, where he
sang in the choir for many years. He
served on the Southold school board
from 1975 to 1980. He was a commit-
teeman for the Agricultural Stabiliza-
tion and Conservation Service, served
as a Southold Park District commis-
sioner and as an assistant Boy Scout
leader with Southold Troop 6.
Parker was a descendant of Phi-
lemon Dickerson, one of Southold
Paid
Town's first settlers. In 1989, Parker
and his brother donated the Old
Bay View Schoolhouse, which had
served as their machine shop for
many years, to the Southold His-
torical Society. It was moved to the
museum grounds and opened to
the public in luly 1990 for Southold
Town's 350th anniversary.
He sang with the North Fork Cho-
rale, and was an accomplished bowl-
er, bowling with the Southold Men's
. League for more than 50 years, and
later with the Southold Seniors.
He took pleasure in reading, sing-
ing, boating and waterskiing. He
loved to tell the story of the motor-
cycle- trip to Florida he.~his brother
and cousin Halsey Goldsmith took
after World War II ended. Parker
could find enjoyment in just about
everything, particularly his many
friends and acquaintances and,
most of all, his family.
Besides his wife, he is survived
by his children, Howard Dickerson.
Nancy Dickerson and Lauren'Sis-
son; grandchildren lacob and Lucas
Sisson and Rudi and Eva Rosenthal:
and his sister, ]anis Krise. He was
predeceased by his brother in 2008.
Family received visitors May 1
at DeFriest-Grattan Funeral Home
in Southold. Funeral services were
held May 2 at Southold United
Methodist Church.

the request of Mike Verity of the Building Dept., the flat roof section will have to be
raised to a steeper pitch. For all this work, I will need a letter from your committee to the

Request for Land Preservation Committee Review of
proposed agricultural structure on property on which Town owns a
development rights easement
Dear Mr. Sisson:
The Land Preservation Committee Members, in accordance with Section
25-50 C. (2) [3] of the Town Code, reviewed the request you outlined in a letter
dated March 24, 2006, for a tractor and equipment storage building. Your letter,
with detailed information pertaining to the request, is attached for reference. In
summary, your letter requested the following to be located on the northeastern
corner of SCTM#1000-55-1-8.3:
· Tractor and equipment storage Morton building 42 ft x 90 ft.
Building to include; unheated storage area, heated shop area, small
office and bathroom.
· Agrichemical Mixing Facility adjacent to building.
The recorded easement for this property allows land within the easement
to be used for the purpose of agricultural production. Section 25-50-C. (2) [3]
requires that the Committee serve as a review board for the granting of permits
for the construction, reconstruction and additions of and to structures in or on
agricultural lands in which the Town has acquired the development rights.
The Committee met with you and then proceeded to review your request
at several Committee meetings. New Suffolk Land Company owns 3 adjacent
properties, one of which (SCTM# 1000-55-1-9) has all development rights intact
and does not have a development rights easement on it. The other 2 properties
(SCTM# 1000-55-1-8.3 and SCTM# 1000-55-1-8.4) each have a development
rights easement on 100% of the lot area. There are 2 small sheds currently
located on the property; one on SCTM# 1000-55-1-8.4 and one on SCTM# 1000-
55-1-9.
The Committee denied the requested location. The Committee discussed
alternative locations for the building and would prefer to have it located on the
property with development rights intact (SCTM# 1000-55-1-9) that would not
require the Committee's review or approval. Since you noted that it was not likely
that New Suffolk Land Company would be in favor of locating the building on the
property with development rights intact, the Committee discussed alternative
sites, and approved the building requested at a location on the property owned
by New Suffolk Land Company known as SCTM# 1000-55-1-8.4.
The Committee's approval is for the building to be located in the southeast
corner of the property known as SCTM# 1000-55-1-8.4, at the southern most
side of the property. The approved location includes locating the building at or
near the building setbacks allowed by Code, or setting it further back from
Young's Avenue (please see the attached sketch for clarification of the approved
location). The approval is for:
The tractor and equipment storage Morton building 42 ftx 90 ft.
Building to include; unheated storage area, heated shop area, small
office and bathroom. Your letter specifies specific sizes for each
use. The Committee's approval allows for the requested 42' x 90'
building, and the uses requested. The Committee did not put
specific requirements on the size for each use within the building.
· Agrichemical Mixing Facility. Mixing facility to be located so that it is
not on the street side of the building.
· Agricultural well
The Committee's approval does not mean that you can proceed with
construction. All improvements are subject to all applicable Town Code
requirements. The Committee's approval of the location and uses within the
easement does not mean that such uses will be approved or permitted by other
Town Departments or agencies. The Committee's approval allows you to
proceed with pursuing any applicable approvals that are required by Town Code.

Melissa,
Thank you for your time this morning and the careful explanation of the various options we have for
siting our barn. I went to the property right after our meeting to look at the various choices again. After
discussion with my superiors in Salt Lake City we would like to go forward with option #3, our original
location. We would be glad to agree with the 150 ft setback from Young's Avenue as we cannot use that
land for winegrape production anyway. I am not sure we will agree to an "ornamental" vineyard there, but
will agree to find a suitable screening/landscaping plan that would be in the character of the area.
I will put up some posts to mark the approximate corners of the building so the Committee can see
exactly where we would like to site the building.

Thank you for your help yesterday morning concerning procedures for gaining permission to
build a barn on Development Rights Sold property. As you and I discussed, we would like to build
a tractor and equipment storage building, with a small office and bathroom on the former Campbell
property in Southold. The property is located at 5455 Young's Avenue, Southold. The tax ID
number of the parcel is 1000-55-01-8.3. There are currently no buildings on any of the three parcels
we own (ID #s 1000-55-01-8.4 and 1000-55-01-9) except two small sheds. We there/bre need a
building to house the equipment neccessary to manage a vineyard.
We would like to construct a Morton building, 42fi x 90fl (3780 sq. fi), on the northeastern
comer of the property. This would include one unheated storage section 42ft x 60fi and a heated
shop area of42fi x 30fi. In the shop area we would like to build a farm office of approximately 10ft
x 10IL to maintain farm records and the postings and records neccesary to comply with all State and
Federal regulations. We chose this location as it is the portion of the property least suitable for
grapevines as well as being close to the road. We also plan to construct an Agrichemical Mixing
Facilty adjacent to the barn to provide a safe, controlled area for mixing and loading on farm spray
materials and fertilzers.
I have included a copy of the survey of the property showing the approximate desired
location of the barn. I hope that you can discuss our plan at the next meeting of the Committee. 1
would be glad to answer any questions you or any other member might have or to attend the
meeting to answer questions if you prefer.

The Land Preservation Committee Members, in accordance with Section
70-5 C. (2) [3] of the Town Code, reviewed via electronic mail your written
request dated March 10, 2011, for deer fencing installation to be located upon
land on which the Town owns a development rights easement.
The recorded easement for this property allows land within the easement
to be used for the purpose of agricultural production which includes fencing.
Section 70-5-C. (2) [3] requires that the Committee serve as a review board for
the granting of permits for the construction, reconstruction and additions of and to
structures in or on agricultural lands in which the development rights have been
acquired by the Town.
The Committee is approving the use you requested, as listed and clarified
below, to be allowed within the development rights easement area. The
Committee's approval does not mean that you can proceed with installation. All
improvements are subject to all applicable Town Code requirements.
· Erection of an 8' high deer exclusion fencing on farm located at Youngs
Avenue in Southold, SCTM #1000-55.-2-9.4
Please note that the Committee's approval of this use within the easement
