THIS INDENTURE, made the 5'P~' day of February, 2009 BETWEEN
WILLIAM H. STILES, individually and as Trustee of the William H. Stiles Declaration of Trust
dated February 28, 1991 and JOAN R. STILES, individually and as Trustee of the Joan R. Stiles
Declaration of Trust dated February 28, 1991, both residing at 12700 New Suffolk Avenue,
Cutchogue, NY 11935
party of the first part, and
WILLIAM H. STILES and JOAN R. STILES, both residing at 12700 New Suffolk Avenue,
Cutchogue, NY 11935, as tenants in common
party of the second part,
WITNESSETH, that the party of the first part, in consideration o£TEN ($10.00) dollars,
lawful money of the United States paid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party o£ the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in Cutchogue, Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
NORTHERLY by the highway running from New Suffolk to Mattituck approximately 404.25 feet; Easterly
by beach and meadows of Wickham Case, beginning on the southerly line of said highway and running
thence South 37 degrees 10 minutes 55 seconds West, 182.30 feet to the southeast face ora Black Oak
Tree;
THENCE South 43 degrees 52 minutes 10 seconds West, 113.30 feet to the southeast face of White Oak
Tree;
THENCE South 21 degrees 24 minutes 35 seconds West, 137.70 feet to an iron pipe and so on in the same
direction 28.3 feet to the high water mark on Peocnic Bay (the first course above set forth running by the
northwest face of a White Oak Tree at a point 52 feet distant from the line of said highway);
THENCE running along the high water mark of Peconic Bay North 67 degrees 23 minutes 00 seconds
West 173.25 feet and thence North 71 degrees 20 minutes 47 seconds West 58.20 feet to the land owned or
leased by Beverly S. King;
THENCE running North 11 degrees 25 minutes 00 seconds East by said land owned or leased by Beverly S.
King, 380.16 feet to the southerly side of said highway at a point 115.50 feet distant from the land of said
Wickham Case reserved as a two rod strip to the Bay fi~om said highway and the place of BEGINNING.
TOGETHER with the appurtenances and all the right, title and interest of the party of the first part to the fee
of the highway adjoining and adjacent to said premises to the middle line of said highway and also to the
lands under the waters of Peconic Bay adjoining and adjacent to the said premises so far as the same may
extend.
BEING AND INTENDED TO BE ali of the same premises conveyed by deed dated October 18t",
1991 and recorded in the Office of the Suffolk County Clerk on October 31, 1992 in liber 11362 page
396. In addition, this deed further clarifies that the party of the first part has conveyed the party's of
the first part entire interest in the subject premises to the party of the second part.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
