THIS INDENTURE, made the oq (~4~ day of February, 2009 BETWEEN
ROBERT F. KETCHAM, JR. a/k/a ROBERT F. KETCHAM and LOIS ANN KETCHAM a/k/a LOIS
KETCHAM, both residing at 1120 Truman's Path, East Marion, NY 11939
party of the first part,
LOIS KETCHAM, residing at 1120 Truman's Path, East Marion, NY 11939
party of the second part,
WITNESSETH, that the party of the first part, in consideration of TEN ($10.00) dollars,
lawful money of the United States paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at East Marion, in the Town of Southold, County of Suffolk and State of New York, bounded
and described as follows:
BEGINNING at a point n the westerly side of a private road approximately 25 feet in width, which point is distant
100.00 feet southerly from the intersection of the westerly side of said private road and the southerly side of Main
Road, said point being also the southeasterly comer of land now or formerly of Vogt;
RUNNING THENCE along said private road South 25 degrees 54 minutes 20 seconds East 50.00 feet to an iron
pipe and land now or formerly of Williams;
RUNNING THENCE along said land now or formerly of Williams South 64 degrees 05 minutes 40 seconds West
to Marion Lake 226.00 feet more or less;
RUNNING THENCE northerly along said Marion Lake 50.00 feet more of less to land now or formerly of Vogt;
RUNNING THENCE along said land now or formerly of Vogt North 64 degrees 05 minutes 40 seconds East
240.00 feet more or less to the said private road, the said point or place of BEGINNING.
TOGETHER WITH all the right, title and interest of the part of the first part of, in and to the land under the waters
of Marion Lake adjoining said premises on the West.
ALSO, with a right of way over said strip of land 25 feet, or more, in width along the easterly line of the premises
extending southerly 450 feet beyond the southeasterly comer of the premises, and thence southwesterly about 355
feet to said Marion Lake, and extending northerly from the northeasterly comer of the promises through land of
Edna A. Brown about 600 feet to land now or formerly of land of Edna a. Brown about 600 feet to land now or
formerly of Florence Tuthill and continuing northerly 16 feet in width over said land now or formerly of Florence
Tuthill and land now or formerly of Griffing to the Main Road along land formerly of F. Milton Welch.
ALSO, with a right of way along the westerly line of land now or formerly of Edna A. Brown from the westerly end
of the above described right of way southerly about 250 feet to the Bay, said right of way being ten (10) feet in width
i at the northerly end and about twenty (20) feet in width at the Bay.
SUBJECT TO the following covenants and restrictions:
1. No building or any part thereof or structure of any kind shall be erected or maintained on any part of said
premises within 40 feet of the shore line of Marion Lake.
2. No trailer shall be kept or parked on the said premises.
3. All material used on the exterior of any building which may be erected on said premises shall be new material.
4. All buildings erected or maintained on the said premises shall have a peaked roof.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated February
19, 1974 recorded in the Office of the Clerk of the County of Suffolk on February 20, 1974 in Liber 7590 at page
567.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
)remises.
ro HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors
and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement, and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose. The
word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
