late of New Jersey
who died intestate on the 12th day of April nineteen hundred and ninety-five
party of the first part, and
ROBERT G. RULAND, residing at 310 Bailey Beach Road, Mattituck, New York 11952,
and LOUISE M. RULAND, residing at 4055 Westphalia Road, Mattituck, New York
11952, as Joint Tenants with the Righi of Survivorship,
party of the second part,
WITNESSETH, that whereas ancillary letters of administration were issued to the party of the first part
by the Surrogate's Court of Suffolk County, New York on August 19, 1996tnd by virtue
of the power and authority given by Article 11 of the Estates, Powers and Trusts Law, and in consideration of
Sixty-two Thousand Five Hundred and 00/100---------------------------------dollars,
---------------($62,500.00)--------- paid by the party of the second part, does hereby grant and
release unto the party of the second part, the distributees or successors and assigns of the party of the second
part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in tbgx Mattituck, Town of Southold, County of Suffolk and State of
New York, designated as I.ot Nos. 18 and 19 and part of Lot No. 17, on a certain
map entitled, "Map of Tollewood" and filed in the Office of the Clerk of the
County of Suffolk on January 25, 1957 as Map No. 175, more particularly bounded
and described as follows:
DISTRICT BEGINNING at a point marking the intersection of the northerly side of Westphalia
1000 Road and the easterly line of Howard Avenue;
SECTION RUNNING THENCE along the easterly line of Howard Avenue, North 4 degrees 31
113.00 minutes 20 seconds East, 270.73 feet to Lot No. 35 on said map;
BLOCK RUNNING THENCE along Lot 35 and Lot 34, North 71 degrees 30 minutes 50 seconds
11.00 East, 127.83 feet;
LOT RUNNING THENCE through Lot No. 17, South 1 degree 11 minutes 00 seconds East,
020.000 246.08 feet to the northerly line of Westphalia Road;
RUNNING THENCE along said line, South 66 degrees 29 minutes 00 seconds West,
161 .01 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to Joseph David Cavaliere
by deed dated December 7, 1982 and recorded in Suffolk County Clerk's Office
on December 14, 1982 in Liber 9284, Page 300.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any strtets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of decedent's death in said premises, and also
the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ-
ually, or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the distributees or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffe'red anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
Subject to the trust fund provisions of section thirteen of the Lien Law.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
