BETWEEN John S. W. Spofford, with an address of (no #) East End Road, P.O. Box 134,
Fishers Island, New York 06390 and Margaret S. Benkard, residing at 1192 Park Avenue, New
York, New York 10128, as Successor Trustees of the Margaret W. Spofford Trust, originally
dated November 4, 1971, and as Executors of the Estate of Margaret Walker Spofford under the
Last Will and Testament of Margaret Walker Spofford, late of New York, New York, New York
Surrogates Court File No.2001-4165 who died on the 7th day of October, two thousand one,
party of the first part, and
Melie T. Spofford, with an address of (no #) East End Road, P.O. Box 134, Fishers Island, New
York 06390,
party of the second part,
WITNESSETH, that the party of the first part, in their capacity as Executors of the Estate of
Margaret Walker Spofford, to whom Certificates of Letters Testamentary were issued by the
Surrogate's Court, New York County, New York on November 29, 2001 and by virtue of the
power and authority given in and by said Last Will and Testament, and/or by Article 11 of the
Estates, Powers and Trusts Law, and in consideration of
Ten ($10.00) dollars, paid by the party of the second part, does hereby grant and release unto the
party of the second part, the distributees or successors and assigns of the party of the second part
forever,
ALL that certain plot piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk, State of New York,
being a part of that portion of Fishers Island belong to the grantor (which parties hereinafter
called the "Park") lying to the east of Peninsula Road, said lot or parcel of land being bounded
and described as follows:
BEGINNING at a point on the Northwesterly side of a road 45 feet wide said point being on the
Easterly line of land now or formerly of William M. Duryea, said point also being located 586.61
feet South of a point which is 2694.98 feet West of a monument marking the United States Coast
and Geodetic Survey Triangulation Station "Chocomount 2" and thence running North 9o25, 10"
West 239.13 feet; thence North 0° 21' 30" West 312.68 feet to an iron pipe; these last two lines
abutting Westerly on said Duryea land; thence South 88o 40' 20" East 233.54 feet to an iron pipe,
abutting Northerly on land now or formerly of Shaw Walker, Trustee; thence South 20 05' 50"
East 181.58 feet to an iron pipe; thence South 18° 36' 10" East 192.38 feet to an iron p!pe at said
road line, these last two lines abutting Northeasterly on land now or formerly of Harry O.
Hurlbert, Jr.; thence along said road line South 51o 38, 30" West 197.68 feet to a point of curve to
the right whose radius is 341.79 feet and the direction of whose radius at that point is North 38°
21' 30" West; thence Southwestwardly, along said road line, following the arc of said curve
120.09 feet to the point of beginning.
Containing 2.77 acres, more or less and designated as Fidco Block 19, Lot 4 or Tax Map
3, Block 2, Lot 9.
The grantor covenants that is conveyance is made in the ordinary course of the
grantor's business.
BEING AND INTENDED TO BE the same premises conveyed to Shaw Walker, as Trustee of
the Margaret W. Spofford Trust originally dated November 4, 1971, by deed from Fishers Island
Development Corporation dated March 22, 1977 and recorded on March 26, 1977 in the Suffolk
County Clerk's Office in Liber 8241 pages 482 -488.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with all of the right, title and interest of the party of the first part in and to the
lands under the waters of Fishers Island Sound adjoining said premises and together with the
appurtenances and all the estate and right of the party of the first part in and to said premises.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party to the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires.
