WITNESSETH, that the party of the first part, in consideration of TEN DOLLARS ($10.00),
lawful money of the United States, paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, known and designated as Lot #72, as shown on a certain map entitled, "Map of Harbor
Lights Estates, Section Three, Bayview, Town of Southold, Suffolk County, New York", made
by Otto'~4an Tu~and Son, licensed land surveyors, Greenport, New York, and filed in the Office
of the Clerk of the County of Suffolk on August 7, 1968, as Map No. 5147.
BEGINNING at a point on the Easterly side of Brigantine Drive where the same is
intersected by the division line between Lots 71 & 72. Said point also being distant lt201.73 feet
in a Northerly direction, as measured along the Easterly side of Brigantine Drive, from the comer
formed by the intersection of the Easterly side of Brigantine Drive with the Northerly side of
North Bayview Road;
RUNNING THENCE along the Easterly side of Brigantine Drive, North 18 degrees 13
minutes 20 seconds East, 100.00 feet to the division line between Lots 72 & 73;
THENCE along the last mentioned division line South 71 degrees 46 minutes 40 seconds
East, 205.63 feet to the division line between Lot 72 and the Land now or formerly of Paradise
Shores;
THENCE along the last mentioned division line South 18 degrees 36 minutes 20 seconds
West (actual), South 19 degrees 36 minutes 20 seconds West (map), 100.00 feet to the division
line between Lots 71 & 72;
THENCE along the last mentioned division line North 7I degrees 46 minutes 40 seconds
West, 204.96 feet to the Easterly side of Brigantine Drive, thc point or place of BEGINN'ING;
TOGETHER with the use in common with others of the beach area and parking area adjacent
thereto, as shown on Map of Harbor Lights Estates, Section One, Bayview, Town of Southold,
Suffolk County, New York, filed in the Office of the Clerk of the County of Suffolk on June 8,
1965 as Map # 4362; said beach area having a depth of approximately 50 feet from the average
high water mark on Peconic Bay and having a length of 900 feet; more or less, as measured along
the ordinary high water mark and said parking area having a frontage on the Northerly side of
Harbor Lights Drive of approximately 150 feet running Westerly along said street from Lot No.
7 and having a depth of not less that 150 feet Northerly of Harbor Lights Drive. The parking area
shall be immediately adjacent and contiguous to the beach area herein referred to.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
by deed dated 5/23/74, recorded 6/~/74 in Liber 7649 Page 523.
TOGETHER with all right, title and interest,'if any, of the party of the first part in and to an~,
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part
in and to said premises,
TO HA VEAND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
