THIS INDENTURE, made the 23rd day of December, Two Thousand Eight
BETWEEN
JACQUEL1NE MARY MONSELL, as surviving tenant by the entirety, residing at 509
First Street, Greenport, New York 11944,
party of the first part, and
CAROLE MONSELL, residing at (No#) Maple Avenue, Peconic, New York 11958,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
PARCEL I:
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk
and State of New York, known and designated as Lot No. 115 on Map of "Beebe Estate"
filed in the Suffolk County Clerk's Office on August 10, 1838 as Map #9, said lot with
reference to said map being bounded northerly by Lot No. 116; easterly by First Street;
southerly by Lot No. 114 and westerly by Lot No. 136, being 50 feet in width front and
rear and 150 feet in depth, more or less.
PARCEL II:
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk
and State of New York, more fully described as follows:
BEGINNING at a point on the boundary line between land now or formerly of Viola
Prince and land of Robert Parrish, 106 feet, more or less, northerly along said boundary
line from Center Street, being the northwesterly comer of land now or formerly of Viola
Prince and the southwesterly comer of land of Hubbard; and
RUNNING easterly along said land of Hubbard, 10 feet, more or less, to land of the party
of the first part;
THENCE southerly along said land of the party of the first part, 50 feet, more or less, to
said land now or formerly of Viola Prince;
THENCE westerly along said land now or formerly of Viola Prince, 10 feet, more or less,
to said land of Parrish;
THENCE northerly along said land of Parrish, 50 feet, more or less, to the point of
BEGINNING.
BEING AND INTENDED TO BE .the same premises conveyed to the party of the first
part by deed dated January 24, 1956, and recorded in the Suffolk County Clerk's Office
on February 7, 1956, in Liber 4066, Page 419.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, to change their remainderman
as follows:
TO or among any one or more members of a class consisting of the party of the first
part's descendants, in any degree, whether presently living or bom hereafter, in such
proportions and amounts, without regard to equality, outright or in trust, as the party of
the first part may direct and appoint during her lifetime by properly written and
acknowledged instrument, and recorded prior to death, making specific reference to this
power of appointment. The party of the first part may not appoint themselves, their
estate, their creditors or the creditors of their estate, under any circumstances.
THIS DEED IS AN EXERCISE OF THE SPECIAL POWER OF APPOINTMENT
contained in a certain prior deed in respect to the above-described premises dated
September 26, 2000, recorded in the Suffolk County Clerk's Office on January 12,
2001, in Liber 12096, Page 593; and it is further stated that the party of the first
part continues to reserve a special power of appointment as hereinabove set forth.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises; TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.

and year first above written.
