party of the first part,
Frances B. Zissel and Mary Elizabeth Zissel, both residing at 2345 Haywaters Road,
Cutch. ogue, New York 11935, as joint tenants with rights of surviorship
party ofthe second part,
WITNESSETH, that the party of the first part, in consideration of TEN DOLLARS ($10.00),
lawful money of the United States, paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being Nassau Point, in the
Town of Southold, County of Suffolk and State of New York, known and designated as Lot
Number 378 on a certain map entitled, "Map of Section D, Nassau Point Club Properties, Inc.,
situate at Nassau Point, Suffolk County, New York, surveyed by Otto W. Van Tuyl, C.E. & S.,
Greenport, NY", and filed in the Office of the Clerk of the County of Suffolk on May 7, 1926 as
Map No. 806, said lot being more particularly bounded and described as follows;
BEGINNING at a point on the easterly side of Haywaters Road, where the same is
intersected by the division line between Lots 378 and 379 on said map; RUNNING THENCE
northerly along the easterly side of Haywaters Road, 100 feet to the division line of said Lots 377
and 378 on said map; RUNNING THENCE easterly along said division line and the division line
of said Lots 378 and 393 on said map and at right angles to the easterly side of Haywaters Road,
320 feet to the division line between Lots 378 and 387 on said map; RUNNING THENCE
southerly along said division line and parallel with the easterly side of Haywaters Road, 100 feet

SUBJECT TO a life estate hereby reserved by the grantor, Frances B. Zissel for her life
use and occupancy.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
by deed dated 10/15/99, recorded 01/14/99 in Liber 12013, Page 882 and by deed dated 12/29/99
and recorded on 01/14/00 in Liber 12013, page 883.
TOGETHER with all right, title and interest, if any, of the party of the first pan in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part
in and to said premises,
TOHAVEAND TOHOLD the premises herein granted unto the party of the second pan, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
