WITNESSETH, that the party of the first part, in consideration of TEN DOLLARS ($10.00),
lawful money of the United States, paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Cutchogue, in the
Town of Southold, County of Suffolk and State of New York, known and designated as Lot 3 as
shown on a certain map entitled, "Map of Minor Subdivision Prepared for Ernest Schneider",
filed in the Office of the Clerk of the County of Suffolk on 01/30/04 as Map No. 11051, Abstract
No. 15079, said lot being bounded and described as follows;
BEGINNING at a point on the westerly side Alvah's Lane distant 1347.30 feet from the
northerly end of the curve connecting the westerly side of AIvah's Lane and the northerly side of
Middle Road (CR48);
THENCE South 56 degrees 32 minutes 10 seconds West, along land now or formerly of
WaRs 848.16 feet to land now or formerly of Wickham;
THENCE North 31 degrees 25 minutes 20 seconds West, 439.95 feet;
THENCE North 56 degrees 32 minutes l0 seconds East, 832.49 feet to the westerly side of
AIvah's Lane;
THENCE along the westerly side of AIvah's Lane, South 33 degrees 27 minutes 50 seconds
East, 439.67 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
by deed dated 9/8/05, recorded 10/5/05 in Liber 124131 Page 103.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abut'ting th6 above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part
in and to said premises,
TO HA VE/IND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as i fit read "parties" whenever the sense of this indenture so
requires.
