Dear Ms.Neville:
I am enclosing a Petition: to Amend the Zoning Code, of the Town of Southold with respect.to the
property located at Albertson Lane,Southold together with the certified mail receipts showing service,of
the notice to amend the Town Code.
I submit that it is appropriate to have this Petition fully reviewed since the new members have been-just
elected to the Town Board. Undoubtedly, there is a need for apartments and my proposal addresses
this concern. The apartments proposed.will be completely buffered from visibility from the road. The
complex will be entirely private and will require no town services. It would produce significant.r..eal
property taxes for distribution to the local school district as well as the Town. This clustered site:plan
will be serviced by the community water and sewer.
Based upon foregoing, I respectfully submit that this Petition should be fully considered by the Town
Board and a public hearing held to permit the residents of the Town to participate and have their voi0es
heard.
Very truly yours,

Dear Ms. Snyder:
As a courtesy, the Town Board permitted a Work Session discussion on the
change of zone application. If you recall, you were notified by letter on March 20, 2009
and, again on July 6, 2009, that the Town Board declined to take any action on your

After the Work Session discussion on November 17, 2009,.the Town Board's
position has not changed and the Board continues to decline taking any action on this
application and considers the matter closed.

Dear Ms.Lanza, i
I am writing this letter to you to formally notify you that at the last-Town B"oafdlMeeting, which
was held on June 30, 2009, I addressed the Town Board. Not only;didj, brigaper =.with t
but I explained that I want a public meeting so that the people of Southold can hear my request.
When you sent back the items which were missing from my 'package you had a cover sheet
saying that my application was incomplete with notes made in red marker. One of the remarks you made
was that my application was incomplete because there were no 500' radius notices sent out. I showed the
C.R.R. notices all ready to be sent out to the Town Board as I also showed them to you at our meeting,
and again explained that I could not send them out because I was never given a date by you. I have asked
all along for a date to be heard before the board so that I could mail out the radius list notices, but I was
ignored.
I would like a date set so that this could be fairly heard with all`the good merits to bring income
into the Town of Southold and Greenport. If I continue to receive no response from you I will take this to
the Supervisor.

Attention: Heather Lanza, AICP, Town Planning Director
Dear Ms. Lanza,
I am writing this letter pertaining to your letter and package which you sent to us
on June 3, 2009. When we discussed the subject of the change of zone for apartments,
you felt that you were not for it, and that I should take it up with the Town Board. When
I asked you who the Town Board members were, you instructed me to go downstairs,
outside the building department, and they would be listed on the door. As you saw, I did
that. You told me to write to the Town Board and tell them how I felt. I took down the
names, but before I could write to them, you sent me the package containing the
application and maps. I tried to call you but your secretary Carol said you were on the
phone and promised that she would give you the message so that you would pick up the
phone as soon as you were free, as I explained it would only take a minute. Carol said
you would call me back when you were off the phone. The next thing I knew, when I
called back, was that you had left immediately without calling me back. Let me tell you
what I wanted to say. First, you did not return all of my papers and second, you had a
cover sheet saying that my application was incomplete because there were no 500' radius
notices sent out. I ask you, I have had them ready all along just waiting for a date to be
inserted, which you never gave me. I consider this a run around. I am not going to go
through each and every item you say is missing, instead I am sending you your checklist
which you sent me. I have asked you all along for a date to be heard before the board so
that I could mail out the radius list notices, but instead you did nothing. Don't you
consider this a complete contradiction? Whenever I came for any type of meeting, I
brought the entire box with those notices on the top. I am asking you, as I intend to ask
the board, I would like a date set so that this could be fairly heard with all the good merits
to bring income into the Town of Southold and Greenport.
I would like the remainder of the papers you kept from application you were given
returned to me first and then a date to be heard before the board and the people of the
community. As far as it not being located close to the town, that would not be an issue
because as I have explained many times, there would be a bus on call at all times to bring
the people into town to shop, to doctors, dentists, etc... It will also help to keep our
young people here, and as you have been told many times, I would locate a 5 acre parcel
to give the less fortunate housing opportunities also. I am enclosing your letter, and I am
sending this letter and the same notice to each member of the Town Board. Hopefully,
they will realize the situation and give me a date to be heard before them and then I can
send out the notices to the surrounding area, so that other people can be informed too.
Then I feel that the project could have the proper time to be explained, such as the
clustering and the opportunity to bring more revenue into Southold and Greenport. My
project already has two water hydrants, which means that the project has water
availability. Much time and money has been spent and I know once everyone realizes it
this project would be a big plus to the community. I would appreciate it if this would be
done within 10 days so that I can move forward.
Respectfully submitted,
Dorothy Snyder

Lake Shore Ponds at Southold Change of Zone decision
Today at the Town Board work session, the Town Board decided not to consider any further the Change of Zone
application for Lake Shore Ponds at Southold from R-80 to HD.
It is my understanding that the next step is for the Town Attorney to send a letter to the petitioner stating that the Town
Board will not consider this zone change.

Change of Zone Petition - review for application completeness
Lake Shore Ponds at Southold
I have reviewed the documents submitted with the Change of Zone petition noted above, and the
petition application is not complete. There is, however, sufficient information for the Town
Board 'to determine whether they would consider moving forward with further review. Should
the Town Board decide to consider this petition beyond their initial review, the applicant must
submit the missing application requirements. I can provide a detailed list of those missing items
at that time.
The proposed zone change would create a high-density residential development (21 O-unit
apartment complex) on a parcel that is two and a half miles from the nearest hamlet center
(Greenport Village). Good planning advocates high-density development within walking
distance (< 0.5 miles) of hamlet centers. Further, this parcel is not located within a HALO zone,
one purpose of which was to provide a guide for where high-density development might be
appropriate.

serviced by the local sewer ~ istrict, water authority, and utilities. The rezoning and
design o~'this residential deYel )pment will allow for as much open, undeveloped space as
possible in keeping with tl~e Yown's Master Plan. The communi, r)' will benefit in thc
increased tax re,,,enue and tl ,e preservation of open space. The current zoning is
residen6al R-80 that would ~ Ilow for 27 single*family residences with minimal oper~

State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project or action may
be significant, The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of
a project that are subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal
knowledge of the environment or may not be technically expert in environmental analysis, In addition, many who have knowledge
in one particular area may not be aware of the broader concerns affecting the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process
has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists
a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action, It provides guidance
as to whether an impact is likely to be considered small to moderate or whether it is a potentially-large impact The
form also identifies whether an impact can be mitigated or reduced,
Part 3: If any impact in Part 2 is identified as potentiarly-large, then Part 3 is used to evaluate whether or not the impact is
actually important.

DETERMINATION OF SIGNIFICANCE -- Type I and Unlisted Actions
Identify the Portions of E/~ completod for this project: r"'lPart 1 r'-lPart 2 J'-'lPart 3
Upon review of the information recorded on this EAF (Parts I and 2 and 3 if appropriate), and any other supporting information, and
considering both the magnitude and importance of each impact, it is reasonably determined by the lead agency that:
J~JA. The project will not result in any large and important impact(s) and, therefore, is one which will not have a
significant impact on the environment, therefore a negative declaration will be prepared.
J~'] B. Although the project could have a significant effect on the environment, there will not be a significant effect
for this Unlisted Action because the mitigation measures described in PART 3 have been required, therefore
a CONDITIONED negative declaration will be prepared.*

PART 2 - PROJECT IMPACTS AND THEIR MAGNITUDE
Responsibility of Lead Agency
General Information (Read Carefully)
In completing the form the reviewer should be guided by the question: Have my responses and determinations been
reasonable? The reviewer is not expected to be an expert environmental analyst.
The Examples provided are to assist the reviewer by showing types of impacts and wherever possible the threshold of
magnitude that would trigger a response in column 2, The examples are generally applicable throughout the State and for
most situations But, f~ranyspeci~cpreject~rsite~therexamp~esand~~r~~werthresh~~dsmaybeapprepriatef~ra
Potential Large Impact response, thus requiring evaluation in Part 3.
The impacts of each project, on each site, in each locality, will va~/. Therefore, the examples are illustrative and have been
offered as guidance. They do not constitute an exhaustive list of impacts and thresholds to answer each question
The number of examples per question does not indicate the importance of each question.
In identifying impacts, consider long term, short term and cumulative effects.
Instructions (Read carefully)
a. Answer each of the 20 questions in PART 2. Answer Yes if there will be any impact.
Maybe answers should be considered as Yes answers.
c If answering Yes to a question then check the appropriate box(column I or 2)to indicate the potential size of the impact If
impact threshold equals or exceeds any example provided, check column 2. If impact will occur but threshold is lower than
example, check column 1
d Identifying that an Impact will be potentially large (column 2) does not mean that it is also necessarily significant. Any
large impact must be evaluated in PART 3 to determine significance. Identifying an impact in column 2 simply asks that it
be looked at further,
e. If reviewer has doubt about size of the impact then consider the impact as potentially large and proceed to PART 3
f If a potentially large impact checked in column 2 can be mitigated by change(s) in the project to a small to moderate
impact, also check the Yes box in column 3. A No response indicates that such a reduction is not possible This must be
explained in Part 3~

Part 3 - EVALUATION OF THE IMPORTANCE OF IMPACTS
Responsibility of Lead Agency
Part 3 must be prepared if one or more impact(s) is considered to be potentially large, even if the impact(s) may
be mitigated.
Instructions (If you need more space, attach additional sheets)
Discuss the following for each impact identified in Column 2 of Part 2:
1. Briefly describe the impact.
2. Describe (if applicable) how the impact could be mitigated or reduced to a small to moderate impact by
project change(s).
Based on the information available, decide if it is reasonable to conclude that this impact is important.
To answer the question of importance, consider:
The probability of the impact occurring
The duration of the impact
Its irreversibility, including permanently lost resources of value
Whether the impact can or will be controlled
The regional consequence of the impact
Its potential divergence from local needs and goals
Whether known objections to the project relate to this impact.
