SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as
required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the
Suffolk County Department of Planning issued its reply dated June 24, 2008 stating that
this apphcation is considered a matter for local determination as there appears to be no
significant county-wide or inter-community impact.
PROPERTY FACTS/DESCRIPTION: The subject property is a 40,854 square foot parcel
measuring 264.09 feet along Main Road (Route 25) to the south, 200.00 feet along the
western boundary, 144.44 feet along the northern boundary, and 233.05 feet along the
eastern boundary. The lot is improved with a tree farm, as shown on the survey by John C.
Ehlers, Land Surveyor, dated March 3, 2005.
BASIS OF APPLICATION: Request for a Variance as amended under Section 280-124,
based on the Building Inspector's August 18, 2008 amended Notice of Disapproval which
states that the proposed agricultural storage building on an existing tree farm property is
not permitted for the reason that barns, storage buildings, greenhouses (including plastic
covered) and other related structures, shall conform to the yard requirements for principal
buildings, and the required minimum rear yard setback is 60 feet.
RELIEF REQUESTED: The applicant requests a variance to construct an agricultural
storage building with a setback of 10 feet from the rear property line.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted, and personal inspections~ the Board makes the following findings:
1. Town Law q267-b(3)(b)(3)(1). Grant of setback variance will not have a significant
adverse environmental effect on the character of the neighborhood or be a detriment to
nearby properties. The proposed building will be close to the adjoining part of a farm
owned by the applicant and will not impact on neighbors' property.

2. Town Law ~267-b(3)(b)(2). The benefit of an agricultural storage building cannot be
achieved by some method, feasible for the apphcant to pursue, other than an area variance.
The Board finds that location of the building for the storage of agricultural equipment close
to the adjoining lot is important to the operation of the farm.
3. Town Law ~267-b(3)(b)(3). The variance is substantial. It is partially mitigated by the
fact that the adjoining property is part of the same tree farm owned by the applicant.
4. Town Law ,~267-b(3)(b)(5). The need for a variance was self-created. It is a consequence
of the layout of the farm, which is divided by a boundary near the middle of farm occupying
more than one lot.
5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that grant of this
relief will have an adverse impact on physical or environmental conditions in the
neighborhood.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and
adequate to enable the applicant to enjoy the benefit of new construction, while preserving
and protecting the character of the neighborhood and the health, safety and welfare of the
community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member Simon,
seconded by Member Weisman, and duly carried, to
DENY the variance as applied for, and in the ALTERNATIVE, to
GRANT a variance to allow a 15-foot setback from the rear lot line.
Any deviation from the variance given such as extensions, or demolitions which are not
shown on the applicant's diagrams or survey site maps, are not authorized under this
apphcation when involving nonconformities under the zoning code. This action does not
authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for
an alteration that does not increase the degree of nonconformity.
Vote of the Board: Ayes: Members Oliva (Vice Chairwoman), Dinizio, Simon, and
Weisman. (Chairman Goehringer was absent.) This Resolution was duly adopted (4-0).

The Planning Board received your request for comments regarding the above application to
construct an agricultural storage building.
The Planning Board has not received an application for this site. Based on a preliminary review
of the plans submitted with this request, it appears the site is well-screened with vegetation from
the Scenic Byway (SR 25) and other properties, and there is enough land area to be able to
provide an adequate drainage system for storm-water runoff associated with the building. The
property line nearest to the proposed building (10') appears to be under the same ownership and
part of the same farm operation.

Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold To;m).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
acl'fievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a

Dear Chairmal~ Gochringer:
This office represents William Bums an adjoining property owner of Joseph and
Cathleen Shipman. As you may recall, Mr. Burns is opposing the application of the
Shipman's for the construction cfa proposed agricultural building on Suffolk County Tax
Map number 108-3-5.5.
One of the reasons for the opposition is that the application as presented uses my
client's dirt driveway as the front yard for setback requirements. The dirt driveway is
known as Suffolk County Tax Map number 1000-108-3-8.2. This is a private driveway
for the fbur owners with private residences towards the back of the driveway. This
driveway is owned by John A. Zurawski and Patricia C. gurawski (1/4 intercst), Donna
Messina Green (1/4 interest), William Burns and Patricia Burns (1/4 interest) and
Constance M. Cross (1/4 interest). [ have enclosed a complete abstract of title for the
driveway in question prepared by LandAmerica Commonwealth Title.
By using my client's din driveway as the proposed front yard, the building, which
actually has the front side facing State Route 25, would only require a 20 foot side yard.
The Shipman's are proposing a 10 1hot setback from the Shipman's rear property line or
a 50% variance from the 20 foot side yard. However, since dirt driveway is a private
driveway, in which the Shipman's have no legal access to, the application as proposed is
incorrect.
The legal front yard of the proposed building is really State Route 25. In fact,
"Comer Lot" as defined by the Code of the Town of Southold is "[a] lot at the junction of
and abutting on two or more intersecting streets where the interior angle of intersection
does not exceed 135 degrees." In this situation you do not have two intersecting streets.
Therefore, the front yard must face State Route 25. This is in keeping with the design of
the building as presented at the hearing.
If the front yard is along State Route 25 the rear yard setback is 60 feet. The
Shipman's are proposing a 10 foot rear yard setback. This result equates to an 83%
variance; which is substantial and could change the character of the neighborhood as is
sets precedent for the Zoning Board.
I believe we have a way of resolving Mr. Bums' concerns along with limiting the
precedent setting value of this variance. What I am proposing is that the Zoning Board
impose a condition that the Shipman's file a covenant in the Office of the Suffolk County
Clerk limiting the use of the proposed building to agricultural uses. This protects Mr.
Burns because if the property is ever sold the building will remain agricultural and it will
never become a commercial establishment ten feet from the adjoining property line. It
also removes any precedent setting value as the Zoning Board can differentiate this case
from all others by the recorded covenant.
The Shipman's should not oppose the covenant because the use is consistent with
the use presented at the hearing. The use is also consistent with the Code of the Town of
Southold.
We believe this proposed solution is both simple in its execution and it preserves
and promotes agriculture on the parcel. I look forward to discussing this matter further
with the Zoning Board.

The Planning Board received your request for comments regarding the above application to
construct an agricultural storage building.
The Planning Board has not received an application for this site. Based on a preliminary review
of the plans submitted with this request, it appears the site is well-screened with vegetation from
the Scenic Byway (SR 25) and other properties, and there is enough land area to be able to
provide an adequate drainage system for storm-water runoff associated with the building. The
property line nearest to the proposed building (10') appears to be under the same ownership and
part of the same farm operation.

INSTRUCTIONS --
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule·
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced beforc issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection tkroughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy·
f. Every building permit shall expire if the work authorized has not commenced within 12 months alter the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Therealter, a new permit shall be required.

(2) The benefit sought by the appHeant cannot be achieved by some
method~ feasible for applicant to pursue, other r3aan au area varisnce
because free standing signs on A-C Zone residential property can
only be granted upon approval by the ZBA.
(3) The requested area variance is not substantial because the si~n
conforms and will not exceed 26.25 square feet.
(4) The proposed variance will net have an adverse effect er bnpaet
on the physical or environmental conditions in the neighborhood or
district because sign identifies an agricultural use of a Christmas
tree farm.
(5) The situation has not been se~~ereated.
RESOLUTION/ACTION: On motion by Chairma~ Goehrin~er,
seconded by Member Terrors, it was
RESOLVED, to GRANT variance relief ss applied SUBJECT TO
THE FOLLOWING CONDITIONS:
1. In the event the ~cultural use is discontinued for more
than two years, the si~a shal] be removed, or othe~vise be
re-considered by the B%dlding Inspector as to a new conformity
(related tO an agricultural use).
2. The set back from the front property line shah not be
closer than seven feet as requested by applicant.
3. The top of the frame (name area) of the sign shah not
exceed nine feet from oaturol ground (with or without the roof
shown in the desig~ sketch). This is a 1,eduction from the
requested 10ol/2 feet total height.
4. Exterior Hghting shall be shielded toward the gnound and
shah not he iridescent; interior illumination is not permitted.
5. The sign shah be positioned perpendicular to the Main Read

The board made the following findings and determination:
By this appeal, applicant seeks permission re erect a
hand-painted redwood sign approximately 2' by 3' to be hung
from 4" post and crossbar with a general wording "Welcome
to Mattituck," ~o be located at the ~orth side of Main Road,
Mattituck, NY; bounded north by Adel; west by Garrell; south
by Main Road; east bp Adel and McGuire; County Tax Map Par-
cel NO. 1000-108-3-5.5. Applicant has submitted written per-
mission from the current property owner.
In considering this appeal, the board finds and deter-
mines that the use herein: (a) will not prevent the orderly
and reasonable use of adjacent properties or of properties in
adjacent use districts; (b) will not prevent the orderly
~nd reasonable use of permitted or legally established uses
in the district wherein the proposed use is to be located, or
of permitted or legally established uses in adjacent use
districts; (c) will nor adversely affect the safety, health,
welfare, comfort, convenience or order of the town; (d)
will be in harmony with end promote the general purposes and
intent of the zoning ordinance of the Town of Southold. The
beard also finds and determines that if the relief is granted
no adverse effects will be produced on surrounding properties
or of governmental facilities of any increased population;
that the relief is not substantial in relation to the code
requirements; and that the interests of justice will be served
by granting the relief as requested and sEbject to t_he condi-
tions specified below.
On motion by Mr. Goehringer, seconded by Mr. Sawicki, it
was
RESOLVED, that the applicant in Appeal NO. 2968, Matti-
tuck Chamber of Commerce, be ~ranted permission to erect ~he
sign with the general wording "Welcome to Mattituck" as
requested and SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the sign shall continue only as long as the
property owner,s consent is in effect;
2. The purpose of the sign mus= be directional in the
public interest and said sign shall bear only the words as
generally indicated in the application (Welcome to Mattituck);
3. Said sign shall not exceed the size of four feet by
six feet (4' by 6'~;
4. Said sign shall not be less than five feet (5') from
any property line; the bottom edge of said sign shall not be
less than four feet [4'] above ground;
5. Said sign shall not be illuminated;
6. This permission is subject to receiving recommendations
from the Suffolk County Planning Commission pursuant to Sections
1323, et seq. of the Suffolk County Charter;
7. This permission is uerminable at once at the direction
of the Board of Appeals;
8. In the event the property in question is conveyed,
written notification to this board shall be made within a
reasonable time;
