MEETING OF JULY 17, 2008 ZBA~ ~171 - ~HO~S and ~NDY C~LEY, Applicants Location of Proper~y: 350 Wampum Way, Sou~hold O~M 87-g-2~ (Property also shown on the Map of Nunnakoma Waters filed ~u]y ~, 1~¢8 as Lo~ 22) SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this apphcation and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 24. 2008 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The applicants' property contains 22,179.76 square feet in total area, with frontage along three sides (195.08 feet along Tree Trail, along an arc in the road, and 213.14 feet along Wampum Way). The property is improved with a single-family, one-story frame house with garage as shown on the July 7, 2006 survey prepared by Joseph A. Ingegno, Land Surveyor. BASIS OF APPLICATION: This apphcation is based on Section 280-124, based on the Building Inspector's March 17, 2008 Notice of Disapproval concerning a proposed porch addition to the existing dwelling, which will be set back less than 40 feet from the front property hne adjacent to the street. FINDINGS OF FACT The Zoning Board of Appeals held a pubhc hearing on this application on June 26, 2008, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: Page 2 - July 17, 2008 ZBA # 6171 - T. and W. Carley, Applicants CTM 87-2-29 AREA VARIANCE RELIEF REQUESTED: The applicant wishes to build a new small porch addition as a new entrance to his existing single-family dwelling. The proposed construction notes a front yard setback of 28.2 feet, and the Code requires a minimum front yard setback of 40 feet on a non-conforming 22,172 square foot lot in the Residential R-40 District, under Article XXIII, Section 280-124. ADDITIONAL INFORMATION: The applicant is burdened with three front yards: Wampum Way, Tepee Trail and a R-O-W on the southern border (arc of a curve) of the applicant's property, connecting Wampum Way and Tepee Trail. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(1): Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant proposes a new entrance porch entrance to his dwelling which will be only 125.2 square feet and will not be enclosed. 2~ Town Law §267-b(3)(b)(2): The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant has an odd shaped lot with three front yards and this entrance porch is the only feasible location in which to build it with a setback of 28.2 feet from Tepee Trail. 3. Town Law §267-b(3)(b)(3). The variance requested herein is not substantial because it is only a 125.2 square feet addition and the setback of 28.2 feet instead of the present setback of 34.7 feet from Tepee Trail is only 4.5 feet. The shape of the lot makes this expansion difficult. 4. Town Law §267-b(3)(b)(5). The difficulty has not been self created. The configuration of the streets to the lot existed when the applicant purchased it. 5~ Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community wi]] have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Town Law ~267. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new porch entrance while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de mimmis in nature for an alteration that does not increase the degree of nonconformity.
