Fax (631) 765-906~ ~ fown Clerk FINDINGS, DELIBERATIONS, AND DETERMINATION MEETING OF JULY 17, 2008 ZBA it 6169 - CAROL ANN and MICHAEL SENDLEWSKI, Applicants PROPERTY LOCATION: 270 Pequash Avenue, Cutchogue CTM 102-3-5.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 38,685.83 square foot parcel in the Residential R40 District, measuring 209.75 ft. along Pequash Avenue to the east, 202.64 ft. along the northern boundary, 200.00 ft. along the southern boundary, and 177.11 ft. along the western boundary. The lot is improved with a single-family dwelling, a single-story frame building, and an accessory frame shed, as shown on the survey prepared April 2, 2007, amended December 7, 2007 by Nathan Taft Corwin III, hcensed land surveyor. BASIS OF APPLICATION: Request for Variances under Sections 280-15 and 280- 122, stating that accessory buildings shall be located in the code-required rear yard, based on the Building Inspector's April 10, 2008 amended Notice of Disapproval RELIEF REQUESTED: The applicants seek a variance to allow an increase from the current nonconforming six feet of the garage, to a nonconforming 31 feet of the accessory garage located in the side yard. ADDITIONAL INFORMATION: The accessory garage is a pre-existing (nonconforming) automobile repair shop. It is 46.6 feet in depth, 40.6 feet of which is currently in the rear yard of the primary structure. The proposed addition at the rear of the dwelhng will have the effect of reducing the portion of the shop that extends into the rear yard to approximately 15 feet. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the variance to allow an increase in the amount of accessory building located in the side yard will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Page 2 - July 17, 2008 ZBA # 6169 - C. and M. Sendlewski CTM 102-3-5.1 There will be no change in the front yard setback of either structure, and the addition will not be visible from the road. 2. Town Law §267-b(3)(b)(2). The benefit of enlarging the house cannot be obtained without a variance. 3. Town Law §267-b(3)(b)(3). The proposed variance is substantial with respect the increase in the degree of side yard penetration. It will increase the degree of nonconformity from 6 ft. to 31 ft. It is not substantial with respect to the overall plan of structures on the lot. 4. Town Law §267-b(3)(b)(4). Constructing an addition to the rear of the existing dwelling will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood. 5. Town Law §267-b(3)(b)(5). The need for a variance was not self-created. It is a result of the location of the pre-existing non-conforming shop building that is already partially in the side yard of the existing dwelling. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition to the dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Oliva, and duly carried, to GRANT the variance as apphed for, as shown on the site plan SP-1 prepared by Martin F. Sendlewski, A.I.A. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Unfortunately I cannot attend. My name is Chris Peddy and I live directly across the street from 270 Pequash at 445 Pequash Avenue. Concerning this matter: Firstly I want to thank and recognize that the Sendlewski's have been a great addition to the neighborhood vs the previous owner as they have dramatically cleaned up the yard and property that was an eyesore for years. However I am opposed to the relocation of the Shed which they have already done despite the opposition of the Building Inspector. It is an eyesore and an unnecessary addition to the front streetscape of the property when it could have been left at the rear of the property out of view. They are already operating a commercial garage (identified on plans as 1 story frame building) which has plenty of room for storage and there is no reason they cannot just keep the shed where it was previously located. It is already bad enough that there is a commercial operation-a car repair garage-on an otherwise 100% residential and family oriented street. As a result there are several cars parked in the yard and I am obviously concerned about the safety of my young child and the potential devaluation of property values associated with this.
