Location of Property: East End Road, Fishers Island CTM 1000-1-2-11
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as
required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the
Suffolk County Department of Planning reply dated June 24, 2008 states that the
application is considered a matter for local determination as there appears to be no
significant county-wide or inter-community impact.
LWRP CODE DETERMINATION: A letter was received from the LWRP Coordinator
concerning reasons for inconsistency of this project under Chapter 268, Waterfront
Consistency Review of the Town of Southold Code and Local Waterfront Revitalization
Program (LWRP) standards, since the set back of the proposed swimming pool will not be a
minimum of 100 feet from the top of the bluff. Under ZBA File it 5924 dated 11/30/06, it is
noted that the applicants' engineering firm, CME Associates, submitted information using a
1959 topographical survey of the area prepared by Chandler & Palmer, Engineers,
indicating the erosion rate to be an average of between 4 and 5 inches per year, and finding
the steep bank very stable and well vegetated with no areas subject to erosion. The
applicants also will provide drywells for drainage in accordance with LWRP standards
and/or as approved by the Town of Southold Board of Trustees. Also, the bluff will be
protected with hay bales, mature trees, nearby drywells away from the bluff, and
substantial landscaping.
The property fronts along the bluff and high water of Block Island Sound. The top of the
bank runs along the east side of the property and the new house is 52 feet, at its closest
point from the top of a bank. The proposed swimming pool is set back further from the top

of the bank than the house. The pool is proposed to be set back 56.6 feet from the top of a
bank at its closest point and a small terrace wall is proposed around the proposed pool to
retain the natural slope of the property. The terrace, a low brick retaining wall, is proposed
45.6 feet from the top of the bank. The terrace, and landscaping with drywells to retain
water also adds protection to the top of the bank. The bank and adjacent land slopes
consist of a natural, heavily vegetated slope with no evidence of erosion. The toe of the
slope is protected by stones and large boulders. Information was submitted by the
applicant and her agent stating that the proposed location of the pool was given careful
study by their engineer allowing the pool setback to be in this location, to maximize the
setback away from the top of the bank while being at least 100 feet from the freshwater
wetlands on the north side of the property. For these reasons, the Board finds the project
as planned to be consistent to the greatest degree practical under the policies and standards
of the LWRP and Zoning Code.
BASIS OF APPLICATION: Based on applicant's building permit application, for which the
Building Inspector on April 30, 2008 issued a Notice of Disapproval, citing Zoning Code
Section 280-116A(1), concerning a proposed accessory in-ground swimming pool +/- 56.6 feet
from the top of the bluff adjacent to Block Island Sound.
CODE REQUIREMENT: Proposed construction is not permitted pursuant to Article XXII,
Section 280-116A(1) which states: "All buildings or structures located on lots adjacent to
the Sound and upon which there exists a bluff or bank landward of the shore or beach shall
be set back nor fewer than 100 feet from the top of such bluff or bank."
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on August 21, 2008,
at which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board
finds the following facts to be true and relevant:
RELIEF REQUESTED: The applicants request placement of an accessory swimming pool
with retaining wall at less than 100 feet from the top of the bluff adjacent to Block Island
Sound.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the followings:
1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will produce no undesirable change
in the neighborhood or a detriment to nearby properties. Maximum landscaping has been
planned by applicants to obtain the greatest protection possible to protect the environment.
In addition, there is enough land area to place the pool without affecting other neighboring

lands or neighbors. The location of the pool was carefully studied and is proposed to
maximize the setback away from the top of the bank, while being at least 100 feet from the
fresh water wetlands which is on the north side of the property.
2. Town Law §267-b(3)(b)(3)(2). The benefit sought by the applicants cannot be achieved by
some method feasible for the applicant to pursue, other than an area variance. The pool
must be setback at least 100 feet from the fresh water wetlands which is on the north side
of the property.
3. Town Law §267-b(3)(b)(3)(4). The amount of relief is not substantial because the
property is sloped and the house was constructed on the fiat area of the property. The pool
is as far back as is reasonable. The placement of the house was preexisting and was
reconstructed, while retained portions of the house predates the code requirements for
minimum setbacks of 100 feet.
4. Town Law §267-b(3)(b)(3)(3). The variance will not have an adverse effect or impact on
the physical or environmental conditions in the neighborhood. The slope is stable, all water
runoff captured by dry wells and the pool must be properly retained as proposed, and no
pool water shall drain over or on the bank given the natural vegetation and retaining walls
being provided by applicants.
5. Town Law §267-b(3)(b)(3)(5). The difficulty has been self created.
6. Town Law §267-b. Grant of the variance is the minimum action necessary and
adequate to enable the applicants to enjoy the benefit of an accessory in-ground swimming
pool, while preserving and protecting the character of the neighborhood and the health,
safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member Oliva,
seconded by Member Simon, and duly
Grant the variance as applied for, as shown on the Site Plan Set CD Sheet L-1.01
dated 4-11-08 prepared by Edmund H. Hollander, Landscape Architect Design, Site
Planting Plan and Schedule dated August 22, 2008 with drainage (as per Code),
Drawings of Pool Sections (Long and Short with Depth) 3B-SEC issued 6-20-08
Plans L-5.01 revised 8-13-08..
Any deviation from the variance given such as extensions, or demolitions which are not
shown on the applicant's diagrams or survey site maps, are not authorized under this
application when involving nonconformities under the zoning code. This action does not
authorize or condone any current or future use, setback or other feature of the subject

property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimus in nature for
an alteration that does not increase the degree of nonconformity.

PLANTING NOTES
A. Coordination: Prior to I~nnln~ operations, Contractor
shall verify and certify in writing that all planting beds are in
suitable condition for plan6ng and are weliqlmined. Prior to
beginning any work on the site, verify that all wetlands
boundaries are staked, and that are~ shown on this drawing
for planting operations are eleafiy identifiable in the field. If
there is any uncertainty about wetland boundaries or
proposed areas for planting, notify the Ovraor at once, and do
not begin work on the site until these issues are clarified.
B. Contractor's responsibilities: Landscape architect and
Owner may decide to have a separate Landscape Contractor
(as distinct from Landscape Construction Coulmctor) prepare
planting beds. In lifts case, Contractors must coordinate thdir
work. Construction Contractor will bring finish grade to
bottom of proposed planting areas, 10 inches for
groundcover beds. Landscape Codiraeter will verify
drainage before starting planting opemllons.
C, Locate and protect all utilities and structures prior to and
during construction, and repair/replace any element dsm.ge
during construction at no additional cost to Owner.
D. Notify Landseape Architect/Owner of any discrepancies
or errors between plan and site conditions prior to
commencement of worL
E. Topsoil: Natural friable soil, screened sandy loam, fi.ce of
subsoil foreign matter, weeds and weed seed, stones larger
than one inch, and toxic substances. Organic conteut
mlnlmum 8% to mav-lmum 20% and a pH of 6.0 to 7.0.
on site (whether excavated by other Conmaetors or fi.om new
excavations), submit a sample of this topsoil to a soil testing
laboratory approved by the Landseepe Architect. Laboratory
must certify that soil is suitable for planting purposes.
Subject to the approval of the Landscape Architect, the
Landscape Contractor may add speddied elements to tested
topsoil to comply with Iabomtory requirements. Amended
topsoil must be re-submitted for additional testing. Final test
results must be submitted ia writing to General Contractor
and Landscape Architect and must be approved prior to use
on the site.
G. Plant material shall be guaranteed for a period of one year
at, er date of insts[lation.
II. All locabons of plant materials to be staked in field for
approval of Landscape Architect prior to planting.
I. Planting mix to be prepared of 5 parts screened topsoil 1
part peat moss, 1 part well-composted aged manure, and 1
part clean sand. Ail trees to receive min. 12" planting mix
around root ball. Shrub beds to receive 6" planting mix
Incorporated into soil to a depth of 12% Rotofill Healthy
Start 3-4-3 (by Plant Health CarD, Icc. 1-800-421-9051) a
natural biofetrilizer and soil conditioner, at the rate of 25 lbs.
per 1000 sq. ff. into the top 2 to 4 hiches of planting mix.
J. Circular planting pits with vertical sides shall be dug by
hand or machine methods for planting of trees and shrubs.
Tree pits for trees over 2 inches in caliper shall be 2 feet
greater in diameter than the spread of the root mass and one
foot deeper than the height of the root ball. Check tree pits
for draimagn before planting. Notify the Landscape Architect
of any tree pits that do not drain at the rate of at least 1 inch
per hour.
K. Excavate groundcover beds to a depth of 10 inches and
rototill Healthy Start 34-3, by Plant Health Care, Inc.
( 1-800421-9051 ), a na0a'al biofetrilizer and soil conditioner,
at the rote of 25 lb. per 1000 square feet into the top 2 to 4
inches of these beds.
L. Mulch: Apply pine needles to 1~ Jnlm~tm depth of 2 inches.
M. Landscape Architect to inspect all trees prior to delivery
to site. Coordinate with Landscapo Architect to review all
plant material prior to installation.
N. I~corporate Mycor Tree Saver by Plant Health Care, Inc.
( 1-800-421-9051 ), a natural biofertilizer and soil conditioner,
at the rote of 3 oz. per caliper inch for each proposed tree in
the Planting Schedule, and rotofiil Healthy Start 3-4-3 at the
rate of 3 oz. into the top 2 to 4 inabes of each shrub planting
pit.
O. Landscape Conrtactor shall coordinate planmig with
irrigation Contractor for plants to receive necessary water
immediately althr planting and during the "growing in"
pefimi. Landscape Contcaetor shalllnform

Dear Ms. Moore:
I am in receipt of your letter dated May 18, 2011 and the architectural drawings date
stamped received by the Zoning Board office on May 19, 2011, requesting the installation
of a lower wall in front of the approved retaining wall that was the subject of the above
referenced appeal. The proposal is not considered de minimus in nature since the proposed
lower wall will decrease the approved non-conforming setback from the top of the bluff
and would therefore require a new application to the Zoning Board of Appeals.
Should you wish to pursue this proposal, please apply to the Building Department for a
Notice of Disapproval. If you have any further questions please contact the ZBA office.

Dear Ms. Weisman:
My client has completed the pool and retaining wall as approved
by your Board in decislon #6167. I have attached a copy of the
drawings which were approved in that decision for your convenience.
My client and their architects have requested a modification to
the landscaping features: to soften the upper retaining wall which was

add a lower wall. Between the two walls boxwood are plan%ed in a
planter, a guardrail pool code compliant is located on the lower
wall, and the lower brick wall is covered with ivy. The purpose of
this lower wall is to add additional planters around the perimeter of
the existinq retaining wall, as well as, have the required guard rail
placed on the lower landscape wall.
This landscape feature was submitted to the Southold Town
Trustees and approved. A copy of their approval is enclosed.

The proposed action which has been reviewed to Chapter 268, Waterfront Consistency Review of
the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)
Policy Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT from LWRP review pursuant
to § 268 of the Southold Town Code.
I Policy 6: Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
The distance from the proposed pool to the top of bluff line is 0 feet~ a minimum
separation distance of 100 feet is required pursuant to Chapter ,~ 280-116 A which
states:
(0 All buildings or structures located on lots adjacent to sounds' and upon which there
exists a bluff or bank landward of the shore or beach shall be set back not fewer than 100
feet from the top of such bluff'or bank.
It is recommended that the Board require that the applicant amend the action to meet and/or
further the above policy to the greatest extent practicable.
In the event that the action is approved the following Best Management Practices are
recommended to further Policy 5: Protect and Improve Water Quality in the Town of Southold
and Policy 6: Protect and restore the quality and function of the Town of Southold's ecosystem:
I. Require the re-establishment of native vegetation on tile bluff. Note that this would
require the removal of existing turf and the creation of a vegetated buffer.
2. Require the installation of pool de-watering well.
Pursuant to Chapter 268, tile Southold ]'own Zoning Board of Appeals shall consider this
recommendation in prepariug its written determination regarding the cousistency of the proposed
action.

The Board of Town Trustees took the following action during its regular meeting held on
Wed., July 19, 2006 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of MICHAEL 8, SUSAN JEFFRIES
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated June 8, 2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on July 19, 2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of MICHAEL & SUSAN
JEFFRIES to demolish the existing dwelling and construct a new dwelling, abandon the
existing sanitary system and install a new sanitary system, and all as depicted on the
site plan prepared by CME Associates Engineering & Land Surveying, PLLC dated May
23, 2006 and landscape plan prepared by Edmund D. Hollander dated June 28, 2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law.
This assessment is intended to supplement other information used by a Town of Southold agency
in making a determination of consistency. *Except minor exempt actions including Building

(I) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to
nearby properties if granted, because: The property fronts Block Island Sound. The top of the bank runs
along the east side of the property and the house at it's closest point is 52 feet from the top of the bank. The
proposed swimming pool is set back further from the top of the bank then the house. The pool is set back 56.6
feet from the top of the bank at it's closest point and a small terrace wall (landscape feature) is proposed around

protection for the top of the bank. The bank is a natural heavily vegetated slope with no evidence of erosion.
The toe of the slope is protected by stones and large boulders. The property owner is completing the
reconstruction of their home and the pool has been proposed to enhance the enjoyment of this beautiful Fishers
Island property.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to
pursue, other than an area variance, because:
The location of the proposed swimming pool has been studied and proposed away from the top of the bank in
order to maximize the setback. The pool must stay away from the freshwater wetlands, more than 100 feet from
the wetlands. The freshwater wetlands are located on the north side of the property. The proposed location of
the pool is kept out of the DEC jurisdiction.
(3) The amount of relief requested is not substantial because:
The property is sloped and the house was reconstructed on the fiat areas of the property. The pool is as far back
as is reasonable. The placement of the house was preexisting, the reconstruction retalned portions of the house
which predate the setbacks of 100 feet.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the
neighborhood or district because:
The density of water is less than the density of soil, therefore, the pool will have no adverse physical or
environmental conditions on the top of the slope since it weighs less then the soil. The slope is stable, all water
runoffis captured by dry wells and the pool will not be permitted to drain on the bank.

Dear Chairman and Board members:
In accordance with our discussion at the hearing, I am in
receipt of the Local Waterfront Revitalization Program Coordinator's
letter dated August 19, 2008 and ask you to consider the following:
The subject parcel is on Fishers Island, adjacent to Block
Island Sound. The parcel is naturally sloped, with a shoreline bank
or bluff which has a slope of 22% on the south end of the property
and which dissipates to no slope, with freshwater wetlands, on the
north end of the property. At the location of the proposed pool the
shoreline contains a rocky beach with only a 10% gradual slope. The
original residence was constructed in the 60's with no evidence of
loss and the gradual slope of the bank is stable. The natural slopes
and naturally occurring rocks presently provide protection from loss
of life, loss of structure, flooding or erosion.
In 2007 the owner obtained a variance to reconstruct the
residence within 100 feet from the top of bank. Both the Trustees
and the Zoning Board recognized that the top of the bank is as shown
on a survey dated November 4, 2003 prepared by CME Associates
Engineering & Land Surveyors, PLLC. The LWRP report fails to note
that the top of the bank had been previously determined by the Town.
Most recently the Trustees, in their evaluation of the proposed pool,
found that the survey prepared by CME was accurate and reflected the
unique conditions found on Fishers Island.
The LWRP report finds the proposed pool inconsistent because the
setback from the top of the bank determined by the LWRP coordinator
to be zero (0) was not analyzed under the previously determined
setbacks. The LWRP report determined that the entire development is
within the top of bank or slope. However, the natural slopes of the
entire parcel do not constitute a bank or bluff. The definition of
bluff in Southold Town Zoning Code, 280 and the Wetland Regulations,
278 contain inconsistent definitions which do not accurately describe
the conditions found on Fishers Island. The Fishers Island coastline
is unique, there are generally no bluffs (as the term is defined in
Town Code section 280). Therefore the basis for finding inconsistency
under policy 6 is incorrect. (See attached five photographs which
illustrate the natural features of the property)
Nevertheless, the owner's efforts to make the proposed pool
"more consistent" with the LWRP is evidenced by the following actions
taken by the applicant:
1. To maintain the existing bank on the seaward side of the pool
a wall is proposed which limits activity seaward of the wall and
provides an even building area. Extensive landscaping is planned for
the entire property. Significant landscaping is seward of the wall.
(See attached plan dated 8-22-08 prepared by Edmund Hollander,
Landscape Architect Design PC.)
2. The alterations to the dwelling required a nonturf buffer to
capture surface water runoff before running down the bank, this
buffer continues to be in place and makes the project ~'more
consistent" with the LWRP at policy 4 "minimize loss of life,
structures, and natural resources from flooding and erosion", policy
5 ~protection of the water quality and supply of the Town" and policy
6 ~'protect and restore the quality and function of the Town of
Southold's ecosystem". The vegetative buffer was planted in 2007.
3. Best management practices was implemented in 2007 and continue
to be applied with this plan.

new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT

improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Town Assessors' Office located at Southold Town Hall, or Real Property Office at the County
Center, Riverhead. If you know of another address for a neighbor, you may want to send the
notice to that addreSs as well. If any letter is returned to you undeliverable, you are requested
to make other attempts to obtain a mailing address or to deliver the letter to the current owner,
to the best of your ability, and to confirm how arranqements were made in either a written
statement, or durinq the hearing, providing the returned letter to us as soon as possible;

Property Location: East End Road (vicinity of Mudd Pond and Money Pond), Fishers Island
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without further steps under SEQRA,
PROPERTY FACTS/DESCRIPTION: The applicants' 95,832 square foot parcel is located in an R-
120 Residential Zone District, and is improved with a 2017 sq. ft. single-family dwelling as shown on
the site plan dated 11/04/03 prepared by CME Associates Engineering & Land Surveying, PLLC.
BASIS OF APPLICATION: Based on applicants' request for a building permit, the Building Inspector
issued a Notice of Disapproval on March 7, 2006, amended Apdl 12, 2006 citing Sections 100-
239.4.1 (280-116) and 100-32 (280-14) for the reasons that the location of the new dwelling
construction (after demolition of the existing building) will be less than 100 feet from the top of the
bluff and at a height exceeding the code limitation of two and one-half stories.
FINDINGS OF FACT
The Zoning Board of Appeals held a public headng on this application on October 26, 2006, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTFI3: The applicants wish to substantially reconstruct their
existing single-family dwelling, utilizing parts of the existing foundation. The setbacks requested are
shown on the 5/23~2006 site plan Sheet 1 of 1 prepared by CME Associates, measuring +/- 58 feet
from the top of the bluff at the southeast corner of the dwelling, and +/-52 feet from the top of the
bluff measured at the closest point for the 16.4 ft. wide living room extension.
TOWN CODE CHAPTER 95 {268) LWRP DETERMINATION: The applicants are requesting
reconstruction of the existing dwelling using pads of the existing foundation, adding a second floor
and living room existing, after demolishing the remainder of the dwelling, A Determination of
Inconsistency was issued under Chapter 95, Waterfront Consistency Review of the Town of
Southold Code and Local Waterfront Revitalization Program (LWRP) standards which requires the

set back be a minimum of 100 feet from the top of the bluff. The applicants' engineering firm, CME
Associates, submitted information using a 1959 topographical survey of the area prepared by
Chandler & Palmer, Engineers, indicating the erosion rate to be an average of between 4 and 5
inches per year, and finding the steep bank very stable and well vegetated with no areas subject to
erosion. Grant of variance relief in this variance application is similar to, or landward of, the existing
nonconforming setbacks of the applicants' dwelling. The applicant will provide drywells for roof
drainage in accordance with LWRP standards and/or as approved by the Town of Southold Board of
Trustees. The new reconstruction areas will utilize sections of the existing foundation which are
nonconforming under the Zoning regulations, and the bluff will be protected with hay bales, mature
trees, nearby drywells away from the bluff, and substantial landscaping.
SUFFOLK COUNTY ADMINISTRATIVE CODE REFERRAL: This application was referred to the
Suffolk County Department of Planning under the provisions of the Suffolk County Administrative
Code, Sections A14-14 to 23, and the November 8, 2006 reply states that the Suffolk County
Department of Planning considered this matter for local determination, as there appears to be no
significant county-wide or inter-community impact.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties, The applicants have submitted a substantial
landscape design plan which protects the bluff areas and provides screening for the new
construction (dwelling) from view by adjacent neighbors and the adjacent property (also owned by
the applicants). In addition, the applicants will provide several drywells to properly retain water
runoff, preventing runoff onto the bluff or adjacent neighboring lands.
2. The benefit sought by the applicants cannot be achieved by some method, feasible for the
applicants to pursue, other than an area variance due to the shape and topography of the land as a
limiting factor, and established mature trees and gardens, when choosing either the location of any
addition to the existing dwelling or construction of a new dwelling.
3. The variance granted herein is substantial.
4. The difficulty has been self-created, The setback from the bluff was established after the lot was
created.
5. No evidence has been submitted to suggest that a variance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of reconstruction with additions, after substantially demolishing the
existing dwelling, while preserving and protecting the character of the neighborhood and the health,
safety and welfare of the community.
RESOLUTION OF THE BOARD; In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by
Member Weisman, and duly carried, to

GRANT the variance as applied for, as shown on the Conceptual Landscape Design Plan
dated 6/28/2006 prepared by Edward D, Hollander Landscape Architect Design, P.C.,
longitudinal section dated September 12, 2006 prepared by Anderson Architects, P.C., and
5/23/2006 diagrams prepared by CME Associates.
Any deviation from the variance given such as extensions, or demolitions which are not
shown on the applicant's diagrams or survey site maps, are not authorized under this
application when involving nonconformities under the zoning code. This action does not
authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an
alteration that does not increase the degree of nonconformity.
