EXECUTOR'S DEED
THIS INDENTURE, made November ~, 2008 between DOROTHY J. MULHALL, residing at 745
Kenneys Road, Southold, New York as Executrix under the last will and Testament of JAMES E.
MULHAU., late of 745 Kenneys Road, Southold, New York, party of the first part and DOROTHY J.
MULHALL, residing at 745 Kenneys Road, Southold, New York., party of the second part.
WlTNESSETH, that the party of the first part, to whom letters testamentary were issued by the
Surrogate's Court of the State of New York for the County of Suffolk, Surrogate's Court File No.
1798P2008 and by virtue of the power and authority given in and by said will and testament, and in
consideration of ten ($10) dollars, paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece, or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Southold, in the Town of Southold, County of Suffolk and State of New York,
known and designated as Lots Numbered i and 2 on survey map entitled" Map of Subdivision known as
Kennewood ~ made by Otto W. Van Tuyl & Son, Licensed Land Surveyor, dated January 9, 1954 and filed
in the Suffolk County Clerk's Office on March 20, 1954, as Map 2180.
BEING AND INTENDED TO BE the same premises conveyed to James Edward Mulhall, deceased, by
deed dated February 28, 1958 and recorded on March 3, 1958, in the Office of the Suffolk County Clerk
in Liber 4433, page 423.
Premises known as Section 59, Block 7, and lot 24.1 as shown on the Suffolk county Land and tax map.
TOGETHER with all right, title and interest, if any, of party of first part in and to any streets and
roads abutting said premises to the center lines thereof;
TOGETHER with the appurtenances and also all the estate which said decedent had at the time of
decedent's death in said premises, and also the estate therein, which the party of the first part has or
has the power to convey or dispose of, whether individually, or by virtue of said will or otherwise;
Grantor DOROTHY J. MULHALL is the same person certified as the Executrix of the Estate of James
E. Mulhall.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part and the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that party of the first part has not done or suffered
anythin8 whereby the said premises have been encumbered in any way whatever, except as aforesaid.
· AND the party of the first part, in compliance with Section 13 of the Uen law, covenants that party
o~ the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose.
The word Uparty" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
