a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF SEPTEMBER 27, 2007

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without further reviews under SEQRA.
PROPERTY FACTS/DESCRIPTION: The applicant's 39,770 sq. ft. parcel in the R-40 District is
improved with an existing single family dwelling with garage as shown on survey prepared by
Roderick Van Tuyi, P.C. dated August 17, 1981.
BASIS OF APPLICATION: Request for a Variance under Section 280-122, based on the
Building Inspector's January 30, 2007 Notice of Disapproval concerning proposed additions and
alterations to an existing accessory building, with conversion from the existing barn use, to an
accessory playhouse or similar accessory use as per code. The existing barn with proposed
additions is in the nonconforming front yard, instead of the code-required rear yard.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as
required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk
County Department of Planning reply dated March 14, 2007 states that the application is
considered a matter for local determination as there appears to be no significant county-wide or
inter-community impact.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on September 13, 2007,
at which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board finds
the following facts to be true and relevant:
AREA VARIANCE/RELIEF REQUESTED The applicant requests additions and renovations
related to altering the existing barn for accessory uses as per code. The 20.4' by 28.5 ft. barn is
in a nonconforming front yard location as shown on the November 16, 2006 survey prepared by

Peconic Surveyors, P.C. with setbacks at 33 feet from the westerly property line and 13 feet
from the westerly 20-ft. wide right-of-way (front yard line).
AREA VARIANCE/AMENDED RELIEF: During the September 13, 2007 hearing, the
applicant confirmed the uses of the accessory building will be permitted as per Building
Inspector (Damon Peter Rallis) letter dated June 15, 2007. ~;.i
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted
and personal inspections, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The accessory barn has been in place in this
residential neighborhood for some time with a non-conforming setback at 13 feet from a 20 ft.-
wide, private right-of-way (R.O.W.) that locates the barn in a front yard instead of the code-
required rear yard. None of the proposed additions will encroach upon the existing setback
from the R.O.W. The barn is also currently located 75.6 feet from Main Road and that front
yard setback will be reduced by the proposed open porch addition on the south side of the barn
to a conforming 69 feet. The proposed use(s) for the converted accessory barn are permitted by
code. At the public hearing, the neighbor on the west side of the R.O.W. expressed concern for a
possible reduction in their privacy caused by an additional window on the proposed west
elevation that faces their property (there are currently three) and the possibility of adding a
future interior staircase that would permit access to the proposed glazed cupola that could be
used to look down on their premises. Otherwise there were no objections to the proposed
additions and alterations.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance because the accessory building is already
located in a non-conforming front yard and the proposed additions to the accessory building will
increase the degree of this non-conformity.
3. The variance granted herein is substantial.
4. The alleged difficulty has not been self-created but is the result of an existing non-
conforming location of the barn.
5. No evidence has been submitted to suggest that the proposed additions to the accessory
building will have an adverse impact on physical or environmental conditions in the
neighborhood
6. Grant of the requested variance is the minimum action necessary and adequate to enable
the applicant to enjoy the benefit of a converted barn with accessory uses as per code, while
preserving and protecting the character of the neighborhood and the health, safety and welfare
of the community.

RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member Weisman,
seconded by Member Simon, and duly carried, to
GRANT the variance as applied for, shown on May 1, 2007 site project diagram and floor
plan revised 6/12/07 by Proper-T Permit Services subject to the following Conditions:
1. The three windows on the existing west elevation shall remain in their current
location, and a fourth window shah not be added,
2. The proposed cupola shall be glazed with a translucent material that will permit
natural light to filter into the interior but will not permit views to the exterior. Said
cupola shall not be accessible and shall be used solely as a decorative architectural
feature,
3. The proposed dormer width on the front (south) elevation of 70% of the roof width
shall be reduced to a conforming width of 40%, and
4. The accessory structure shall remain unheated and not contain a kitchen or sleeping
quarters.
That these ZBA conditions be written into the Building Inspector's Certificate of Occupancy,
when issued.
Any deviation from the variance given such as extensions, or demolitions which are not shown
on the applicant's diagrams or survey site maps, are not authorized under this application when
involving nonconformities under the zoning code. This action does not authorize or condone any
current or future use, setback or other feature of the subject property that may violate the
Zoning Code, other than such uses, setbacks and other features as are expressly addressed in
this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an
alteration that does not increase the degree of nonconformity.
