The Planning Board has received your request for a determination regarding the necessity for site plan for the above referenced application. The Town of Southold is responsible for regulating land usage and approving building permits. We are forwarding a copy of your letter to the Town for any appropriate action they deem necessary to address your concerns. Our role in developments, such as Beds and Borders, along or adjacent to the State Highway system, is to review the proposed work within the State Highway right-of-way (ROW) and to review the impact of the site generated traffic on the State Highway system. The developer must mitigate negative traffic impacts, which may require construction of turning lanes, highway widening, traffic signal improvements and other related work depending on the size and scope of the development. Once developers address those impacts to our satisfaction, we issue highway work permit(s) to allow developers to work within the State Highway right-of-way to carry out the necessary work. We do not have the authority to deny access to a State Highway except along a controlled or limited access highway. Hopefully, this clarifies our Department's role in developments, such as Beds &Borders. We reviewed all proposals for access to the site and we consulted with Town of Southold engineering and planning personnel regarding same. Based on our review and discussion of the proposed location of the farm stand, we determined the operational safety of NY 25 may be improved with an entrance only access from NY 25. Therefore, we issued the property owner a Highway Work Permit to establish an entrance only to the farm stand and to also install No Stopping signs along the NY 25 highway frontage. All exiting traffic would be required to exit onto Laurel Lane to access NY 25. Had we not permitted access to this site from NY 25 it is conceivable to believe that many cars would be stopping on the shoulder of the State Highway. If that occurred, it would also be likely to expect pedestrian activity along this busy section of NY 25 to gain entry to the farm stand based on its proposed proximity to NY 25. Permitting an ingress only at this location promotes the containment of all parking and pedestrian activity on site, which appears to enhance safety for all involved. SCTM#: 1000-127-02-02.1 Dear Mr. Verity: I have received a revised site plan from the applicant for the above referenced project. In addition, I have completed a site inspection and enclosed a copy of this revised site plan for your reference. Please consider the following: 1. This revised site plan indicates an "Entrance Only' Access from. NY State Route 25.This access point was not allowed based on the last correspondence that I have received from the DOT. According to the applicant,the DOT has reconsidered there position and they have approved this access point subject to all exiting traffic leaving by way of Laurel Lane. This item will require certification by the DOT in writing prior to issuance of any permits. 2. The shallow swale drainage system indicated/shown on this revised site plan is considered adequate to contain the runoff from the proposed roadway and parking area. However, this proposed road and parking area must be graded in a manner that will direct all surface flow into this swale. 3. The proposed selling space shown in the plan is a reasonably large area. Will the applicant be placing stone blend or other surfacing materials within this area? If storm-water run-off is generated by improvements made to this area this watershed area will also require drainage systems or a site design capable of containing all of the run-off on site. Grading the site to allow for surface water flow in the direction of the proposed drainage swales would be acceptable. 4. The applicant has begun assembly of what appears to be the construction of a trellis system fronting the proposed Farm Stand. We would like to make you aware that a highway serves two major purposes as a part of a transportation facility. It must facilitate safe and efficient movement of people and goods and provide reasonably convenient 'access to the abutting property owner. Driveway regulation is intended to balance these two roles without allowing one to become a serious detriment to the other and is implemented by the Highway Work Permit review process. Available research links increased numbers and width of commercial access points and undesirable locations with increased accidents and lower levels of service. Uncontrolled access can increase accidents, disrupt traffic flow, degrade air quality, reduce commercial viability of the corridor, result in early functional obsolescence of the facility, and require costly remedies. Good control of access can diminish these adverse impacts by minimizing points of conflict between through traffic an�de*fi,09,or exiting.txaflic and separating the highway from activities on abutting property. To achieve a desired balance between the mobility and access functions.of the State highway system, localities join with the Department in looking beyond individual driveways and developments and apply a corridor or subarea perspective by coordinating access and land use control decisions. The initiative is collaboration between the Department and local governments, which focuses on melding transportation and land-use management strategies to preserve and. enhance mobility while promoting development along uncontrolled access facilities. The goals of access management are to limit the number of access points, separate conflict points and remove turning traffic from through movements. New York State is utilizing this technique to -minimize impacts to State highways. We have consulted with Town of Southold Planning personnel concerning this matter and they support the access management technique described above. During the course of our review, it was rioted that the site has an existing access to Laurel Lane for. the existing wholesale business. The site has significant frontage on Laurel Lane and. could accommodate another access point for the retail business, which would not only keep wholesale and retail traffic separate, but also eliminate the.need for access to.NY 25. Our driveway policy states "When a property fronting on a State highway also.fronts on and has access to any other public street, road, or highway that intersects.the State highway, the Department may restrict access to the State highway if it determines that such access would be detrimental to the safety and/or operation of the State highway." In addition, it appears that to increase the visibility,business signs could be installed along NY 25, on private property, subject to,local laws/regulations, to direct potential customers to a retail access on Laurel Lane. Based on all of the information noted above, we will not be able to approve your request to establish direct access to this site from NY 25 as designed. We recommend that all site access should be from the local road. Should site development and traffic volumes at the NY 25 /Laurel Lane intersection increase to the point that Town of Southold Planning Board review and approval becomes necessary, additional mitigation measures at this intersection may be needed as part of the review process. We would like to make you aware that a highway serves two major purposes as a part of a transportation facility. It must facilitate safe and efficient movement of people and goods and provide reasonably convenient access to the abutting property owner. Driveway regulation 1s intended to balance these two roles without allowing one to become a serious detriment to the other and is implemented by the Highway Work Permit review process. Available research links increased numbers and width of commercial access points and undesirable locations with increased accidents and lower levels of service. Uncontrolled access can increase accidents, disrupt traffic flow, degrade air quality, reduce commercial viability of the corridor, result in early functional obsolescence of the facility, and require costly remedies. Good control of access can diminish these adverse impacts by minimizing points of conflict between through traffic and entering or exiting traffic and separating the highway from activities on abutting property. To achieve a desired balance between the mobility and access functions of the State highway system, localities join with the Department in looking beyond individual driveways and developments and apply a corridor or subarea perspective by coordinating access and land use control decisions. Mr.Zack Eddinger . • April 7,2009 Page 2 of 3 One method of improving coordination is through the Department's Arterial/Access Management Initiative. The initiative is collaboration between the Department and local governments, which focuses on melding transportation and land-use management strategies to preserve and enhance mobility while promoting development along uncontrolled access facilities. The goals of access management are to limit the number of access points, separate conflict points and remove turning traffic from through movements. New York State is utilizing this technique to minimize impacts to State highways. We have consulted with Town of Southold Planning personnel concerning this matter and they support the access management technique described above. During the course of our review, it was noted that the site has an existing access to Laurel Lane for the existing wholesale business. The site has significant frontage on Laurel Lane and could accommodate another access point for the retail business, which would not only keep wholesale and retail traffic separate, but also eliminate the need for access to NY 25. Our driveway policy states "When a property fronting on a State highway also fronts on and has access to any other public street, road, or highway that intersects the State highway, the Department may restrict access to the State highway if it determines that such access would be detrimental to the safety and/or operation of the State highway." In addition, it appears that to increase the visibility, business signs could be installed along NY 25, on private property, subject to local laws / regulations, to direct potential customers to a retail access on Laurel Lane. Based on all of the information noted above, we will not be able to approve your request to establish direct access to this site from NY 25 as designed. We recommend that all site access should be from the local road. Should site development and traffic volumes at the NY 25 / Laurel Lane intersection increase to the point that Town of Southold Planning Board review and approval becomes necessary, additional mitigation measures at this intersection may be needed as part of the review process. The goals of access management are to limit the number of access points, separate conflict points and remove turning movements from through traffic. Please consult our Policy Manual titled `Policy and Standards for the Design of Entrances to State Highways' on our web site www.nysdot.gov for the required features to be included in the plans. All proposed road improvements detailed in the Site Plans must be designed in accordance with the latest versions of AASHTO, National Manual of Uniform Traffic Control Devices (MUTCD), along with NYS Supplement and NYSDOT Highway Design Manual.
