GORDON JAMES WALL Southold, N.Y. 11971 TELEPHONE 765-1938 A regular meeting of the Southold Town Planning Board was held on Tuesday, January 10, 1978 at 7:30 p.m. at the Town Hall, Main Road, Southold, New York. Present were: John Wickham, Chairman Henry E. Raynor, Jr., Vice-Chairman Frank S. Coyle Frederick E. Gordon Absent was: James Wall (inclement weather) Woodbine Manor. Mr. and Mrs. John Fellinger-Ihar and Shepard Scheinberg, Esq., appeared. The developers are willing to restrict the right-of-way in the front from Duck Pond Road through lots 20 and 21 with deeded access in the back to the recharge basin. The Planning Board needs the written report of the Supt. of Highways which is required by the Code. Mr. Scheinberg requested a thirty day extension of time to act to settle this matter of access to the recharge basin. On m0~i~n made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to grant a 30 day extension of time to act as requested by the attorney for the developer of the subdivision known as "Woodbine Manor" in order to get the written report of the Supt. of Highways. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon Drell Corporation site plan for addition to existing building. Lewis Edson appeared. Planning Board -2- J~ lry 10, 1978 On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to approve the site plan of Drell Corporation for an addition to existing building as presented by Lewis Edson subject to receipt of a list of plantings and pencil sketch of location of same, said plantings to encompass approximately five feet on the westerly side of the property and three or four feet on the southerly side. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon North Fork Manor~ Inc. change of zone application. Eric Bressler, Esq., Fred Meyer, Planner, appeared. Mr. Ksouros was also present in the room. Mr. Meyer made a presentation and left a copy of a study he has done regarding this change of zone application. His main thrust was that the property is surrounded by other business property, had originally been zoned for business and was totally unsuitable for two one-family houses. There was discussion about the site plan for the Hut which required the access to be from the side street. A barrier had been placed so no access could be obtained from the County Road but after approximately two months the barrier was removed. The previous owner could not live up to the access with his business. There was also discussion about the traffic pattern at the intersection. The Board will investigate the site before it makes a decision. Heritage Harbor - Riverside Homes, Inc. Matthew Wandoloski appeared. The covenants and restrictions were reviewed. In item #18 and #33, there was an error in the name of the corporation. There also is no provision for the time that the home owners association would acquire the open space and roadways and the liability therefore. Joanne Schwartz minor subdivision. William Price, Jr., Esq. and Robert Gillispie III appeared. Mr. Price will check with his client to see if there is an objection to a building line being shown on lot #1. Terry appeared and requested The board will discuss the Kreh and Allen minor subdivisions. John McNulty, Esq. appeared. Henry Raynor reported that he had met with Robert Tasker, Town Attorney, on Tuesday, December 27, 1977. The Town Attorney had indicated to Mr. Raynor that this subdivision could be developed Planning Board -3- ~uuary lO, 1978 as a major subdivision or two minor subdivisions in tandem use. This would involve a common right-of-way 50 feet wide and the straightening out of the right-of-way involved. The recommendations of the Suffolk County Dept. of Health as to completing test holes and wells on both properties should be adopted. The recommendations of the Suffolk County Planning Commission with regard to setback, sewage sanitary facilities and possible erosion in the area should be adopted. Mr. Raynor recommended that it should be treated as two minor subdivisions, with the necessary restrictions. It was suggested that Mr. Allen eliminate the problem lot and make the subdivision three lots. The following letter under date of August 8, 1977 to the Planning Board was read. Dear Ms. Brush: Please be advised that, in response to your letter of July 26, 1977, we have made a survey of the area. Our findings are as follows. l) The majority of the land consists of hydraulic fill which was placed there m~ny years ago. 2) It would appear that areas not filled and/or filled were, at one time, wetlands. 3) It is evident that a good deal of this land is underlain with meadow mat which is not a suitable material for individual sanitary systems and/or construction of buildings. 4) The possibility of obtaining a potable water supply under normal conditions would appear very unlikely. Construction of private wells in a re, re area located as far as possible from the wetlands might bear some potable water. However, it is very unlikely that any well in this area could be driven as much as 40' deep. The Department's recommendations are that, before we could entertain any thoughts of approval, we would request that test holes and test wells be installed. Further, that approvals for the subdivision would require additional fill being placed in those areas where a leaching system might be installed. This would necessitate Town, County and State approval. With the present lot layout, there may be some difficulty in obtaining the minimum 100' from leaching pools to surface waters. I would think that the Town might investigate the possibilities put forth by Mr. Charles G. Lind in his letter of July 8, 1977, addressed to Mr. Wickham, since such combining of subdivisions with a reserved area for private wells may just cause a subdivision to be viable. If the Town would wish to pursue this matter further, this office would request that the developers provide test holes and test wells. A final decision could not be made without this information. /s/ Robert W. The request is from residential to multiple zone. For the immediate future, Mr. Aliano would like to place a Par 3 and tennis courts on this property across the street from the Beachcomber. In the future, if erosion continues on the Sound, he may want to locate his motel there. The board would like to make a physical inspection of the property. Edward Booth cluster subdivision. Whitney Booth appeared. Mr. Lawrenc~ Tuthill, Town Engineer, made the following recommenda- tions which are to be followed. 1. That the roads be layed out so that there are no reverse curves or compound curves and 200 foot tangents between curves. 2. That a connection to the property of Bittner be made in the vicinity of lot no. 10. 3. That a recharge basin be inclnded. Mr. Tuthill is to be contacted by Mr. Booth to determine where the recharge basin should be located. Mr. Tuthill had also suggested that lot no. 12 is in the flood plain area. The Conservation Advisory Council examined the property and although several small pools of fresh water were found, none would be classified as fresh water wetlands. Any ponding in the subdivision should be shown on the map. There should be more buildable are in no. 12. William and Barbara Schriever subdivision. Mr. and Mrs. Schriever and Charles Cuddy, Esq., appeared. Mr. Schriever wants to put both properties in one subdivision. He also feels the road should go through to Village Lane. He wants to abandon the business property. He needs approval of the Town Board to cluster the property. He will come back with drawings. On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to approve the minor subdivision of property of Lloyd Terry located at Orient, New York, said map dated October 7, 1977 and amended November 2, 1977, subject to the following: 1. Covenants and restrictions as to no further subdivision of the property being filed in the Suffolk County Clerk's Office. 2. The remainder of the property will be treated only as a major subdivision. 3. The right-of-way will be constructed to the specifications of the Town Engineer. 4. Vote of the Board: Ayes: Wickham, Raynor, Gordon, Coyle On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to approve the final map of the subdivision known as "Centennial Manor~ Section l" located at Cutchogue, New York, subject to the following: 1. Receipt of report of the Supt. of Highways. 2. Receipt of bond estimate from the town engineer, acceptance of same by the Southold Town Board and receipt of inspection fee. 3. Turnarounds being dotted in on the map. 4. Recommendations of the Suffolk County Planning Commission. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon *** On motion made by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED to approve the preliminary map of the subdivision known as "Country Club Estates" located in Cutchogue, New York, subject to the following: 1. General compliance with the recommendations of the Suffolk County Planning Commission in letter dated December 9, 1977. 2. General compliance with the recommendations of the town engineer, Lawrence M. Tuthill, as contained in report dated January 10, 1978. 3. Recommendations of the Southold Town Conservation Advisory Council. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon Planning Board -6- ,anuary 10, 1978 On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to approve the preliminary map of the subdivision known as "Southold Gardens" owned by Babcock and Rimmler and located at Southold, New York, said map dated November 3, 1977, subject to the following: 1. Addition of two proposed leaching pools as shown on the preliminary map of Southold Gardens amended July 18, 1976. 2. Addition of a valley gutter as leaching field should pick up some of the water coming down Wells Road. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon Mr. Gordon made a motion, seconded by Mr. Raynor and carried to approve the minutes of November 30, 1977 as presented. Mr. Coyle made a motion, seconded by Mr. Raynor and carried to approve the minutes of December 13, 1977 as presented. On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to set 7:30 p.m., January 30, 1978 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of property of which Arlene Marvin is the contract vendee. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED to set 8:00 p.m., January 30, 1978 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the preliminary map of the subdivision known as "S~ndwood Farms". Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon On motion made by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED to accept the recommendations of the Suffolk County Planning Commission as pertain to the subdivision of property of Mary MacNish. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon Planning Board -7- January 10, 1978 On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to accept the recommendations of the Suffolk County Planning Commission as pertain to the subdivision of property known as Nay Harbor Hills. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon Mr. Wickham reported to the Board that he had written a letter to Mr. William Baxter regarding Fort Corchaug. On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to recommend to the Southold Town Board the following change in the Code of the Town of Southold: (Changes or additions in text are indicated by underline, deletions by ~88-17 OTHER ORDINANCES AND RE~WAA~$Ng MODIFICATIONS The provisions of this chapter shall be in addition to and supplementary to the provisions of all other ordinances of the Town of Southold, and where there is any conflict between the provisions of this chapter and any other ordinance, then the ordinance providing the stricter regulation shall prevail. However~ where the Town Board finds that extraordinary and ,~nnecessary hardships may result from strict compliance with the provisions of this chapter, then iL may vary any condition of this ordinance so that the intent of the ordinance shall be observed with respect to the orderly development of tourist camps and safeguarding the public health, safety and general welfare. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon Mr. Wickham reported that he had written to the New York State Department of Environmental Conservation requesting information on why they had cancelled the hearing on Nunnakoma Waters in view of the fact that there were objections filed. Long Pond Estates was discussed briefly and will be referred to the Town Engineer for his study and recommendations.
