The following resolution was adopted by the Southold Town Planning Board at a meeting held on
Monday, April 27, 2009:
WHEREAS, at its February 9, 2009 meeting, the Planning Board determined to waive the site
plan requirements of {}280-133 with respect to the siting of a hoop house in the front portion of
the property located at 13797 Oregon Road in Cutchogue, SCTM~1000-83-2-10.16, owned by
Timothy Steele; and
WHEREAS, that determination was set forth in a letter dated February 23, 2009 to Mr. Steele's
attorney; and
WHEREAS, the Planning Board wishes to ratify and confirm its determination by the adoption of
this resolution; therefore be it
RESOLVED, that the Planning Board hereby ratifies and confirms its determination to waive the
formal site plan requirements of §280-133 with respect to the siting of a hoop house in the front
portion of the property located at 13797 Oregon Road in Cutchogue, SCTM#1000-83-2-10.16,
owned by Timothy Steele, for the reasons set forth in the letter of February 23, 2009 to Abigail
A. Wickham, Esq. and approves the siting of the structure where situated.

As notified in the correspondence dated September 10, 2009, an inspection of the above captioned
properly was coaducted ou September 17, 2009. This inspection has revealed that nonagricultural activities
have occurred on a six-acre area of PDR property without permission from the County of Suffolk. These
activities constitute violations of Suffolk County law and of the deed of development rights acquired by the
Connty of Suffolk on January 29, 1997.
You are hereby directed to immediately CEASE AND DESIST any nonagricultural activities
including, but not limited to, all-terrain vehicle use. Your failure to comply herewith will result in prompt legal
action.

Dear Ms. Wickham,
This letter is to inform you of the Southold Town Planning Board's decision
regarding your site plan application for Timothy Steele, SCTM# 1000-83-2-10.16.
The Planning Board has reviewed the above referenced application at their
February 9, 2009 Work Session. Based upon this review and materials supplied
by the applicant, the Planning board has determined that Site Plan approval for
this project is not required for the following reasons:
a. Pursuant to§280-127 of the Southold Town Code~ Site plan is not
required because the proposed agricultural hoop house will not
create any changes in use or intensity of the property which will
affect the characteristics of the site in terms of parking, loading,
access, drainage, open space or utilities;
b. The proposed Quonset hut type building/hoop house was 'reviewed
by Allan S. Connell of the Natural Resources Conservation Service
(NRCS) and a determination was made that there was adequate
drainage for this structure and that no further measures were
required to control run-off;
c. Pursuant to §280-133(c) of the Southold Town Code, the Planning
Board has the discretion to waive any or all of the requirements of
§280-133, where the application involves uses strictly related to
agriculture and where the requirements of §280-133 are not
necessary to protect and maintain the public health, safety or
welfare;
d. The applicant has supplied the Southold Town Planning Board with
documentation verifying that his business is a bona fide
agricultural operation and that the property upon which this hoop
house is built is part of the Suffolk County Agricultural Districts
Program.

Dear Heather:
Pursuant to our previous discussion, we request abbreviated review of the telixporary
hoophouse installed by Mr. Steele on his farm at Cutchogue, NY. The l~oophbuse was installed
in a location approved by Ed Forrester on site, and did not require a building permit, but the
Building Dept. has since determined that the reinforcement of the ends required a permit.
Accordingly, we enclose:
1. Site Plan application
2. Notice of Disapproval
3. LWRP
4. Copyofphoto of site
5. Three copies of proposed map
6. Copy of hoophouse information
Because of the extensive horticultural plantings on the property, and the desire to preserve
existing vegetation, this is the only feasible location for the hoophouse. It is well screened.
We request that site plan be waived or the components abbreviated.
This application is made solely at the insistence of the Building Department and is not an
acknowledgement by the applicant that the application is required under the Zoning Code.
Mr. Steele and I would welcome the opportunity to meet with you and/or the Board at a work
session to review this matter.

Mr. Steele, who runs a farming operation at the above property, erected an
agricultural building some time ago, in a location approved by Mr. Forrester. The
building is a hoop-type structure which houses his fanning equipment and supplies. He
was advised at the time that a building permit was n~ requirec[. The building is a
temporary building and does not have a foundation. (~-~c,~> p~
After a winter storm which damaged the structure, he fortified the ends of the
structure with removable wood/door covers. The Town, upon the complaint of a
litigious neighbor, issued a violation. In addition, and at our request, the Building
Department issued a notice of disapproval, copy enclosed. The gist of the matter is that
they do not regard the building as being of a temporary nature.
We were advised by the Building Department that we can either apply to the Zoning
Board of Appeals for a variance, or seek site plan review by the Planning Board. We
would like to request a meeting with the Planning Board, or its staff, to review this
matter. If the site plan is pursued, we would request that an expedited review be
allowed as the nature of the structure is a temporary ag structure which is used in the
on-premises farming operation.
A copy of the map showing the location of the structure, together with a photograph
of it, is enclosed. Thank you for your consideration.
