This letter is to inform you of the Southold Town Planning Board's decision
regarding your site plan application for Joe and Catherine Shipman,
SCTM#1000-108-3-5.5.
The Planning Board has reviewed the above referenced application at their
January 5, 2009 Work Session. Based upon this review, the Planning board has
determined that Site Plan approval for this project is not required for the following
reasons:
a. Pursuant to §280-127 of the Southold Town Code, Site plan is not
required because the proposed agricultural storage barn will not
create any changes in use or intensity of the property which will
affect the characteristics of the site in terms of parking, loading,
access, drainage, open space or utilities; and
b. Pursuant to §280-133(c) of the Southold Town Code, the Planning
Board has the discretion to waive any or all of the requirements of
§280-133, where the application involves uses strictly related to
agriculture and where the requirements of §280-133 are not
necessary to protect and maintain the public health, safety or
welfare.

We have completed our review of this submission.
As long as all work takes place outside the NY 25 highway right-of-way (ROW) and the NY 25
highway ROW is not used to perform any work or to stage equipment or vehicles, we will not require a
Highway Work Permit from our Agency.
However, please note that as mentioned in our previous letter of 12-1-08, any utility work in State
ROW will require a utility Highway Work Permit.

PROPERTY LOCATION: 20685 Route 25 (Main Road), Mattituck CTM 108-3-5.5
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as
required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the
Suffolk County Department of Planning issued its reply dated June 24, 2008 stating that
this application is considered a matter for local determination as there appears to be no
significant county-wide or inter-community impact.
PROPERTY FACTS/DESCRIPTION: The subject property is a 40,854 square foot parcel
measuring 264.09 feet along Main Road (Route 25) to the south, 200.00 feet along the
western boundary, 144.44 feet along the northern boundary, and 233.05 feet along the
eastern boundary. The lot is improved with a tree farm, as shown on the survey by John C.
Ehlers, Land Surveyor, dated March 3, 2005.
BASIS OF APPLICATION: Request for a Variance as amended under Section 280-124,
based on the Building Inspector's August 18, 2008 amended Notice of Disapproval which
states that the proposed agricultural storage building on an existing tree farm property is
not permitted for the reason that barns, storage buildings, greenhouses (including plastic
covered) and other related structures, shall conform to the yard requirements for principal
buildings, and the required minimum rear yard setback is 60 feet.
RELIEF REQUESTED The applicant requests a variance to construct an agricultural
storage building with a setback of 10 feet from the rear property hne.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted, and personal inspections, the Board makes the following findings:
1. Town Law ~267-b(3)(b)(3)(1). Grant of setback variance will not have a significant
adverse environmental effect on the character of the neighborhood or be a detriment to
nearby properties. The proposed building will be close to the adjoining part of a farm
owned by the applicant and will not impact on neighbors' property.

2. Town Law §267-b(3)(b)(2). The benefit of an agricultural storage building cannot be
achieved by some method, feasible for the applicant to pursue, other than an area variance.
The Board finds that location of the building for the storage of agricultural equipment close
to the adjoining lot is important to the operation of the farm.
3. Town Law §267~b(3)(b)(3). The variance is substantial. It is partially mitigated by the
fact that the adjoining property is part of the same tree farm owned by the applicant.
4. Town Law §267-b(3)(b)(5). The need for a variance was self-created. It is a consequence
of the layout of the farm, which is divided by a boundary near the middle of farm occupying
more than one lot.
5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that grant of this
relief will have an adverse impact on physical or environmental conditions in the
neighborhood.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and
adequate to enable the applicant to enjoy the benefit of new construction, while preserving
and protecting the character of the neighborhood and the health, safety and welfare of the
community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member Simon,
seconded by Member Weisman, and duly carried, to
DENY the variance as applied for, and in the ALTERNATIVE, to
GRANT a variance to allow a 15-foot setback from the rear lot line.
Any deviation from the variance given such as extensions, or demolitions which are not
shown on the applicant's diagrams or survey site maps, are not authorized under this
application when involving nonconformities under the zoning code. This action does not
authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for
an alteration that does not increase the degree of nonconformity.
Vote of the Board: Ayes: Members Oliva (Vice Chairwoman), Dinizio, Simon, and
Weisman. (Chairman Goehringer w~a~ absent.) This Resolution was duly adopted (4-0).

The Planning Board received your request for comments regarding the above application to
construct an agricultural storage building.
The Planning Board has not received an application for this site. Based on a preliminary review
of the plans submitted with this request, it appears the site is well-screened with vegetation from
the Scenic Byway (SR 25) and other properties, and there is enough land area to be able to
provide an adequate drainage system for storm-water runoff associated with the building. The
property line nearest to the proposed building (10') appears to be under the same ownership and
part of the same farm operation.

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and subznitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.

property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law.
This assessment is intended to supplement other information used by a Town of Southold agency
in making a determination of consistency. *Except minor exempt actions including Building
Permits and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold

consideration in this application and determines that this review fails under the Type II
category of the State's List of Actions, without further steps under SEQP~A.
S.U. FFOLK COUCqTY ADMINJ~TRATP~E CODE: This application was referred as
required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the
Suffolk County Department of Planniug issued its reply dated June 24, 2008 stating that
this application is considered a matter for local determination as there appears to be no
significant county-wide or inter-community impact.
P~ROPERTfi/FAC.TS/DESCRIPTION: The subject property is a 40,854 square foot parcel
measuring 264.09 feet along Main Road (Pmute 25) to the south, 200.00 feet along the
western boundary, 144.44 feet along the northern boundary, and 233.05 feet along the
eastern boundary. The lot is improved with a tree farm, as shown on the survey by John C.
Ehlers, Land Surveyor, dated. March 3, 2005.
B_ASIS OF APPLICATIO~N: Request for a Variance as amended under Section 28o-124,
based on the Building Inspector's August 18, 2008 amended Notice of Disapproval which
states that the proposed agricultural storage building on an existing tree farm property is
not permitted for the reason that barns, storage buildings, greenhouses (including plastic
covered) and other related structures, shall conform to the yard requirements for principal
buildings, and the required minimum rear yard setback is 60 feet.
RELIEF I~.EQUE..~TED: The applicant requests a variance to construct an agricu].tural
storage buj.iding with a setback of 10 feet from the rear property line.
REASONS FOR BOAI.~D ACTION: On the basis of testimony presented., materials
submitted, and personal, inspection~ the Board makes the following findings:
l. Tow.n. Law ~26%.b(3)(b)(3)(1). Grant of setback variance will not have a significant
adverse environmental effect on the character of the neighborhood or be a detriment to
nearby propertiee. The proposed building will be close to the adjoining part of a farm
owned by the applicant and will not impact on neighbors' property.

2. Town Law ~267-b(_3)(b)(2). The benefit of an agricultural s~orage builclLng cannot be
achieved by some method, feasible for the applicant to pursue, other than an area variance.
The Board finds that location of the building for the storage of agricultural equipment close
to the adjoining lot is important to the operation of the farm.
3. Town Law §267-b(.3)(b)(3~. The variance i~ substantial.. It Jz partially mitigated by the
fact that the adjoining property is part of the same tree farm owned by the applicant.
4. Town Law ]267-b(3)(b)(5). The need for a variance was self-created. It is a consequence
of the~layout of the farm, which is clivided by a boundary near the middle of farm occupying
more than one lot.

FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project or action may
be significant. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of
