SCTM#1000-108-3-5.5 Zoning District: AC Dear Ms. Moore, This letter is to inform you of the Southold Town Planning Board's decision regarding your site plan application for Joe and Catherine Shipman, SCTM#1000-108-3-5.5. The Planning Board has reviewed the above referenced application at their January 5, 2009 Work Session. Based upon this review, the Planning board has determined that Site Plan approval for this project is not required for the following reasons: a. Pursuant to §280-127 of the Southold Town Code, Site plan is not required because the proposed agricultural storage barn will not create any changes in use or intensity of the property which will affect the characteristics of the site in terms of parking, loading, access, drainage, open space or utilities; and b. Pursuant to §280-133(c) of the Southold Town Code, the Planning Board has the discretion to waive any or all of the requirements of §280-133, where the application involves uses strictly related to agriculture and where the requirements of §280-133 are not necessary to protect and maintain the public health, safety or welfare. (631) 765-1809 · Fax (631) 765-9064 FINDINGS, DELIBERATIONS, AND DETERMINATION - MEETING DATE: OCTOBER 16, 2008 ~ ZBA # 6173 - JOSEPH and CATHLEEN SHIPMAN ~ PROPERTY LOCATION: 20685 Route 25 (Main Road), Mattituck CTM 108-3-5.5 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 24, 2008 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The subject property is a 40,854 square foot parcel measuring 264.09 feet along Main Road (Route 25) to the south, 200.00 feet along the western boundary, 144.44 feet along the northern boundary, and 233.05 feet along the eastern boundary. The lot is improved with a tree farm, as shown on the survey by John C. Ehlers, Land Surveyor, dated March 3, 2005. BASIS OF APPLICATION: Request for a Variance as amended under Section 280-124, based on the Building Inspector's August 18, 2008 amended Notice of Disapproval which states that the proposed agricultural storage building on an existing tree farm property is not permitted for the reason that barns, storage buildings, greenhouses (including plastic covered) and other related structures, shall conform to the yard requirements for principal buildings, and the required minimum rear yard setback is 60 feet. RELIEF REQUESTED The applicant requests a variance to construct an agricultural storage building with a setback of 10 feet from the rear property hne. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. Town Law ~267-b(3)(b)(3)(1). Grant of setback variance will not have a significant adverse environmental effect on the character of the neighborhood or be a detriment to nearby properties. The proposed building will be close to the adjoining part of a farm owned by the applicant and will not impact on neighbors' property. Page 2 - October 16, 2008 ZBA # 6173 - J. and C. Shipman, Applicants CTM 108-3-5.5 2. Town Law §267-b(3)(b)(2). The benefit of an agricultural storage building cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The Board finds that location of the building for the storage of agricultural equipment close to the adjoining lot is important to the operation of the farm. 3. Town Law §267~b(3)(b)(3). The variance is substantial. It is partially mitigated by the fact that the adjoining property is part of the same tree farm owned by the applicant. 4. Town Law §267-b(3)(b)(5). The need for a variance was self-created. It is a consequence of the layout of the farm, which is divided by a boundary near the middle of farm occupying more than one lot. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that grant of this relief will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of new construction, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Weisman, and duly carried, to DENY the variance as applied for, and in the ALTERNATIVE, to GRANT a variance to allow a 15-foot setback from the rear lot line. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Vote of the Board: Ayes: Members Oliva (Vice Chairwoman), Dinizio, Simon, and Weisman. (Chairman Goehringer w~a~ absent.) This Resolution was duly adopted (4-0). Ruth D. The Planning Board has not received an application for this site. Based on a preliminary review of the plans submitted with this request, it appears the site is well-screened with vegetation from the Scenic Byway (SR 25) and other properties, and there is enough land area to be able to provide an adequate drainage system for storm-water runoff associated with the building. The property line nearest to the proposed building (10') appears to be under the same ownership and part of the same farm operation. S.U. FFOLK COUCqTY ADMINJ~TRATP~E CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planniug issued its reply dated June 24, 2008 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. P~ROPERTfi/FAC.TS/DESCRIPTION: The subject property is a 40,854 square foot parcel measuring 264.09 feet along Main Road (Pmute 25) to the south, 200.00 feet along the western boundary, 144.44 feet along the northern boundary, and 233.05 feet along the eastern boundary. The lot is improved with a tree farm, as shown on the survey by John C. Ehlers, Land Surveyor, dated. March 3, 2005. B_ASIS OF APPLICATIO~N: Request for a Variance as amended under Section 28o-124, based on the Building Inspector's August 18, 2008 amended Notice of Disapproval which states that the proposed agricultural storage building on an existing tree farm property is not permitted for the reason that barns, storage buildings, greenhouses (including plastic covered) and other related structures, shall conform to the yard requirements for principal buildings, and the required minimum rear yard setback is 60 feet. RELIEF I~.EQUE..~TED: The applicant requests a variance to construct an agricu].tural storage buj.iding with a setback of 10 feet from the rear property line. REASONS FOR BOAI.~D ACTION: On the basis of testimony presented., materials submitted, and personal, inspection~ the Board makes the following findings: l. Tow.n. Law ~26%.b(3)(b)(3)(1). Grant of setback variance will not have a significant adverse environmental effect on the character of the neighborhood or be a detriment to nearby propertiee. The proposed building will be close to the adjoining part of a farm owned by the applicant and will not impact on neighbors' property. Page 2 - October 16~ 200S ZBA# 6173 - J. a~cl C. Shipman, Applicants CTM 108-3-~.5 2. Town Law ~267-b(_3)(b)(2). The benefit of an agricultural s~orage builclLng cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The Board finds that location of the building for the storage of agricultural equipment close to the adjoining lot is important to the operation of the farm. 3. Town Law §267-b(.3)(b)(3~. The variance i~ substantial.. It Jz partially mitigated by the fact that the adjoining property is part of the same tree farm owned by the applicant. 4. Town Law ]267-b(3)(b)(5). The need for a variance was self-created. It is a consequence of the~layout of the farm, which is clivided by a boundary near the middle of farm occupying more than one lot. ~ ..Town Law .~26%b(3)(b)(4): No evidence has been submitted to suggest that grant of this relief wi]~ have an adverse impact on physical or environmental conditions in the neighborhood. 6. Town Law ~267-h, Grant of the requested relief is the minimum a~ion necessary and adequate to enable the applicant to enjoy the benefit of new construction, while preearving and protecting the character of the neighborhood and the health, safety and welfare of the community, RESOLUTIQIq OF T,H~E ,BOARD: In considering all ef the above factors and applying the balancing test under New York Town Law 267-B, motion was offerecl by Member Simon, seconded, by Member Weisman, and duly carried, to DENY the variance as applied for, and in the ALTERNATIVE, to GIKANT a variance to allow a 15-~oot setback from the rear lot line. Any deviafS.on ~om the variance given such as extensions, or demolitions which are not shown on the appllcant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any cuxrent or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis ~n nature for an alteration that does not increase the degree of nonconformity. Vote of the Board: Ayes: Members eltra (Vice Chairwoman), Dinizio, Simon, and Weisman. (Chairman Goebringer wa~Tabsent.) This Eesolutionwas duly adopted (4-0). Ruth D. Olios, Vice Chairwoman 10/~e~08 Approved for Filing 617.20 Appendix A State Environmental Quality Review FULL ENVIRONMENTAL ASSESSMENT FORM Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of a project that are subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important. Page 10 of 21 PART 2 - PROJECT IMPACTS AND THEIR MAGNITUDE Responsibility of Lead Agency General Information (Read Carefully) · ~n completing the form the reviewer should be guided by the question: Have my responses and determinations been reasonable? The reviewer is not expected to be an expert environmental analyst. · The Examples provided are to assist the reviewer by showing types of impacts and wherever possible the threshold of magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State and for most situations. But, for any specific project or site other examples and/or lower thresholds may be appropriate for a Potential Large Impact response, thus requiring evaluation in Part 3. · The impacts of each project, on each site, in each locality, will vary. Therefore, the examples are illustrative and have been offered as guidance. They do not constitute an exhaustive list of impacts and thresholds to answer each question. · The number of examples per question dues not indicate the importance of each question. · In identifying impacts, consider long term, short term and cumulative effects. Instructions (Read carefully) a. Answer each of the 20 questions in PART 2. Answer Yes if there will be any impact. b. Maybe answers should be considered as Yes answers. c. If answering Yes to a question then check the appropriate box(column 1 or 2)to indicate the potential size of the impact. If impact threshold equals or exceeds any example provided, check column 2. If impact will occur but threshold is lower than example, check column 1. d. Identifying that an Impact will be potentially large (column 2) does not mean that it is also necessarily significant. Any large impact must be evaluated in PART 3 to determine significance. Identifying an impact in column 2 simply asks that it be looked at further. e. If reviewer has doubt about size of the impact then consider the impact as potentially large and proceed to PART 3. f. If a potentially large impact checked in column 2 can be mitigated by change(s) in the project to a small to moderate impact, also check the Yes box in column 3. A No response indicates that such a reduction is not possible. This must be explained in Part 3. Impact on Land 1. Will the Proposed Action result in a physical change to the project site? £xamples that would apply to column 2 o Any construction on slopes of 15 Ye or greater, (15 foot rise per 100 foot of length), or where the general slopes in the project area exceed 10%.
