' UPON READING AND FILING the dedication and release of
GEORGE. H. KAELIN. dated April 7, 19~, and duly acknowledged,
dedicating and releasing the necessary lands for a certsin
proposed town highwey to be known as BAYVIEW AVENUE.
~ESOLVED: that conseht be and the same hereby is given that
theTown Superintendent of Highways of the Town of SouthOld,
make an ~rder laying out She aforesaid Town Highway to
of the lands described in the said dedication ahd release"end
to extend as delineated upon the map annexed to saidapplic-
ation~ all in accordance with the provisions of Section 171
of the Highway Law of the State of New York.

ORAL APPLICATION having been duly made to me '~heT~ewn
Superintendent of Highways for the Town of Southold~ Suffolk
CoUnty~ New York, for the la~ing out of a certain Town
Highway in the said Town of outhold by GEORGE H. KAELIN, lia5]
to be assessed for h~ghway taxes in said Town, and the written
consent of the Town card of Said Town having been given as pre
scribed by Law, and a dedication and release from damage~ herin
been executed~ acknowledged and delivered by the owner of the
lands through which the proposed highway is proposed to be laid
andnothing having been
out~ a copy of which is hereto annexed,
paid to any claimant for such damages,

NOW~ THEREFORE, I~ the Superintendent of H&ghways of the Town of

nat the ~own highway shall be, and the same is hereby laid out
in said'Town as follows and is to be known as BAYVIEW AVENUE
which shall be fifty feet in width: -

BEGINNING at a concrete monument set at the intersection of the
northwesterly line of Colony Road and the southwesterly line of
~v~ew Avenue, a~ it_now exists, and running thence North

to a pOint, running thence South 62 ~% O0 West 83.71 feet

land of J. Herbert Cassidy to a point on the northwesterly line
of Colony Road; andrunning thence South 76e 30 ' 30 "West 59.75
feet along the Northwesterly line of Colony Road to the concrete
monument at the point or place of beginning.

WHEREAS, application has been duly made to the Town
Superintendent of Highways of the Town of Southold, in the County
of Suffolk and S~ate of New York, for the laying out of a certain
i~wn highway to Be known es
~ BAYEIEW AVENUE, AND
~ WHEREAS, GEORGE H. KAELIN~ of Southold, Town of
S0uthold, Suffolk County, New York, is.the o~mer of the premises
i!~o be dedicated as hereinafter provided, and is the only person,
!firm or corporation having any interest in the lands through
~ich the highway is proposed to be opened.
NOW, THEREFORE, the said GEORGE H. KAELIN, in con-
~ide~ation of the sum of ONE ($1.O0) DOLLAR, to him in hand paid,
~YHAROLD PRICE, Town Superintendent of Highways of the Town of
S0uthold, the receipt whereof is hereby acknowledged, and in further
~nsideration of the laying oMt of a new highway at Arshamomoque,
the Town of Oouthold, Suffolk County, New York, to be known as
BAYVIEWAVENUE
~DOES HEREBY DEDICATE, RELEASE AND CONVEY TO THE SAID TOWN OF
S0U~HOLD, for highway pmrposes, th~ following lands, t~t:-
"BA'YVIEW AVENUE
ALL that tract or parcel of land~ situate, lying and being
at Arshamomoque, in the Town of ~outhold, County of Suffolk
and State of New York~ bounded and described as follows:
BEGINNING at a concrete monument set at the intersection
of the northwesterly line of Colony Road and the xouthwesterly
line of Bayview Avenue, as it now exists, and running thence
North ~6° 41' 30" We~t 670.82 feet along other land of George
H. Kaelin to a point, running thence South 62u ~5' 00" West
83.71 feet along other land of George H. Kaelin to a point;
running thence South 55° 27' ~O" West llO feet more or less
to the ordinary highwater mark of Arshamomoque Pond ( also
known as M~ll Creek ); thence in e northwesterly direction 50
feet more or less along the ordinary highwater mark of
Xrshamomoque Pond (also known as Mill ~reek) to land of
Valentine Ruch; running North 55° 27' ~0" East 130 feet more
or less along land of ~alentine Ruch to a point; running thence
North 620 $5' O0" East 12~.26 feet still along lan~ of, ,,
Valentine Ruch to a point, running thence South $6 ~l 30
East 738.91 along land if J. Herbert Cassidy to a point on
the northwesterly line ~f Cqlony Road; ~nd running thence
South 76 30' 30" West 59,75 feet along the northwesterly llne
of Colony Road to the concrete monument at the point or place
of beginning, said parcel ~f land being 50 £eet in width
throughout.
AND the ssid GEORGE H. KAELIN does hereby release said
Town from all damages by resson of the laying out of the
~said above described new highway.
IN WITNESS ~EREO~, the said GEORGE H. KAELIN has hereunto
set his hand and seal this 7th day of April , 1951.
