Dear Mr. Williamson:
The Southold Town Board of Trustees reviewed the plans prepared by Nigel Robert Williamson
Architect dated January 12, 2009 and determined the proposed replacement of the existing
stairs and decks with new decks and stairs of equal dimensions to be out of the Wetland
jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal
Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal
and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard
area as indicated above, or within 100' landward from the top of the bluff and/or wetlands
jurisdictional boundary, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to
ensure that all necessary best management practices are taken to prevent any sedimentation or
other alteration or disturbance to the ground sudace or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project.
This determination is not a determination from any other agency.

Re: Proposed decks & stairs replacement to Cleaves Point Condominiums at
2820 Shipyard Lane, East Marion, NY 11939
Dear Board Members:
We are replacing the existing decks which have become unsafe and the existing stairs
with new decks and stairs of equal dimensions. The replacement is for the safety of the
occupants and visitors. It is also to bring the structures into conformance with the present
code.
We are submitting the following documentation for a determination from the Board as to
jurisdiction.
1. Site development plan SD1 (Proposed Shipyard Lane Project) dated Nov. 20th,
1980 showing buildings 1 through 4.
2. Site Plan SD1 (Condominiums Cleaves Point Commons *1) dated Jan. 15th, 1982
showing buildings 5 & 6.
3. Drawings A-l, A-2, A-3, A-6, A-7, A-9, A-10, A-11, A-12 & A-13.
4. Photographs showing view A, B, C, D, E, F, G, H, J, K & L which are also
marked on the site development plan SD1 and site plan SD1.
