Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
October 15. 2008 in consideration of application fee in the sum of $250 00 paid by Henry & Diane Hobbs and

TERMS AND CONDITIONS
The Permittee, Henry & Diane Hobbs, residing at 800 Sterling Rd., Cutchogue, NY, as part of
the consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Pennittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be~ no unreasonable interference with navigation as a result of the wOrk
herein authoriZed.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that maY be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Mesiano:
The Board of Town Trustees took the following action dudng its regular meeting held on
Wed., October 15, 2008 regarding the above matter:
WHEREAS, Catherine Mesiano, Inc. on behalf of HENRY & DIANE HOBBS applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance, application dated September 22, 2008,
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 15, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees has found the application to be Consistent with
the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of HENRY & DIANE
HOBBS for the existing pervious brick patio, to construct a second-story addition to the
existing dwelling, and to expand the front porch, with the condition gutters and drywelts
are installed in accordance with Chapter 236- Stormwater Management of the Town
Code, and as depicted on the site plan prepared by MCH Designs dated October 20,
2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided
on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is
CONSISTENT with the LWRP.
The following BMP is recommended:
1) Installation of drywells to contain storm water runoff.

Dear Town Trustees:
We are the property owners of the separate two lots, 104-4-9 and 104-4-10,
located to the NE corner of the above referenced property. Lot #10 is land
directly next door to the above property, and the pond behind 800 Sterling Road
extends into it. Unfortunately we did not receive notice that this hearing was
taking place until October 10, when we saw a posting on a tree. We then
obtained the proposed survey plans from the Trustees office. Hence this letter is
being submitted very soon before the hearing date.
We feel we are in a very delicate and difficult situation, and the last thing in the
world we want to do is create any kind of misunderstanding or hard feelings with
our neighbors. We are not trying to stop anyone, let alone our next door
neighbors or anyone else from improving their property.
However, we are torn by this proposal. To offer some background, we
purchased the land the pond extends into about 9 years ago because we wanted
to do all we could to help preserve the pond, and help it from being overly
encroached on. We scrapped up every cent we could find to buy it. That was
right after we were married and Jennifer was going to quit her job and go to an
expensive graduate school. We almost went broke doing it but we wanted to
ensure that we could enjoy the pond, it view, and the birds and wildlife would
remain.
We have some concerns that ~n aggregate, we feel this proposal results in the
pond being excessively encroached upon, creating a negative impact on the
wetland area.
The survey shows that the existing home is set back 30-32 (varies) feet
from the road, and the house is 25 feet wide. Therefore the back of the
house is 67 feet from the road. Our home, even though it is on a smaller
lot, is located 71 feet back from the road. The house on our other side, to
the east of us, is less than 10 feet away from our property line, although it
is on a large lot. Hence, all our views face directly into the rear side of the
800 Sterling Lane.
The south, or rear of 800 Sterling is completely at grade level, a full two
stories. This application requests to make this building a full 3 stories high
in the rear, located only 30 feet away from the water edge.
There is a large masonry patio and concrete block retaining wall on the
rear side of the house that according to the plans is already only 15 feet
away from the water edge. It runs the entire length of the house and
approximately 20 additional feet past it, towards our property. We
understand this was not given Town Trustee approval when built. We also
understand that the new landscaping also required Town Trustee
approval, but did not receive it.
The concrete block retaining wall for the patio is 4.5 feet high in the back
of the house. The elevation change around the existing house is
approximately 6 feet. As the Town height requirements measure from the
midpoint of the footprint, this allows an 'additional' height of 3 feet on the
lower elevation, or for the back of the house.
Therefore, for a proposed 3 story building, if estimating 10 foot per story
and 5 foot for a roof line, adding the 3 foot 'additional' height in the back,
and then the 4.5 foot high retaining wall installed without Town Trustee
approval, amounts to us having no choice but to view what amounts
to a flat rise of almost 45 feet from the beginning of the constructed
home, which starts at only 15 feet away from the water edge we
share.
The front gutters are not connected to dry-wells to accept storm run off,
although they are approximately 50 feet away from the water edge and the
slope is directed towards the pond. We do not know the existence or
status of any existing dry wells in the back of the house, there are none
noted on any plan.
We do not know if the septic system, already under 100 feet away from
the pond, is approved or can accommodate more than doubling the size of
the living space.
As an adjacent property owner and a co-owner of the pond, due to the mentioned
points we are wondering if the pond is slowly but ever increasingly
being encroached on, and the proposal becomes just too much. This is what we
sought to minimize when we went spent all we had to purchase the land.
Writing this letter was the last thing we wanted to do. We don't want people to
think we are bad or mean neighbors, and by no means do we want to create any
type of hard feelings. But this is a permanent change that will closely impact the
pond and something that we will have to view forever, particularly in the
winter when there is no screening at all. We feel the pond is slowly and steadily
being encroached on and it's integrity breeched. We also feel this proposal will
also affect our investment and ourselves, and we feel we had to voice our
concerns, because this could be a lose-lose-lose from our perspective: the pond,
our investment we went broke on, and our enjoyment of our own property.
If this application is unfortunately approved, we ask that measures please be put
in place to ensure the impacts be mitigated as much as
possible, including reduction of mass, requirement of storm water and erosion
management, and screening from a 45 foot high wall. We also ask that light
management be required, as flood lights into the pond will disturb the wildlife and
will enter directly into our windows.
