December 7, 2009, and received on December 22, 2009.

Attached please find (2) copies ora revised site plan which show the repositioning of the
swimming pool enclosure fence. It is requested that the water side of the fence be located
on the flat section of land between the two existing bulkheads, extend up to the house
along the property line and then be returned into the house. Required gates and safety
features will be included. This change is requested to avoid blocking views of Peconic
Bay from the swimming pool area.
If this revision meets with your approval, please process for an amended administrative
permit. A check to the Town of Southold for $50 is included. Please contact me with any

Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of thc Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on

TERMS AND CONDITIONS
The Permittee Claire & Rob Riccio, residing at 6512 Indian Neck Lane, Peconic, New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released fi'om any and all
damages, or claims for damages, of Suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittea will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittec
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should cimumstancos warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittea wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the previsions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the fight of the public to pass and repass along the
beach between high and low wate~ marks.
That if furore operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Pennittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittec of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke up6n falhire tO obtain same.

Dear Ms. Moore:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 15, 2008 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq., on behalf of CLAIRE & ROB RICCIO applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated August 7, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: a line of staked hay bales and silt
fencing is installed prior to construction, the installation of gutters, leaders and drywells
to contain roof and pool runoff and in accordance with Chapter 236 of the Town Code-
Storm Water Runoff, American Beach Grass is planted in-between the two bulkheads,
and
WHEREAS, a Public Headng was held by the Town Trustees with respect to said
application on October 15, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of CLAIRE & ROB
RlCClO to demolish the existing dwelling and construct a new dwelling, swimming pool,

Boundary) at Indian Neck Road, Peconic Parcels CTM 1000-98-6-1, 86-7-3.1
SEQRA DETE~vIINATION: The Zorfing Boar(]. of Appeals has visited the property under
consideration m this application and determines that this review falls under the Type I1
category of the State's List of Actions, wi. thout further steps under SEQRA.
SUFF. OLK COUNTY ADMIN. JSTRATIVJ~ CODE: This application has been referred as
require& under the Suffolk County Administrative Code Sections A ].4-14 to 23, and the
Suffolk County Department of Planning reply dated March 11, 2008 states that the
application is considered a matter for local determination aa there appears to be no
sig:aifieant coun .ty-wide or inter-community impact.
PROPERTY FACTS/DESCRIPTION: The applicants' property consists of a total area of
26,180 square feet measured to a tie line 109.70 feet along the average high water mark of
.Little Peconlc Bay, 229.99 feet along the eastern boundary of the lot, 119.19 feet along the
northern boundary, and 235.58 feet at the western boundary as described and shown on
the32-1-2004 survey, amended 5-5-2008 by John C. Eh_lets, licensed land surveyor.
BASIS .OF APPLICATION: Zoning Code Sections 280-15 and 280-116B, based on the
B~filding Inspector's amended February 6, 2008 and amended June 1.7, 2008 Notices of
Disapproval concerning proposed new construction. The reasons stated in the disapproval of
the building permit application are: (1) the proposed new dwelling construction will be less
than 75 feet from the bulkhead, (2) the proposed swimming pool will be in a side yard instead
of a code-required rear yard; and (3) New York Town Law, Section 280-a to determine the
need, if any, for base improvements and clearance within the right-of-way easement g~.ving
access to this property from Indian Neek Lane.
FINDINGS .OF FACT
The Zoning Board of Appeals held a public hearing on this application on June 26, 2008, at
which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board

keeping the distance from their front yard to the pool at the maximum distance
possible.

May 25, 1972 and. is currently the legal access to this property. They do not propose to
change tlzis access.
2. Town Law ~267-b(3)Co)(2). The benefit sought by the applicants cannot be achieved by
some method, feasible for the applicants to pursue, other than an area v~riance because:
A: The new location of the budlding will decrease the existing non-conformity and is
dictated by the location of the septic and dxywell system which are located landward
of the house in an effort to reduce the environmental impact to the bay.
B: The location of the pool in the side yard keeps the structure away from the
bulkhead.
3. Town Law §26%b(3)(b)(3).~ The variance requested herein is not substantial. The setback

PROPERTY FACTS/DESCRIPTION: The applicants' property consists of a total area of
26,180 square feet measured to a tie Hne 109.70 feet along the average high water mark of
Little Peconic Bay, 229.99 fee~ along the eastern boundary of the lot, 119.19 feet along the
northern boundary, and 235.58 feet at the western boundary as described and shown on
tlie3~-l-2004 survey, amended 5-5-2008 by John C. Ehlers, licensed land surveyor.
BASIS .OF APPLICATION: Zoning Code Sections 280-15 and 280-116B, based on the
Building Inspector's amended February 6, 2008 and amended June 17, 2008 Notices of
Disapproval concerning proposed new construction. The reasons stated in the disapproval of
the building permit application are: (1) the proposed new dwelling construction will be less
than 75 feet from the bulkhead, (2) the proposed swimming pool will be in a side yard instead
of a code-required rear yard; and (3) New York Town Law, Section 280-a to determine the
need, if any, for base improvements and clearance within the right-of-way easement gj.ving
access to this property from Indian Neck Lane.

The Zoning Board of Appeals held a public hearing on this application on June 26, 2008, at
which t~.e written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board
finds the following facts to be true and relevant:

directly on a Town Street, and relates to base improvements and vebicle clearance over the

draining of water from the slope of the driveway. This is at the point of access
on the pub]Jo road of Indian Neck Lane. The Town is under a Federal mandate
to contain water ~ow into creeks, and open bodies of water (Bays and the LI
Sound).
~. The new location of the home will decrease the non-conformity, by increasing the
distance ~om the bulkhead.
a. The new location of the septic system and dry wells for roof runoff will be
located well landward of the house. This will reduce the environmental impact
of sewerage and rainwater into the open bay.
b. A proposed pump out drain pool w~Jl provide for discharge of pool water, wail
landward ~rom the bulkhead.
3. The setback at 50 feet from the bulkhead is more than double the existing setback
with more conformity.
~ASOMS FOR .BOA-RD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the follow~mg findings:

change this access.
2. Town Law ~267-b(3~(b)(2). The benefit sought by the applicants cannot be achieved by
some method, feasible ~or the applicants to pursue, other than an area variance because:
A: The new location of the building will decrease the existing non-oonformity and is
dictated by the location of the septic and drywell system which are located landward
of the house in an effort to reduce the environmental impact to the bay.

The property is off of Indian Neck Lane, facing Peconic Bay.
There are no bluffs. The waterfront properties along Indian Neck
Lane have low vegetated banks with both bulkheads and retaining
walls, many of these bulkheads were constructed of either wood or
cement in the 1940's. Mr. And Mrs. Riccio have a pending
application to demolish the existing house and reconstruct further
back from the water with a pool in the side yard. The plan was
reviewed and approved by the Zoning Board of Appeals.
Mr. And Mrs. Riccio purchased the property in 2004, the prior
owners had used the area behind the bulkhead as a dumping ground.
This area was full of beer cans, bottles and debris. Moreover,
the land behind the bulkead was covered with overgrown Japanese
Bamboo or Jungleweed (polygonum Cuspidatrum), a nonnative invasive
species which had strangled any naturally growing native vegetation.
In 2004 they hired Frank Cichanowicz of Briarcliff landscaping to
remove the jungleweed and clean up a dumpster full of garbage.
Briarcliff prepared the bank and planted the following native plants
which have survived to date:
juniper pfitzer compacta
fountain grass
nepeta, walkers low
bayberry,myrica
rosa rugosa
beachgrass
Most recently their landscaper, Plantings by the Sea, has been
maintaining these plants. The jungleweed must be removed constantly
or it chokes the native plants, your inspection was immediately
after the maintenance had been completed by Plantings by the Sea.
Both local landscapers who worked at this property rely on the
unambiguous language of the Wetland Code, the code does not require
a permit for the work done in 2004 and maintained till today.
275-4 Exceptions states:
(4) the ordinary and usual operations relative to residential
horticulture within Trustee's jurisdiction provided they are limited
to use of noninvasive native species of vegetation. Re-grading and
removal of trees are not considered such ordinary and usual
operations.
What both landscapers and the owner did was precisely what is
authorized, to remove by hand invasive jugleweed and plant
noninvasive native species, no permit is or was required.
I would ask you to consider the language in the code, recommend
that the violation be dismissed, and continue to process our permit.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is our recommendation that the proposed action is
INCONSISTENT with LWRP Policy Standard 6.3 and therefore is INCONSISTENT with the
LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands' under their jurisdiction
1. Comply wtth' Trustee regulattons' and recommendations as set forth in Trustee permit
conditions.
The distance from the natural protective feature, bluff(as defined in § 275-2) to the proposed
actions~ pool and related structures, deck and residence are 15', 20', 25' 5"~ and 30' 1'
respectively. The minimum setback requirements from the bluff line (as defined in § 275-2) is 100
feet for the proposed actions listed above pursuant to § 275-3. Please require that the applicant
amend the proposed actions to meet the above policy to the greatest extent practicable.
§ 275-2 Definitions; word usage.
BLUFF -- .4ny bank or cliff with a precipitous or steeply sloped face adjoining a beach or a body of
water. The waterward limit ora bluff is the landward limit of its waterward natural prolective. Where no
beach is present, the waterward limit of a bluff is mean low water. The landward feature limit is 25feet
landward of the receding edge or, in those cases where there is no discernible line of active erosion, 25
feet landward of the point of inflection on the top of the bluff The point of inflection is that point along
the top of the bluff where the trend of the land slope changes to begin its descent to the shoreline.
BLUFF LINE -- The landward limit of a bluff that is' 25feet landward of the receding edge or, in
those cases where there is no discernible line of active erosion, 25feet landward of the point of
inflection on the top of the bluff. The point of inflection is that point along the top of the bluff where the
trend of the land slope changes to begin its descent to the shoreline.
§ 275-3 Findings; purpose; jurisdiction; setbacl~
C. Jurisdiction: The following areas are subject to protection under Chapter 275 of the Code of
Southold. [Amended 10-11-2005 by L.L. No. 17-2005]
(1) Any freshwater wetland, tidal wetland, beach, bluff, dune, fiat, marsh, swamp, wet meadow, bog,

making its determination of consistency, the designated agency shall consider the consistency
recommendation of the L WRP Coordinator. The agency shall render a written determination of
consistency based on the CAF, the LWRP Coordinator recommendation and such other information as is
deemed necessary to its determination. No approval or decision shall be rendered for an action in the
coastal area without a determination of consistency. The designated agency will make the final
determination of consistency. The Zoning Board of Appeals is the designated agency, [or the
determination o[ consistency [or variance applications subject to this chapter. The Zoning Board of
Appeals shall consider the written consistenc~, recommendation of the 1[, I, FRP Coordinator in the event
and at the time it makes a decision to grant such a variance and shah impose appropriate conditions
on the variance to make the activit~ consistent with the objectives o[ this chapter.
If the Agency~ Board of Trustees makes a contrary determination of consistency, the Agency shall
elaborate in writing the basis for its disagreement with their recommendations Pursuant to
Chapter 268 Waterfront Consistency Review.
§ 268-5. Review of actions.
In the event the LI4/RP Coordinalor's recommendation is that the action is inconsistent with the
LIg'RP, and the agency makes a contrary determination of consistency, the agency shall
elaborate in writing the basis for its disagreement with the recommendation and state the
manner and extent to which the action is consistent with the L I~RP policy standards.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

over time. The proposed dwelling will promote and enhance marine resources
because the construction mitigates the existing conditions and is environmentally
friendly and all the regulatory agencies control the project to prevent degredation of

Nature and extent of action: The existing residence is located approximately 20 feet
from the bulkhead. The existing residence will be demolished and new residence
will be set back 50 feet from the bulkhead. The area is disturbed and the
reconstructed house is more consistent with the LWRP then the existing structures.
The property contains a bulkhead and timber retaining wall, therefore there is no
threat to the property.
