Any debris,or excess material from Construction of this project shall be completely removed from the adjacent area ' and removed to an approved upland area for disposal,No debris is permitted in tidal wetlands or protected buffer areas. 2. There shall-be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted j .3. GENERAL CONDITIONS General Condition 1: Facility Inspection by the bepartm.ent The permitted site or facility,including relevant records,is subject to inspection at reasonable hours and intervals by an authorized representative of the.Department of Environmental Conservation(the Department)to determine.whether the perrhittee is complying with this permit and the ECL.Such representative may order the work suspended pursuant to ECL 7'I-0301 and SADA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit,including all referenced maps,drawings and special conditions,must be available for inspection by the Department at all-times at the project site or facility. Failure to produce a,.copy of the permit upon request by a Department r'opresentaltive is a violation of thls permit- General Condition 2;, Relationship of this Permit to Other Department orciers and Determinations . Unless expressly provided for by the Department,issuance of this permit does not modify, supersede or rescind any order or determination previo6sly'issued by the Department or any of the terms,conditions or requirements contained in such order or determination. General Condition 3: Applications for Permit Renewals or Modifications The permittee must submit a separate written applicailon:to the Department for•renewal,'modificatiori or transfer of this- permit. Such application must include any forms or.supplemental'information:the Department requires. Any renewal, modification or transfer granted by the Department must be In writing. The permittee must submit a renewalapplication at least: a) 180 days before expiration,of permits for state.Pollutant Discharge Elimination System($PDES),Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management Facilities(SWMF);and b) 30 days before expiration of all other permit types. Submission of applications for permit renewal or modification are to be submitted to: NYSDITC Regional Permit Administrator,SUNY @ Stony 8iook, 50 Circle Read,Stony Brook,NY 11790-3409 General Condition 4: 'Permit Modifications,Suspensions and Revocations.by the Department 'The Department reserves the right to modify,suspend or revoke this permit in accordance with 6 NYCRR Part 621. The grounds for modification,suspenslon or revocation include: a) materially false or inaccurate statements in the permit application or supporting papers; b) failure by thapermittee to comply with any terms or conditions of the permit; c) exceeding the scop®of the•project as.described in the permit application; d) newlydiscovered material infgrnation ora material change in environmental conditions,relevant technology or applicable law or regulatlons since the issuance of the existing permit; e) , noncompliance with previously issued permit conditions,orders,of the commissioner,any provisions of the Environmental Conservation law or regulations of the Department related to the permitted activity. Any i'naterial dredged In the conduct of the work herein•permitted shat!-be 'removed evenly,without leaving large refuse piles,ridges across the bed of'a waterway or floodplain or deep holes that rnay have a tendency to cause damage to navigable channels•or to the banks of a waterway. 5. There shall be no unreasonable interference with navigation by the work herein authorized: 6. if upon the.expiration or revocation of this permit, the project hereby authorized has not-been completed, the applicant shall,without expense.to the State,and to such extent and in such time and manner as the Department of Environmental Conservation mayrequire,remove all oranypottion of the uncompleted struc ture•orfili and restore the site to its former condition. No claim shall lie made against the State of New York on account of any such removal or alteration. 7. If granted under 6NYCRR Part 608,the NYS Department of Environmental Conservation hereby certifies*that the subject project will not contravene effluent limitations or other..limitations or standards under Sections 307,302,303, 306 and 307 of the Clean Water Act of 1977(PL•95-217)provided that all of the conditions listed herein'are met. 8. That the said Board of Trustees and the Town of Southold are released from any and all damages,or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely,or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required,upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. Untbrtunately, my client did not become aware of the hearing until after its date and thcrelbre did not have a representative appear. Several months ago. at my client's request, I prepared a proposed Agreement setting forth the terms under which Breezy Shores would be willing to give its consent. To date, the applicant has neither executed that document nor made a counter proposal. To date, all discussions with this matter have been through a representative of the applicant. In order to address this issue mom directly and so as to avoid sulkjecting the applicant to any delay, I have recently written to Mr. Arslanyan directly. While Brcczy Shores wants to be a good neighbor and cooperate with Mr. Arslanyan in the installation of his dock, it must at the same time act prudently and protect its residents. I am hopeful that Mr. Arslanyan will appreciate the position of Breezy Shores and enter into an appropriate Agreement wilh the Cooperative. But you regularly approve "variances" from other regulated limits, most notably residential setbacks, and such variances are specifically allowed by the Town Code. Chapter 275 time and time again allows the Trustees significant leeway in applying the "as written" provisions of the Chapter. We're asking that you take advantage of that discretionary windfall in reviewing this application. The 6-foot width specified as the maximum for floats is entirely arbitrary. The code specifically allows 8-foot-wide floats on Fishers Island, under certain unstated circumstances. Wouldn't you agree that all arbitrarily determined limits should be treated as guidelines and subject to the granting of variances at the discretion of the Board? Sure, it would make your job harder, but that's why we pay you the big bucks. You have said time and again that every project is different, so please don't cling hard and fast to a "one role fits all" approach in this case. There is, within a few hundred feet of this proposed project, a float described in a Trustees' permit issued in 1995 as being 8 feet wide and 37.5 feet long. It's a "grandfather permit". I mention this not to imply that our project should be approved simply because the continued existence of a neighboring float of comparable size was approved, but to indicate that in the past the Trustees have indeed been willing to grant a variance from the rule in question, grandfathered or not. Forgetting any requirements or limitations imposed by Chapter 275 or the LWRP, what is it that is bad about this project, envirorm/entally.speaking? And what, exactly, would you think you're protecting in this case? And, most importantly, who, or what, would benefit from the denial of this application? Worded about establishing a precedent? The granting of this variance for this project, in this place, at this time will not of itself es,tablish a precedent, since you, the Trustees, have repeatedly stated that every project is different and must be approved or disapproved on its own merits: a different project, at a different place, at a different time. The Town Code burdens the Trustees with the job of attempting to strike a balance between, among other things, recreational use of the land and protection of the environment. If this application is denied, will you have achieved that goal in the present case? In this case the recreational use may be denied simply because, and only because, the Town Code says so. The granting of this permit would indeed stand out as a precedent for the thoughtful application of reason and common sense in a situation in which there was no environmental reason to deny it. And that's the proper use of discretion. The Trustees' job is to manage the relationship between use and protection, not to simply enforce roles written long ago and passed on down to ns simply because "it was always that way." What was the person thinking, I wonder, who first said, "Let's make it six feet." About the proposal itself... The seaward side of the most seaward float will be in water 5 to 6 feet deep at ordinary low tide, which water depth would itself reduce the amount of light reaching the bottom, bm on the other hand the increased height of the float above the bottom would minimize the effect of any created shadow. The proposed float size and configuration will provide necessary stability for the desired wheelchair access and the support of the weight of the wider ramp with its two handrails. The ADA requires that access must be provided in public places, so it doesn't seem reasonable that that access in a private place should be denied in the absence of some pretty significant reason. The project site is close to a heavily populated and used commercial marina within a man-made basin with very limited access to the open bay. And last, and probably least, the NYSDEC allows floats of up to 200 square feet...without a permit...in this location. And along those lines I ~hink it is apparent that tl~e dock configuration that we are describing, and which the two floats are eight-feet wide, would be significantly more stable than six-foot wide floats. The doctors that we were counting on to provide detailed medical reasons for doing this are gone in one way or another, so I have for you a letter to the Board from Mrs. Arslanyan. She says: My mother underwent total knee replacement surgery in 1993 for the left and 1994 for the right at Beth Israel North Hospital in New York City. Dr, John Insahl (sic) was her surgeon. A few years later Or. Insahl passed away aad the hospital was e'ventually demo!ished. Dr. Insahl's practice was taken over by one of his partners, Dr. Scidari (sic). I called Dr. Scidari's office and his office staff informed me that after seven years all records go into medical archives. They were not able to locate our old files on top of which, Dr. Sci0ari was not our operating surgeon and the hospital is no longer irt existence. My mother is 86-years old and walks with a walker at all tirnes. She loves the outdoors and in particular boating, which we want Iler to enjoy for the remainder of her years. We also have five grandcl~ildren, the youngest of which is three-years old. We are concerned about the safety of all of them from the youngest to the oldest. We thought a somewhat w;der dock would be more stable and could eiiminate the potential of any dangerous situations. We would be grateful a~3d appreciate il if you would grant permission to our request. In addition, one of our in-laws has also undergone total knee replacement surgery on both her left and right knees. We are blessed with a large and loving family and enjoy activ,ties all together and would hope she could continue to spend time with us enjoying the outdoors.
