HOLD the premises herein granted Unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part,in compliance with Section 13 of the Lien law, hereby covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to he applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

BEGINNING at a point which is distant the following two (2) courses
and distances measured along the northerly and easterly sides of a
certain Right of Way from the point of intersection of the
northerly side of said Right of Way and the southerly side of land
now or formerly of John Zuhoski with the westerly side of Oregon
Road:
1 . North 46 degrees 15 minutes 00 seconds West along land now or
formerly of John Zuhoski, 3398 . 72 feet;
2 . South 43 degrees 45 minutes 00 seconds West along land now or
formerly of John Zuhoski, Jr. and Lucille Zuhoski, 294 . 13 feet to
the point or place of beginning;
THENCE South 43 degrees 45 minutes 00 seconds West along last
mentioned land, 180 .44 feet to land now or formerly of Richard L.

THENCE North 44 degrees 11 minutes 00 seconds West along last
mentioned land, 566 . 15 feet to the average high water line of Long
Island Sound;
THENCE Northeasterly along the average high water line of Long
Island Sound along a tie line bearing of North 74 degrees 37
minutes 10 seconds East, 186 .44 feet to land now or formerly of
Daniel C. Shelley;
THENCE South 46 degrees 15 minutes 00 seconds East along last
mentioned land, 470 . 12 feet to the easterly side of a 25 foot right
of way at the point or place of BEGINNING.
SUBJECT to agreements in Liber 1174, page 537 and Liber 5187, page
289 .
SUBJECT to an existing 16 foot right of way along the southerly
portion of the within premises as said right of way is described in
a certain deed from Frederick Dettner and Mary L. Dettner, his
wife, etal, to Daniel C. Shelley and Katharine F. Shelley, his wife
dated November 17, 1954 recorded in the Suffolk County Clerk' s
Office at Liber 3799, page 577 on the 29th day of November, 1954,
and subject to the expansion of said 16 foot right of way to 25
feet in accordance with the conditions of minor subdivision
approval of the Town of Southold Planning Board dated September 19,
1983 , as said 25 foot right of way is depicted on a certain survey
of Young and Young, land surveyors, numbered 82-595, dated November
8, 1984 .
TOGETHER with and subject to a non-exclusive right of way in common
with others from the within premises to Oregon Road as said right
of way is depicted on a certain minor subdivision map prepared by
Young and Young, land surveyors under number 82-595 dated November
8, 1984, as said right of way is described in the aforesaid deed
from Dettner, etal, to Shelley dated November 17, 1954 .
SUBJECT to the rights of others, including the rights of the
grantor herein as owner of the premises depicted on the aforesaid
subdivision map prepared by Young and Young, designated as Lot No.
1 to utilize for pedestrian, automobile, vehicular and laying of
utility lines above and below ground the area designated as right
of way from Oregon Road to the easterly line of the premises
conveyed to the grantee hereunder, all as depicted on the aforesaid
minor subdivision map of Young and Young dated November 8, 1984 .
