WITNESSETH, that the party of the first part, in consideration of Ten Dollars and Other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, at Nassau Point, Cutchogue, Suffolk
County, in the State of New York, known and designated as Lot 16 on a
certain map entitled, "Map of Nassau Point Club Properties at Nassau
Point, Town of Southold, Suffolk County, New York, Amended Map A" and
filed in the Office of the Clerk of the County of Suffolk on August 16 ,
1922 as Map No. 156 ; said lot being bounded and described as follows:
BEGINNING at the corner formed by the intersection of the northerly
side of Old Menhaden Road and the easterly side of Nassau Point Road:
RUN14ING THENCE northerly along said easterly side of Nassau Point Road
along an undefined curve bearing to the left a distance of 150 . 00 Fret
(tie line bearing North 12 degrees 08 minutes 20 seconds West and tie
distance of 149 . 95 feet) to a monument and Lot No. 15;
THENCE North 78 degrees 36 minutes 50 seconds East along the division
line between Lot No. 15 and 16 on said map, 381 . 00 feet to the mean
high water mark of Peconic Bay, as on 11/11/97 ;
THENCE southerly along said mean high water mark of Peconic Bay on a tie
line bearing South 12 degrees 21 minutes 46 seconds East, a tie
distance of 99 . 97 feet to the northerly side of Old Menhaden Road;
THENCE westerly along said northerly side of Old Menhaden Road along
undefined curves bearing first to the left and then to the right, a
tie line of which bears South 71 degrees 08 minutes 10 seconds West, a
tie distance of 384 . 00 feet to the corner at the point or .place of.
BEGINNING.
BEING AND INTENDED TO BE THE SAME PREMISES conveyed to the party of
the first part by deed filed December 21 , 1995 and recorded in the
Office of the Clerk of Suffolk County on February 8 , 1996 in Liber 11761
of Deeds at page 742 .
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the
TAX MAP second part forever. -
nESIGNATION
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
[ilk, as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
