WffNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration
paid by the party of thesecond part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the town of Cutchogue , in the town of Southold, County
Of Suffolk and State of New York, more particularly bounded and
described as follows :
BEGINNING at a point on the center line of a 20 foot wide right of
way (known as "Briarwood Lane"); where the same is intersected by
the easterly side of land now or foremerly of Joseph L. Hassan and
Patricia Hassan; said point or place of beginning being also
distant 421 . 35 feet easterly as measured along the center line of
a 20 foot wide right of way (known as "Briarwood Lane" ) from the
intersection of the easterly side of Harbor Lane with the center
line of a 20 foot wide right of way (known as "Briarwood Lane") ;
Running thence from said point or place of beginning along the
Easterly side of land now or formerly of Joseph L. Hassan and
Patricia Hassan North 16 degrees, 24 minutes, 30 seconds west 79 . 14
feet to land now or formerly of Marvel Almeda;
Thence along said last mentioned land north 73 degrees , 35 minutes ,
30 seconds East 187 .85 feet to the mean high water mark of East
J!� Creek (Eugene 's Creek) ;
Thence along the mean high water mark of East Creek (Eugene ' s
Creek) along a tie line south 02 degrees , 07 minutes , 42 seconds
East 81 . 59 feet to the Center line of a 20 foot wide right of
way (known as "Briarwood Lane") ;
And thence along the center line of said right of way (known as
"Briarwood Lane") South 73 degrees , 34 minutes, 00 seconds West
167. 73 feet to the point or place of BEGINNING.
Being and intended to be the same premises as delivered to the
party of the first part in deed dated March 12, 1989 recorded
March 21, 1989 in Liber 10820, Page 25 .
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second hart forever.
AND the party of the urst part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the
same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
