HomeMy WebLinkAboutL 11872 P 880 BLOCK LOT "2 3 EXECUTOR'S DEED THIS INDENTURE, made this 26th day of December, nineteen hundred and ninety-seven BETWEEN MOLLIE DRISCOLL Post Office Box 362 , 1300 North Oakwood Road Laurel, New York 11948 as executrix of the :Last will and testament of JACK EDWARD DRISCOLL, late of North Oakwood Road, Laurel, New York who died on the 12th of January, nineteen hundred and ninety-two, GRANTOR, and MOLLIE DRISCOLL, and DIANE ESTEP Post Office Box 302 , 1300 North Oakwood Road Laurel, New York 11948 GRANTEES, WITNESSETH, that the Grantor, to whom Letters Testamentary were issued by the Surrogate ' s Court, Suffolk County, New York, on April 6 , 1992 and by virtue of the power and authority given in and by said last will and testament and/or by Article 11 of the Estates, Powers and Trust Law, and in consideration of TEN AND 00/100 ( $10 . 00) DOLLARS paid by Grantees does hereby grant and release unto MOLLIE DRISCOLL an estate for the term of her life and unto DIANE ESTEP the remainder interest in fee simple and to her distributees or successors and assigns forever, ALL that certain plot , piece or parcel of land , with the buildings and improvements thereon erected, situate, lying and being at Laurel, Town of Southold, County of Suffolk and State of New York, being the westerly part of Lot No. 47 on a certain map entitled, "Map of Laurel Park, Property of Ravatone Realty Corporation, Laurel, L. I . , N.Y. , made by Daniel R. Young, P.E. and L. S . , New York State License No. 1404 " , and filed in the Office of the Clerk of the County of Suffolk on October 5 , 1925 as Map No. 212 , more particularly bounded and described as fol:lows :- BEGINNING at a point on the easterly side of North Oakwood Road where the same is intersected by the division line between Lots 47 and 48 on said map; running thence along said division line North 69' 08 ' 20" East 160 feet; running thence South 20° 51 ' 40" East 79 . 97 feet to the northerly side of North Oakwood Road; running thence along the northerly side of North Oakwood Road, South 69* 08 ' 20" West 122 .08 feet to the easterly end of a curve connecting the northerly side of North Oakwood Road with the easterly side of North Oakwood Road; running thence northwesterly along the arc of said curve bearing to the right having a radius of 38.97 feet a distance along said curve of 62.23 feet to the w easterly side of North Oakwood Road; thence along the easterly side of North Oakwood Road North 190 22 ' 10" West 40 feet to the point or place of beginning. TOGETHER with all the right, title and interest of the Grantor, in and to North Oakwood Road adjacent to said premises to the center line thereof. SUBJECT to the rights of other lot owners on said map to pass over and use the said road. SUBJECT to the reservations of record permitting the use of the streets, avenues or roads shown on said map for the purpose of laying and maintaining gas , electric light and water mains ; stringing electric light, telegraph and telephone wires; placing of poles for the stringing of wires, or to make any improvements on said streets, avenues or roads. SUBJECT also to the following restrictions of record which shall apply to and affect only the plot herein conveyed: No part of any lot, and no dwelling to be erected on said lot, shall be used for manufacturing, trade or business purposes whatsoever; and nothing which shall be a nuisance, unwholesome or offensive to the neighborhood shall be permitted on said lot. The second parties shall have the right in common with others to pass over and upon a strip of land along the shore beyond lots 1 to 4 both inclusive on the aforesaid map, for the purpose of boating, bathing and outdoor sports, and for ingress to and egress from the waters of Peconic Bay. TOGETHER with all right, title and interest, if any, of the Grantor in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the Grantor in and to said premises, TO HAVE AND TO HOLD the premises herein granted unto the Grantor, the heirs or successors and assigns of Diane Estep forever. AND the Grantor covenants that the Grantor has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid.
