joHN M. SCOPAZ, as TRUSTEE of the JOHN M. SCOPAZ QUAUFIED PERSONAL RF~IDENCE
TRUST dated July 8, 2002, as tenant in common, and
LINDA N. SCOPAZ, as TRUSTEE of the UNDA N. SCOPAZ QUAIAFIED PERSONAL
RESIDENCE TRUST dated July 8, 2002, as tenant in common,
both having an address at 204 Corlies Avenue, Pelham, New York 10~03, parties of the second pm,
REFERENCE IS MADE to the following deeds:
(a) ~ dated and delivered July 8, 2002 from JOHN M. SCOPAZ, as grantor, to JOHN M. SCOPAZ
as Trustee ut' tho JOHN M. SCOPAZ PERSONAL RESIDENCE TRUST, grantee; and
(b) Deed dated and delivered July 8. 2002 from LINDA N. SCOPAZ. as grantor, to LINDA N.
SCOPAZ. as Trustee of the LINDA N. SCOPAZ PERSONAL RESIDENCE TRUST, granten,
which deeds ere imended to bo recorded immediately priur hereto (hereinafter collectively ruferred to B tho
'Prior Deeds").
WHEREAS:
(a) it was the intent of the grantors under the Prior Deeds to terminate their tenancy in the entirety in
the property referenced therein, and to c(mvey and create a tenancy in common in said propany in
the respective grantees thereunder and hereunder.
(b) the party of the first part and the parties of the second party desire to clarify, confirm and reiterate
the intent and efi'ecl of the Prior Deeds: and
(c) this is a Confirmatory Deed. given solely tu clarify, confirm and reiterate that the Prior Deeds
terminated the party of the first part's tenancy in the eatiraty in said property and conveyed to each
of the parties of the s~'ond pan therein and herein an undivided one-half 0/2) interest in said
property as tenants in comn~m.
NOW THEREFORE
WITNESSETH, that the party of the first pan in consideration ofTen Ek~llers (SI0.00) and other valuable
consideration paid by the panie.q of the second pan. does hereby grant and release unto the parties of the
second part, the heirs or successors and assigns of the parties nf the second part forever, as follows:
(a) undivi~led one-half (1~) int.'est, in the properly d~cribed herein to JOHN M. SCOPAZ as
TRUSTEE of the JOHN M. SCOPAZ QUALIFIED PERSONAL RESIDENCE TRUST dated July
8, 2002, as tenant in common: and
(b) undivid~ one-half (I/2) interest in the property described herein to LINDA N. SCOPAZ, as
TRUSTEE of the LINDA N. SCOPAZ QUALIFIED PERSONAL RESIDENCE TRUST dated July
8, 2002. as tenant in commun.
in the following property:
ALL that certain plot. piece or percd of land. with the buildings and improvements thereon erected, situate,
lying and being at Peconic, in the Town of Suuthold. County of Suffulk. and State of New York, bounded
and as de.~ribed on SCIIEDULE A attached hereto.
BEING AND INTENDED TO BE the same premises conveyed by deed dated July 2, 1996 and recorded
July 24, 1996 in Liber 11784, page 78, and the Prior Deeds. which are intended to be recorded immediately
prior hereto. To the extent of any discrepancies in the propany d~4cription between the Prior Deeds and
this Confirmatory Deed. this d~ed shall govern.
ALSO BEING comn~)nly km~wn as 6300 Indian Neck Lane. Peconic. New York 11958-1715
TOGETHER with 'all right, title and inter~-4t, if any, of the party of the first part in and to any streets and
roads abutting the ai~)ve described p ,remises to the center lines thereuf: TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the panies of the second part. the heirs or suecessors and assigns of
the parties of the second part fi)rever.
AND the party of thc first pan covenant.~ that the party of the first part has not done or suffered anything
wharehy the said premise.~ have been encumbered in any way whalever, except as aforesaid.
AND the party ,~t' the ti~t part, in cmnplianee with Section 13 of the Lien Law, covenants that the party of
the first part will receive the ,'onsJderation fi~r this ¢onveyunee and will hold the right to receive such
consideration as a trust fund t,, be applied first for the purlx~se of paying the cost of the improvement and

BEGINNING at a point on the southerly side of Indian Neck Road, said point of
beginning being a distance of 859.06 feet easterly along the southerly side of Indian
Neck Road from the eastedy side of Robinson Road;
RUNNING THENCE the following two courses and distances along the southerly side of
Indian Neck Road:
1. North 75 degrees 22 minutes 20 seconds East 62.23 feet to a point;
2. North 78 degrees 09 minutes 50 seconds East 24.83 feet to land now or formerly of
Edwald;
RUNNING THENCE along said land now or formerly of Ewald; South 24 degrees 47
minutes 30 seconds East 1,257.93 feet to a point on the ordinary high water mark of
Peconic Bay;
RUNNING THENCE along the ordinary high water mark of Peconic Bay on a tie line
course and distance of South 61 degrees 35 minutes 40 seconds West 87.50 feet to a
point on the easterly line of land now or formerly of Rust;
RUNNING THENCE along said land now or formerly of Rust, North 24 degrees 42
minutes 20 seconds West 1,280 feet to a point on the southerly side of Indian Neck
Road, the point or place of BEGINNING.
