Sauer, Jr., deceased 7/6/00, Suffolk County Probate #t601P2000, Letters Testamentary issued by Suffolk County Surrogate's Court on 8/22/00, residing at 55 Dorchester Road, Smithtown, New York 11788,party of the first part, and CAROL ANN SAUER, residing at 55 Dorchester Road, Smithtown, New York 11788, as to an undivided 51.01% interest; G/l~~n'ce_~ R~BERT SAUER, residing at '~" °"~'~" ' --- Franklin, MA 02038, as to an undivided 9.17% interest; DONALD SAUER, residing at 71 Summit Drive, Smithtown, New York 11787, as to an undivided 9.17% interest; and STEVEN SAUER, residing at 55 Dorchester Road, Smithtown, New York 11787, as to an undivided 9.17% interest; all as Tenants in Common, party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten and 00/100-($10.00)-dollars, and other good and valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a monument on the southerly side of Wigwam Way at the northeasterly corner of the premises hereinafter described, said point of beginning being the northwesterly corner of land of Laughing Waters Property Owners Association; RUNNING THENCE South 10 degrees 41 minutes 00 seconds East, 1225 feet to the ordinary high water mark of Peconic Bay of 1978 THENCE along said high water mark of 1978 to the southwesterly corner of the premises herein described, said course being subtended by a chord bearing North 89 degrees 19 minutes 10 seconds West, 141.16 feet; THENCE along parallel to the division line between the premises herein described and Laughing Waters Property Owners Association on a bearing, North 10 degrees 41 minutes 00 seconds West 1200.00 feet, more or less to the southerly side of Wigwam Way; THENCE along the southerly side of Wigwam Way North 76 degrees 27 minutes 00 seconds East 10.5 feet to a monument; THENCE still along the southerly side of Wigwam Way, North 80 degrees 40 minutes 00 seconds East 127.95 feet to a monument and the point or place of BEGINNING. Being and intended to be the same premises conveyed to the party of the first part by deed dated September 28, 2001 and intended to be recorded in the Suffolk County Clerk's Office. This deed is to convey the 78.52% undivided int~[,gs,,t of the decedent, Ernest L. Sauer, in the property. As a result of this conveyance, the ownet ~¥t~e property is as follows: Carol Ann Sauer to an undivided 51.01% interest, Robert Sauer as to an undivided 16.33% interest, Donald Sauer as to an undivided 16.33% interest and Steven Sauer as to an undivided 16.33% interest. TOGETHER with ail right, title and interest, if any, of the party of the first part in and to any streets and reads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so requires.
