CAROL ANN SAUER, residing at 55 Dorchester Road, Smithtown, New York 11788 and
DONALD SAUER, residing at 71 Summit Drive, Smithtown, New York 11787 as Trustees under the
Last Will and Testament of Ernest L. Sauer, Jr.,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100-($10.00)-dollars, and other
good and valuable considerati(~)n paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
an undivided one-half interest in
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk and State of New York, bounded
and described as follows:
BEGINNING at a monument on the southerly side of Wigwam Way at the division line between the premises
hereinafter described and land shown on a map entitled, "Nunnekoma Waters", file number 5126;
RUNNING THENCE along the southerly side of Wigwam Way North 76 degrees 27 minutes 00 seconds East
138 feet;
THENCE parallel to the division line between the premises herein described and the Nunnekoma property
South 10 degrees 41 minutes 00 seconds East 1177.5 feet more or less to the ordinary high water mark of
Peconic Bay;
THENCE along said highwater mark, North 82 degrees 28 minutes 00 seconds West a tie line distance of
145.395 feet more or less, to the land shown on the map entitled, "Nunnekoma Waters";
THENCE along said land North 10 degrees 41 minutes 00 seconds West 1130.0 feet to a monument on the
southerly side of Wigwam Way and the point or place of BEGINNING.
TOGETHER with any accretions thereto,

BEING AND INTENDED TO BE/the premises conveyed ~y Philip ~ar~linale to Ernest L. Sauer and Carolann
C. Sauer, his wife by deed dated 8/9/84 and, recorded in Liber 9632 page 326.
This deed will also confirm and ratify deed dated 12/17/99 made by Ernest L. Sauer and Carolann C.
Sauer, his wife to Ernest L. Sauer and Carol Ann Sauer, as Tenants in Common, recorded in Liber
12056 page 542.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
)remises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the ~ame
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
