THIS INDENTURE, made this [ I''~ day of July, 2006 BETWEEN DAVID E. JOHNSON, residing at 4048 Lake Shore Avenue, Oakland, CA 94610; and ROBERT E. JOHNSON, residing ut 374 Sackville Street, Toronto, Ontario, Cnnuda M4XISS, ns sole heirs-at-law of EILEEN M. JOHNSON, decensed March 5, 2006, who is the surviving tenant by the entirety with ROBERT E. JOHNSON, deceased February 20, 1995, party of the first part. and DAVID E. JOHNSON, residing ut 4048 Lake Shore Avenue, Oakland, CA 94610; and ROBERT E. JOHNSON, residing at 374 Sackville Street, Toronto, Ontario, Canada M4XISS, each ns to an undivided one-half (1/2) interest as tenants-in-common. party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land. with the buildings and improvements thereon erecLed, situate, lying and being in the SEE SCHEDULE UA" ANNEXED HERETO. BEING AND INTENDED TO BE the same premises conveyed to ROBERT E. JOHNSON and EILEEN M. JOHNSON, ns husband and wife, dated July 29, 1966, recorded in the Suffolk County Clerk's Office on August 5, 1966, in Liber 6006, Page 545. TOGETHER with all right, title and interest, if any, oftbe party of the first part in and to any su'eets and roads abuuing the above de.~cribed premises to the center lines thereof; TOGETHER with the appurtenances, and also all the eslate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of thc second part, the heirs or successors and assigns of thc party of the second pan forever. ANl) the party of thc first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first pan, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of improvement before using any part of the total of the same for any other purpose. Thc word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires. SCHEDULE A ALL THAT CERTAIN plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Bayview, in the Town of Southold, County of Suffolk and Stare of New York, bounded and described as follows: BEGINNING at an iron pipe set at the northeasterly comer of the premises herein conveyed and being in the northwesterly coroer of the premises conveyed or about to be conveyed to Helen K. Goldin and which point of beginning is distant from thc northwesterly comer of the premises of Richard J. Hasey and wife the following two courses: (I) South 6g degrees 23 minutes East 76.62 feet; (2) South 53 degrees 49 minutes East 110.06 feet; thence running trom said poim of beginning along said land conveyed or about to be conveyed to Helen K. Goldin South 25 degrees 00 minutes 30 seconds West 99.02 feet to a stake and the ordinary high water mark of ¢orey Creek; thence northwesterly along said high water mark of Corey Creek 75 feet, more or less, to a stake which is North 69 degrees 08 minutes West 75.0 feet from the last described point; thence along olher land or Gertrude K. Bunce, Helen K. Goldin, Alexander W. Koke and Frederick C. Koke 2 courses as follows: (I) North 24 degrees 58 minutes East I00.0 feet to an iron pipe; thence (2) South 68 degrees 23 minutes East 75.0 feet to the point or place of BEGINNING. TOGETHER WITH a right of way 30.0 feet in width, the northwesterly line ot' which is described as follows: BEGINNING at a point on the southwesterly line of Main Bayview Road 30.0 feet northwesterly along said southwesterly line fi'om a concrete monument set on said line at the northwesterly coruer of land heretofore conveyed by Gertrude K. Bunce, Helen K. Goldin, Alexander W. Kokc and Frederick C. Koke to Sophie Anderson; ranning thence South 25 degrees 56 minutes 50 seconds West 695.22 feet; thence South 37 degrees 04 minutes 50 seconds West 199.70 feet to the ordinary high water mark of Corey Creek as of September 15, 1951. The southeasterly linc of said 30.0 foot right of way is parallel with and 30.0 feet southeasterly from the above dcseribed northwesterly line, measured at right angles thereto. ALSO, TOGETHER WITH a right of way 30 feet, more or less, in width, running from the northwesterly comer of the premises herein described and leading into the 30.0 lbOl right of way herein first described leading to North Bayview Road and to Corcy Creek.
