THIS INDENTURE, made the day of-J-ammO, 2002,
between LAUGHING WATERS PROPERTY OWNERS AssoCIATION~ c/o Frank J. Gumper, President,
residing at 20 Deerfield Road, Port Washington, New York 11050,
party of the first part, and DUANE J. PASCALE, residing at 3520 Minnehaha Boulevard, Southold, New York
11971,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of TWO THOUSAND TWO HUNDRED
FIFTY AND 00/100 ($2,250.00) DOLLARS, lawful money of the United States, paid by the party of the second
part, does hereby remise, release and quitclaim unto the party of the second part, the heirs or.successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Laughing Waters, Town of Southold, County of Suffolk and State of New York, being
known as Owaissa Avenue, bounded and described as follows:
BEGINNING at a point on the northerly side of Minnehaha Boulevard, where the same is intersected by the
southerly line of land now or formerly of Paseale;
RUNNING THENCE along land now or formerly of Paseale, North 34 degrees 08 minutes 00 seconds East,
100.04 feet to the highwater mark of Corey Creek;
THENCE along the highwater mark of Corey Creek, South 31 degrees 42 minutes 30 seconds East, 10.96 feet to a
point;
THENCE South 34 degrees 08 minutes 00 seconds West, 94.58 feet to the northerly side of Minnehaha
Boulevard;
THENCE along the northerly side of Minnehaha Boulevard, North 61 degrees 23 minutes 00 seconds West, 10.05
feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the Grantor by Deed made by Cedric H.
Wicldaam and Claretta S. Wickham, recorded April 18, 1961 in Liber 4974 page 293 (contains premises and
more).
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO H.4 VE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second pan forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first pan will receive the consideration for this conveyance and will hold the fight to receive such
consideration as a trust fund to be applied first for the purpose of paying the costs of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the same
for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.
