THIS INDENTURE, made the "~Oday of July, 2006,
BETWEEN Kathleen Fagan, rasiding at 14'; Borland Hill Road, Nobleboro, Mains 04559, as to her 33 113
percent Interest,
party of the first part, and
Thomas McCardck, residing at 80 Roxen Road, Rockville Centre, New York 11570,
party of the second part,
WITNESSETH, that the party of the first part, In consideration of ten dollars and other valuable consideration paid by the
party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements ther~on'e'r~cted, situate, lying
and being at Southoid, Town of Southold, County of Suffolk and State of New York, hounded and described as
follows:
BEGINNING at a point on the northeasterly side of Osseo Avenue where the southeasterly corner of land of
DePhillips intersects said northeasterly [ice of Osseo Avenue, said point being distant 42.06 feet from the comer
formed by the intersection of the southerly side of Owaissa Avenue and the easterly side of Osseo Avenue;
RUNNING THENCE along said land of DePhillips, north 49 degrees 54 minutes 10 seconds east, 1:18.71 feet to
land of Nelson;
THENCE along said land of Nelson and along land of Boedecker and land of Birch, south 47 degrees 12 minutes 40
seconds east, 99.43 feet;
THENCE along land of Birch, south 60 degrees 55 minutes 40 seconds west, 129.30 feet to the northeasterly side
of Osseo Avenue;
THENCE along the northeasterly side of Osseo Avenue, the following two courses and distances:
1. north 28 degrees 41 minutes 00 seconds west, 33.20 feet;
2. north 54 degrees 34 minutes 00 seconds west, 42.75 feet to the point or place of BEGINNING.
The above premises are known as and by the street address: 295 Osseo Avenue, Southold, NY 11971.
BEING AND INTENDED to be the grantor's Interest in that portion of the promises conveyed to her by deed
dated December 5, 1997, recorded in the Office of the Suffolk County Clerk on November 24, 1998 at Liber 11930,

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the
above described premises to the center lines thereof; TOGETHER with the appurtenances and all.the estate and rights
of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered In any way whatever, except as aforesaid.
AN D the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement and will apply the same first to the paymenl of the
cost of the improvement before using any part of the total of the same for any other purpose. The word party shall be
construed as if it read parties whenever the sense of this indenture so requires.
