party of the first part, and
Marion Toan Jones, residing at 369 Spring Avenue, Ridgewood, New Jersey 07450, Trustee of the Marion Toan
Jones Revocable Trust Dated October 20, 2008,
party of the second part,
WITNESSETH, that the party of the first pert, in consideration of ten and 00/100 dollars, lawful money of the
United States, and other consideration paid by the party of the second part, does hereby grant and release unto
the part of the second part, the heirs or successors and assigns of the perty of the second part forever,
ALL that certain plot, piece or parcel of land. with the buildings and improvements thereon erected,
situate, lying and being at Arshamomoque, in the Township of Southold, Suffolk County, New York, bounded and
described as follows:
BEGINNING at a pike set on a southwesterly line of twenty-five (25) foot pdvate road over land of Helen
R. Ruch and anD. At a point about four hundred twenty (420) feet southeasterly along said line from the
southerly line of North Road and one hundred (100) feet northwesterly along said line from the northerly
corner of land now or formerly of Mary Greenleaf and other: running from said point of beginning along
land of Helen R. Ruch and anD. South 34 degrees 45 minutes West two hundred twenty-five (225) feet,
more or less, to ordinary high water mark of Arshamomoque Bay; thence northwesterly along said
ordinary high water mark of Arshamomoque Bay one hundred (100) feet, more or less, to land of Helen
R. Ruch and anD.; thence along said land of Helen R. Ruch and anD and parallel to the first course and
distant one hundred (100) feet therefrom North 34 degrees 45 minutes East two hundred twenty-five
(225) feet, more or less, to a pipe set on the southwesterly line of said twenty-five (25) private road;
thence along the southwesterly line of said twenty-five (25) foot private road South 46 degrees 09
minutes East one hundred (100) feet to the point of BEGINNING.
TOGETHER with all right, title and interest, if any, of the party of the first pert in and to the lands under the waters
of the Arshamomoque Bay adjoining said premises.
ALSO, with a right of way over said twenty-five (25) foot private road from North Road southeasterly to the
soptheastarly corner of the premises herein described·
TOGETHER with a right of way over said twenty-five (25) feet in width, as now laid out over lands of Helen R.
Ruch and anD. leading from the Kings Highway or North Road to the waters of Long Island Sound.
Being and intended to be the same premises as conveyed by Marion Toan Jones, as Trustee of Agreement dated
January 2. 1994 Between Ethel G. Toan as Grantor and Marion Toan Jones as Trustee, to Marion Toan Jones,
by deed dated May 2, 1999, filed in the Suffolk County Clerk's Office on July 8, 1999, in Liber 11974, Page 292.
Subject to any right-of-ways, easements and/or ownership which may have been granted to utility companies.
TOGETHER with a Right of Way. 25' in width, in common with others adjoining said premises to the nearest
public highway;
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors
and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid·
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trusl fund to be applied first for the p~Jrpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of [he total of the same for any other purpose.
The ward 'party" shall be construed as if to read 'parties" whenever the sense of this indenture so requires.
