THIS INDENTURE, made the 1 st day of December, Two Thousand Eight
BETWEEN,
DEBORAH D. SUTHERLAND and CHARLENE D. MOTT, whose address is 42205 Route 48,
Southold, New York 11971, as Co-Executors of the last will and testament of JAMES C. MOTT, who
died on the 4th day of March, Two Thousand Seven, the party of the first part, and
DEBORAHI~SUTHERLAND, residing at 42205 Route 48, Southold, New York 11971, CHARLENE
D. MOTT, residing at 42205 Route 48, Southold, New York 11971, and KATHIE A. IENUSO, residing
at 96 Meyers Road, Neversink, New York 12765, party of the second part,
WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the
Surrogate's Court, Suffolk County, New York, on May 24, 2007 (File No. 876P2007) and by virtue of
the power and authority given in and by said last will and testament and/or by Article 11 of the Estates,
Powers and Trusts Law, and in consideration of THREE HUNDRED TEN THOUSAND ($310,000.00)
DOLLARS, paid by the party of the second part, does hereby grant and release unto the party of the
second part, the distributees or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land with the buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk and State of New York, being more
particularly bounded and described as follows:
BEGINNING at a point on the northwesterly side of Middle Road (C.R. 48) distant 680.55 feet
northeasterly from the extreme southeasterly end of a straight line connecting the easterly side of Kenney
Road with northwesterly side of Middle Road (C.R. 48);
RUNNING THENCE North 41 degrees 08 minutes 20 seconds West along land now or formerly of
Suffolk County Water authority a distance of 224.96 feet to land now or formerly of Venetis;
THENCE the following 2 courses and distances along last mentioned lands:
1. North 60 degrees 46 minutes 40 seconds East 140.00 feet;
2. South 41 degrees 08 minutes 20 seconds East, 229.63 feet to the northwesterly side of Middle
Road (C.R. 48);
THENCE southwesterly along the northwesterly side of Middle Road (C.R. 48) along an arc of a curve
bearing to the left having a radius of 2116.68 feet a distance of 140.03 feet to the point or place of
Beginning.
BEING AND INTENDED TO BE the same premises conveyed to James Mott by deed dated 8/21/54,
and recorded 8/23/54, in the Office of the Suffolk County Clerk in Liber 3745, Page 406.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center line thereof,
TOGETHER with the appurtenances, and also the estate which the said decedent had at the time of
decedent's death in said premises, and also the estate therein, which the party of the first part has or has
the power to convey or dispose of, whether individually, or by virtue of said will or othe~wvise,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
distributees or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of improvement and
will apply same first to the payment of the cost of improvement before using any part of the total of the
same for any other purpose.
The word "party" shall be construed as if it reads "parties" whenever the sense of this indenture so
requires.
