Present Were: Absent Were: Don Wilder, Chairman Jack McGreevy, Member Peter Young, Member Doug Hardy, Member Lauren Standish, Secretary Dave Bergen, Trustee James Eckert, Member Anne Trimble, Member Scott Worth, Student Member CALL TO ORDER Chairman Don Wilder called the meeting to order at 4:30 PM. REPORTS Member Jack McGreevy distributed copies of a memo he sent to the Town Board regarding stewardship and land preservation. There was a group discussion regarding road run-off and the idea of removing road ends and creating a pervious area to allow run-off to leach into the ground. Trustee Dave Bergen commented that the stormwater run-off committee hasn't met in months, however requests have been made to get the committee activated again. Member Doug Hardy shared a letter he received from Lisa Richardson regarding sea-level rise. There will be a series of meetings, with the first being held on January 29, 2009 at Bmokhaven National Lab from 4:00 - 7:00 PM. Jack McGreevy suggested Doug attend the meeting on behalf of the CAC. Chairman Don Wilder distributed a draft letter he would like to submit to the Town Board concerning docks on the bay. It was the opinion of several of the members that the moratorium should be permanent. Member Peter Young thought that the criteria presented by Mark Terry should be applied, rather than all together banning docks on the bay. Don stated that the memo relates to the ban of private docks only, because docks damage the bay. Member Jack McGreevy commented that the applications for properties on Fishers Island should be inspected. Trustee Dave Bergen invited the members of the CAC to join the Trustees on their next trip over to the island, tentatively scheduled for January 31st. APPROVAL OF MINUTES Moved by Jack McGreevy, seconded by Peter Young, to Approve the Minutes of December 3, 2008. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS DAVID BERWALD to reconstruct on existing foundation, a new two-story dwelling with new addition landward of existing foundation. Located: 1525 Aquaview Ave., East Marion. SCTM#22-2-3 The CAC did not make an inspection, therefore no recommendation was made. Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to SUPPORT the Wetland Permit application of DOUGLAS TIKKANEN to raise the existing dwelling, install new foundation, install new roof, windows and siding. Located: 680 Ackerly Pond Rd., Southold. SCTM#69-3-12 Inspected by: Jack McGreevy The CAC Supports the application with the Condition drywells and gutters are installed to contain run-off. The CAC requests consideration in relocating the dwelling to the southeast corner of the property, 60' from the wetlands, which will double the distance from the wetland boundary. Any modifications to the sanitary system will require a further review. The CAC also questions the concrete cover located adjacent to the wetlands. There is also a concrete culvert that should be referred to the stormwater run-off committee. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of GABRIEL SClBELLI to construct a 24'X 30' addition to the existing dwelling, landward of and connected to the existing dwelling by a heated passageway, and to install a new sanitary system. Located: 450 Cedar Point Dr. East, Southold. SCTMf190-2-15 Inspected by: Don Wilder, Anne Trimble The CAC Supports the application with the Condition all run-off is contained on the property, especially in the area of the gully. Vote of Council: Ayes: All Motion Carried DAVID WlLMERDING to construct a 5'X 46' fixed dock over an existing concrete dilapidated ramp onto an existing fixed dock and repair as necessary portions of the existing fixed dock. Located: Private Rd. off of Equestrian Ave., Fishers Island. SCTM#9-9-3.4 The CAC did not make an inspection, therefore no recommendation was made. Moved by Don Wilder, seconded by Doug Hardy, to NOT SUPPORT the Wetland Permit application of PAOLO & JEAN BLOWER to construct an elevated fixed catwalk measuring overall 4' X 205' within the northern section of the subject property. All decking to be open fiberglass grating and elevated a min. 4' above the wetlands. Located: 5865 Soundview Ave. Southold. SCTM#58-1-3 Inspected by: Don Wilder Vote of Council: Ayes: Don Wilder, Doug Hardy Nays: Jack McGreevy, Peter Young The motion was lost. PEBBLE BEACH LOT OWNERS ASSOCIATION to re-vegetate the beach access area with Bayberry bushes and Rosa Rugosa. Located: 5065 The Long Way, East Marion. SCTM#21-5-10 4 The CAC did not make an inspection, therefore no recommendation was made. FISHERS ISLAND DEVELOPMENT CORP. to reclaim and repave East End Rd., which is a private road extending from Oriental Ave. eastwardly approx. 4.5 miles to the east of the island. The plan calls for reclaiming the existing pavement to create a sub base, replacing old culverts with new larger pipes, grading and repaving, with two courses of bituminous concrete. Existing unpaved storm water leaks offs will be improved with rip rap in areas not adjacent to freshwater wetlands and stone trenches and landscaped swales designed to accommodate run-off from a design storm will be installed in areas near wetlands. Areas adjacent to the road disturbed during the grading process will be Ioamed and seeded. In addition, proposed construction of an 8' wide paved or boardwalk path to follow the road alignment for an approx, length of 3.25 miles. Design plans proposed a corridor approx. 12' wide be cleared, topsoil removed, processed gravel base installed and a final 2" pavement course of bituminous concrete. Any disturbed areas will be Ioamed and seeded. In areas where the path crosses freshwater wetlands, an elevated boardwalk with open grating is proposed. Located: Fishers Island The CAC did not make an inspection, therefore no recommendation was made. Moved by Doug Hardy, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit application of CHRISTOPHER PlA to reconstruct in place approx. 190' of timber bulkheading utilizing vinyl sheathing and to backfill structure with approx. 50 cy. of clean sand. Located: 5900/6000 Vanston Rd., Cutchogue. SCTM#118-1-2 Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of JOSEPH & HEIDI BATTAGLIA to demolish the existing dwelling, barn and chicken coop and construct a new dwelling and sanitary system. Located: 2000 Hobart Rd., Southold. SCTM#64-3-3 Inspected by: Don Wilder The CAC Supports the application with the Condition the existing non-turf buffer is maintained and the driveway is pervious. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit application of PINE NECK HOLDINGS LLC to replace the siding and windows; raise a portion of the rear roof 9"; replace in-kind existing screen porch; construct a retaining wall at the rear of the dwelling; and install an outdoor shower attached to the deck. Located: 1475 Pine Neck Rd., Southold. SCTM#70-5-40 Inspected by: Don Wilder, Anne Trimble The CAC Supports the application with the Condition of a non-turf buffer and the installation of gutters and drywells to contain run-off. Located: 3265 Park Ave., Mattituck. SCTM#123-8-22.4 Inspected by: Peter Young The CAC Supports the application with the Condition all future repairs comply with best management practices, ie. open-grate decking and non-treated lumber. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Don Wilder, to TABLE the Wetland Permit application of M,ARY R. RAYNOR to replace the existing wood bulkhead and wood retaining wall as exists, utilizing PVC bulkheading. Located: 575 Beachwood Rd., Cutchogue. SCTM#116-4-21 Inspected by: Peter Young, Doug Hardy The CAC Tables the application and recommends a comprehensive engineered plan for the mouth of the creek. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to SUPPORT the Wetland Permit application of MARK BAXTER to construct a single-family dwelling, sanitary system, driveway, pool, deck, foot path and 4'X 82' open grate catwalk. Located: 5805 Main Bayview Rd., Southold. SCTM#78-7-5.6 The CAC Supports the application with the Condition the driveway is relocated in order to prevent removal of the large trees, and gutters and drywells are installed to contain run- off. The CAC also questions the height of the proposed catwalk. Vote of Council: Ayes: All Motion Carried TED ASSANTE, JOHN DECICCO & RALPH PARISI to construct a 4'X 129' stairway with platforms down bluff in same location as previously existing stairs. Demolish and remove existing house foundation and undertake construction activities such as ground disturbance and clearing activities associated with construction of a new dwelling located no closer than 100' from crest of bluff. Located: 17877 Soundview Ave., Southold. SCTM#51-1-4 The CAC did not make an inspection, therefore no recommendation was made. MARY BURNHAM to construct a two-story addition to the existing dwelling, new deck, and new one-story fully detached garage. Located: Peninsula Rd., Fishers Island. SCTM#10-3-4.1 The CAC did not make an inspection, therefore no recommendation was made. Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of ERIC & PAULA NADELSTERN to repair and rebuild the existing elevated deck and covered area. Located: 1020 Northfield Lane, Southold. SCTM#71-1-18 Inspected by: Don Wilder The CAC Supports the application with the Condition no treated lumber is used and all run-off is controlled. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND WETLAND PERMITS AND COASTAL EROSION PERMITS JOHN & JOY GALLAGHER to Amend Permit #5745 to position the 6'X 20' floating dock in a "T" position off the existing fixed dock. Located: 730 Bayview Dr., East Marion. SCTM#37-5-4 The CAC did not make an inspection, therefore no recommendation was made. Chairman Don Wilder will attend the next regular meeting of the Board of Trustees scheduled for Wed., January 21, 2009. The next regular meeting of the Conservation Advisory Council has been set for Wed., February 11,2009 at 4:30 PM at Down's Farm Preserve.
