Dear Ms. Terry:
Delivered with this letter is the final coastal erosion
hazard area map for those areas within your political boundaries.
This action is required under subdivision 34-0104(3) of the
Coastal Erosion Hazard Areas Act. Also enclosed are a few
informational pamphlets and a copy of the Order that made
official the map for the Town of Southotd. These maps replace
any earlier copies of the preliminary coastal erosion hazard area
maps prepared by the Department of Environmental Conservation.
To prevent confusion, we suggest that you dispose of any
preliminary map copies.
This final map is a public document and should be made
available for inspection by interested persons. You will not be
required to provide copies to the public. Copies of coastal
erosion hazard area maps can be purchased for a small fee from:

Please keep the map clean and flat to preserve its quality.
Should replacement become necessary, please contact the above

ORDER OF THE
COMMISSIONER
WNEREAS:
I. The Legislature, in enacting the Coastal Erosion Hazard Areas Act,
Article 34 of the Environmental Conservation Law ("ECL"), declared the State
public policy regarding coastal resources to include the mapping of those
areas of the State's coastline most prone to erosion. [ECL §34-0102(1)].
II. ECL §34-0104(1) directs that a preliminary identification of erosion
hazard areas be prepared, on a regional basis, by the Department of
Environmental Conservation ("DEC"). Such preliminary identification shall
include a map depicting areas subject to erosion over a forty-year period, a
statement of long-term annual shoreline recession caused by erosion, and an
identification of land areas containing or comprisin~ natural protective
features. The preliminary identification for the Town of Southold, Suffolk
County, was completed in or about April, 1984.
III. On July 19, 1984, in accordance with ECL §34-0104(2), the Department
held a public hearing before DEC Administrative Law Judge ("ALJ") Susan DuBois
in the Town of Southold, to afford affected landowners and other interested
parties an opportunity to comment on the preliminary identification of erosion
hazard areas. Prior to such hearing and as specified in the statute, the
Department sent notice thereof by certified mail to each owner of record, as
shown on the latest completed tax assessment roll, of lands included within
such areas. Certified mail notice of the hearing was also sent to Francis
Murphy, Town Supervisor and to Judith Terry, Town Clerk, on June 18, 1984.
Notice of the hearing was published in the Long Island Traveler-Watchman on
June 28, 1984, and in the Department's Environmental Notice Bulletin on June
27, 1984. A copy of the preliminary identification was made available at the
Town Clerk's office for public inspection prior to the hearing.
IV. I have considered the hearing testimony, the hearing report of ALJ
DuBois dated February 20, 1986, and the potential erosion hazard in accordance
with the purposes and policy of ECL Article 34. Department staff have also
consulted with the Town of Southotd.
V. Upon review of the entire record in this matter, I find that the
final identification of erosion hazard areas represents an accurate depiction
of areas within the Town subject to protection and regulation under ECL
Article 34.
NOW THEREFORE in accordance with the authority vested in me under ECL
Articles 3 and 34, I hereby adopt the final identification of erosion hazard
areas in the Town of Southold, and ORDER that:
1. A copy of the final identification of erosion hazard areas in the
Town of Southold shall be filed with the Town Clerk;
2. Notice that the final identification has been made shall be given to
affected landowners and to the Supervisor of the Town of Southold; and
3. DEC staff shall maintain a current file of maps or descriptions of
all erosion hazard areas in the Town of Southold. Such information shall be
available for public inspection in the Department's Region 1 office and in
the Town Clerk's office in the Town of Southold.
