SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without further steps under SEQRA.
PROPERTY FACTS/DESCRIPTION: The applicant's 1.637 acre parcel has 230 feet along the east
side of Bridge Lane and is improved with a single-family dwelling as shown on survey prepared by
John T. Metzger, Land Surveyor dated July 14, 2005. The applicants' property is situated 1306 feet
north of the Main Road (N.Y.S. Route 25) and is located in the A-C Agricultural Conservation Zone
District.
BASIS OF APPLICATION: Zoning Code Section 280-14 (100-32), based on the Building Inspector's
July 25, 2006 Notice of Disapproval concerning proposed Lots 1 and 2 with less than the code
required 80,000 square feet, less than the minimum 175 feet of width (frontage) along Bddge Lane,
and with a proposed side yard setback at less than the code-required 20 feet from the division line.
The applicants' parcel as exists is nonconforming with a land area of 1.637 acres and conforms to
the side yard setbacks.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred to the Suffolk
County Department of Planning for review and determination under the Suffolk County
Administrative Code Sections A 14-14 to 23. In a reply dated December 13, 2006, the Suffolk
County Department of Planning confirmed that while General Municipal Law and the Suffolk County
Administrative Code mandate referrals within 500 feet from the boundary of a farm operation located
in an agricultural district (property to the east), these laws do not apply to applications for area
variances, the subject of this application.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on November 30, 2006, at
which time wdtten and orat evidence were presented. Based upon all testimony, documentation,
personal inspection of the property, and other evidence, the Zoning Board finds the following facts to
be true and relevant:

AREA VARIANCE RELIEF REQUESTED: The applicants wish to divide their 1.6-acre
nonconforming parcel into two smaller lots, as follows: Proposed Lot 1 with 40,002 square feet,
and lot width of 140 feet; proposed Lot 2 with 31,314 square feet and width of 90 feet. Each of the
two proposed lots will not meet the code-required minimum of 80,000 square feet and minimum
width of 175 feet.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the variance will produce an undesirable change in the character of the neighborhood or
a detriment to nearby properties. Allowing the variances will increase the density of immediate
neighborhood by creating two nonconforming lot where one currently exists. There are three lots to
the south consisting of 1.6 acre with a single-family house; a 1.4 acre lot with a house; and a 5.5-
acre lot. There is preserved agricultural acreage with a winery building to the east of the applicants'
property. The lot to the west is agriculturally preserved land. There are 14 lots to the north
containing approximately one acre each in size, and one lot further north near the railroad containing
9.5 acres.
2. The effect of granting the requested variances will be (and is) substantial, One of the proposed
lots will require nearly a 50% reduction of code-required lot size, The second proposed lot will
require an additional 61% reduction of the required lot size. Both lots will be narrower than the 100-
foot required width: 95 and 90 feet, respectively. One lot will have a 16-foot side setback, where 20
feet are required.
3. The difficulty is entirely self-created, It is a result of an attempt to subdivide an existing non-
conforming lot into two non-conforming lots.
4. The benefit sought by the applicants, providing a residence for their daughter, can be achieved
without the need for an area variance, by constructing an addition to the existing house.
5. No evidence has been submitted to suggest that a variance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood.
BOARD RESOLUTION: In considering all of the above factors and applying the balancing test
under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member
Weisman, and duly carried, to
DENY the variance as applied for.

We are in receipt of your request for comments regarding the above-referenced
application currently before the ZBA. The Planning Board reviewed the application at
their work session on October 23, 2006, and offers the following comments and
recommendations at this time:
This proposal will result in the creation of two (2) non-conforming lots in the R-

family residence. Lot 2 is 31,314 square feet and is vacant. As proposed, Lot 1
requires a lot area variance of 39,998 square feet and a lot width variance of 80

2. The Planning Board supports the proposed layout, which is consistent with the
nature and character of the surrounding neighborhood.

property owner, this proposal also requires setback relief for the existing
residence on Lot 1, which has a proposed side yard setback of 16 feet, where 20

pursuant to the Town's subdivision regulations.

When we built our home in the 1972/1973 time frame, this
area along Bridge Lane was zoned one acre and did not contain
many homes. Shortly thereafter, the Planning Board approved a
one-acre subdivision known as "Ismar Acres" along the easterly
side of Bridge Lane immediately north of your applicants'
property. We purposely placed our home on the northerly side of
the property so in the future we could setoff a building lot for
one of our children. Later on this area became up-zoned to an
Agricultural-Conservation District (A-C). In effect all of the
lots including your applicants have become non-conforming as
there is now a requirement of 80,000 sq. ft. for a building lot
with a width of 175 ft. What your applicants are proposing is to
setoff and gift a building lot to their daughter, Carroll Oman,
who resides with them, so she will be able to afford to build a
small home for herself on proposed Lot 2. Our daughter is single
and lives with us and although working full time, due to the high
land prices in Southold Town, she is unable to purchase a lot and
build a home for herself. Attached to this application are the

REASONS FOR APPEAL:
AREA VARIANCE REASONS:
(1) An undesirable change will not be produced in the CHARACTER
of the neighborhood or a detriment to nearby properties if
granted, because: the majority of the existing residential lots
in this neighborhood on Bridge Lane, south of the railroad
tracks, are non-conforming with the average building lot being
rectangular in shape with an area of approximately 41,000 to
42,000 sq. ft. in size with a lot width of approximately 130 to
135 ft. The granting of area variances will'not in anyway change
the pre-existing, non-conformity of these developed parcels and
will not result in a significant increase in the density of the
neighborhood causing any problems to surrounding properties.
(2) The benefit sought by the applicant CANNOT be achieved by
some method feasible for the applicant to pursue, other than an
area variance: Because of the current zoning requirements, area
variances will have to be obtained so that proposed Lots 1 and 2
will qualify for a minor subdivision. Therefore, the following
area variances are necessary:
Proposed Lot 1: requires an area variance for a
lot of 40,002 sq. ft. with a lot width of 140 ft.
Proposed Lot 2: requires an area variance for a
lot of 31,314 sq. ft. with a lot width of 90 ft.
Ail of the other requirements of the Bulk Schedule for this
residential district are complied with the proposal.
(3) The amount of relief requested is not substantial because:
in applying the required balancing test weighing the benefit to
your applicants against the detriment to the health, safety and
welfare of the neighborhood. Viewed in a vacuum the area
variances as requested, as measured against the current Bulk
Schedule, are substantial. However, considering the surrounding
neighborhood the proposed variances will allow one additional
house to be built in this developed neighborhood. In utilizing
the balancing test and viewing the neighborhood as a whole, it
is seen that approximately 100± acres to the east of your
applicants' property the development rights have been sold or the
property is being used as a vineyard. To the west across Bridge
Lane, the development rights have also been sold and the property
is being used by the Pugliese family for the development of a
vineyard and winery. The point being is there will be no future
subdivision development in this neighborhood.
The proposed lots although slightly smaller than the
existing non-conforming building lots in this neighborhood will
not cause an adverse effect. Proposed Lot 1 will be almost
identical with the size and width of the existing building lots
on the easterly side of Bridge Lane. Proposed Lot 2 although
smaller in size containing 31,314 sq. ft., due to the size and
shape of the house proposed to be built on it by our daughter,
will also be in conformity with the shape of the lots and
character of this neighborhood. Therefore, utilizing the
balancing test, it is submitted the granting of the variances to
allow an additional house will not cause any detriment to the
health, safety and welfare of the neighborhood.
(4) The variance will NOT have an adverse effect or impact on the
physical or environmental conditions in the neighborhood or
district because: it is submitted that both proposed Lots 1
and 2 will be in general conformance with the size and shape of
the improved existing non-conforming building lots on Bridge
Lane. Your applicants' existing home on proposed Lot 1, and the
proposed future home for our daughter on proposed Lot 2, will
comply with the front, side and rear yard components of the Bulk
Schedule. Further, due to the topography, setbacks and
landscaping, it is submitted there will be no adverse effect on
the neighborhood by allowing the construction of this house.
(5) Has the alleged difficulty been self-created? (X) Yes. Does
this variance involve as-built construction or activity (X) No.
The self-created hardship was caused by your applicants waiting
too long to setoff a lot for our daughter. The granting of the
variances will not establish a negative precedent. It will be in
the nature of providing affordable housing for your applicants'
family. Your applicants' request is the minimum variance
practical, given the benefits to your applicants.
This is the MINIMUM that is necessary and adequate, and at the
same time preserve and protect the character of the~rh~

FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project or action ma'/
be significant. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of
