SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
PROPERTY FACTS/DESCRIPTION: The applicant's property contains 21,000 square feet with 100 feet along
Watersedge Way and a depth of 210 feet. The property is improved with a single-story frame dwelling, as shown on
the August 2, 2005 survey prepared by Pat T. Seccafico, L.S.
BASIS OF APPLICATION: Zoning Code Section 280-116B, based on the Building Inspector's June 17, 2007 Notice
of Disapproval concerning proposed additions and alterations to the existing dwelling, which new construction will be
less than 75 feet from the bulkhead, concrete wall, riprap or similar structure adjacent to tidal water body.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred for review as required under the
Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued
its reply on July 25, 2007, stating that this application is considered a matter for local determination as there appears
to be no significant county-wide or inter-community impact.
LWRP: TOWN CODE CHAPTER 266 DETERMINATION: After referral of this application for review by the LWRP
Coordination, a July 17, 2007 letter was submitted to the ZBA stating a Determination of Inconsistency was issued
under Chapter 265, Waterfront Consistency Review of the Town of Southold Code and Local Waterfront
Revitalization Program (LWRP) standards. Board Members have visited the site and evaluated the recommendation
submitted. The Board finds that the requested area variances are related to setbacks for proposed additions and
alterations which will be more in conformity to the code requirements than the existing dwelling, without excavation
by heavy machines, without filling and without grade changes to the property, shown on a detailed site plan prepared
April 9, 2007 by Eagle Design Associates. On the north side of the dwelling, within the 75 ft. Zoning Code and 100
ft. LWRP limitations, is a proposed addition and alterations for a new one-story screen room with second-story deck,
all of which will be at least 63 feet from the bulkhead. The new addition for a second-story, to be built mainly over
the existing lower floor and foundation, is also proposed at last 63 feet from the bulkhead, which addition will be over
the existing first-floor and existing foundation of the dwelling, except for the second-story deck which will be 67'4"
from the bulkhead. The remainder of the new construction is shown at least 75 feet from the bulkhead as required
by Chapter 280-116 of the Zoning Code. The existing northerly setback shown on the August 2, 2005 survey
prepared by Pat T. Seccafico, L.S. between the dwelling and the bulkhead is +/-52 feet, measured at its closest point
from the one-story dining room to the bay window. This section of the dwelling will remain as one-story and will not
be altered.

Conditions will mitigate concerns for roof water runoff with the use of drywells and a complete leaders and gutter
system and the applicant will be required to conform to the Trustee regulations, conditions and recommendations set
forth in Trustee permits.
The application, as proposed, will meet the greatest reasonable degree of conformity with the Zoning regulations, as
well as the LWRP, which mandates the highest standards of coastal erosion/wetland/water bodies protection
approved by New York State and Southold Town.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on August 2, 2007, at which time written and
oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and
other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant is requesting an addition and alterations to her home which
will not meet the Zoning Code requirements for a minimum 75 ft. setback from the bulkhead.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment
to nearby properties. The nonconforming setback from the bulkhead existed for more than 20 years, since 7/18/88,
when a deck alteration was noted on 7/18/88 on town records. The new construction areas will be more conforming
from the bulkhead than the existing home. The land between the home and the rear lot line has been stable for
years and will not create a detriment to adjacent property.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,
other than an area variance. The home has been in this nonconforming location for many years with a
nonconforming setback from the existing bulkhead, the applicant has not other alternative but to request a variance
to alter and add new construction.
3. The variance granted herein is substantial.
4. The relief requested has not been self-created.
5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse
impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessan/and adequate to enable the applicant to enjoy the
benefit of altering and adding to their home, while preserving and protecting the character of the neighborhood and
the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New
York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Oliva, and duly carried, to
GRANT the variance as applied for, as shown on the survey prepared by Pat. T. Seccafico, Land Surveyor

dated 08/02/05 and the 4/9/07 Site Plan prepared by Dennis Oliver, subject to the following conditions:
1. All roof water runoff will be deflected by use of leaders and gutters into dry wells.
2. No significant changes of grade shall occur during and after construction within the 63 foot setback
(northerly yard area) between the home and the bulkhead.
That these ZBA conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's
diagrams or survey site maps, are not authorized under this application when involving nonconformities under the
zoning code. This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are
expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not
increase the degree of nonconformity.

has determined that the property landward of the 10' elevation contour as shown on the survey
prepared by Pat T. Seccafico, dated August 2, 2005 is beyond Tidal Wetlands Act (Article 25)
jurisdiction. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations
(6NYCRR Part 66 !) no permit is required.
Be advised, no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit.
It is your responsibility to ensure that ali precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation within Article 25 jurisdiction
which may result from your project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide
construction area) or erecting a temporary fence, barrier, or hale bay berm.

I have reviewed an amended site plan for the above referenced property. This site plan has
been prepared by the office of Dennis Oliver and has been dated 4/9/07. Please consider the

Drainage calculations have been provided and meet the minimum requirements of
Town code.
The proposed Drainage Design is satisfactory. (Please note, the installation of new
leaching pools should maintain a minimum horizontal separation of twenty (20') feet
from existing septic systems.)
This amended site plan has adequately addressed the concerns listed in my last report and is
considered acceptable. Hay bales and silt fencing should be used to protect the adjacent wetland
from potential erosion during construction. If you have any questions conceming this drainage review,
