paid by the party of the second part, does hereby grant and release unto the party of the second
part, the heirs or successors and assigns of thc party second part forever,
ALL that certain plot, piece or pareel of land, situate lying and being at I~ayview, in the Town of
Southold, County of Suffolk, State of New York, known and designated as Lot No. 38. on a
certain map of"Lecward Acres at Bayview" filed in the Office of the Clerk of the County of
Suffolk on June 4, 1971, as Map No. 5599. which said lot is more particularly bonded and
de. scribed as follows:
BEGINNING at a point on the northerly side of Leeward Drive distant 318.08 fcct westerly from
the westerly end cfa curve having a radius of 25.00 feet and a length of 39.27 fcct which curve
connects the northerly side of Leeward Drive with the westerly side of Topsoil Lane;
RUNNING THENCE North 2:5 degrees 29 minutes 30 seconds West along the northerly side of
Leeward Dr/ye a distance of 100 feet;
THENCE North 37 degrees 30 minutes 30 seconds East a distance of 404.21 feet;
THENCE South 73 degrees 02 minutes 50 seconds East a distance of 66.87 feet;
THENCE South 16 degrees 57 minutes 10 seconds West a distance of 106.~t$ feet;
THENCE South 37 degrees 30 minutes 30 seconds West a distance of 328 feet tot the northerly
side of Leeward Drive, the point or place of BEGINNING.
TOGETHER with all right, title and interest, if any, of thc party of the first part in and to any
streets or roads abutting the above described premises to the center lines thereof;
TOGETHER with all the appurtenances and all the estate and rights of the party of the first part
in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
he/rs or successors and assigns of thc party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premiscz have been encumbered in any way whatever, except as
aforesaid.
A.ND the party of thc first pml. in compliancc with Section 13 ofthe Lien Law, covcnants that
the party of the first part will receive the consideration for this conveyance and will hold thc right
to receive such consideration as a trust fund to bc applied first for the puxI~sc ofpaying thc cost
of the improvement and will apply thc same first to the payment of thc cost of the improvement
before using any par~ ofthe total of the same for any other purpose. Thc word 'party" shall be
construed as if it read "pm'tias" whenever the sense ofthis indenture so requires.
